    • But I'm not mixing and matching. Sure, when researching I do check multiple avenues, but when speaking, I will open a single post. The Fb post was made in March, it is now June, time has passed, and when the suggestion was made, no further information was given on how I should progress beyond "send a letter", which has meant that I've needed to start another stream - this one, but only after taking the time to research first.
    • hes not turning you away he is simply saying that you should stick to one channel of advice. he is perfectly happy with that channel being this forum, and he will help you   all he is saying, and I agree, is that you should stick to one help channel, not mix and match 3/4

    • Hold on @BankFodder, that was a bit harsh. I spoke with the EVRi complaints Facebook group to begin with, a user on that group told me to send a letter but didn't give any specifics. Here at CAG, I was looking more for specific help as I've never raised such a claim before, and wanted to be sure that my claim was correct, which is why I've researched information with the other groups too, to be sure; but you seem to have assumed that I've made some form of contact with the other groups, such that I find your comments and tone to be very unfair. And I do know a thing or two about forums, that forum users are unpaid volunteers, I happen to be a Tableau Ambassador, and so perform a very similar role helping others in an unpaid capacity

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Foum

 

I am new to this forum, I have a problem with a letter i received from Thames credit limited, in it it states that our company Activ kapital group, has due to the credit crunch decided to help its customers, by offering deal in that I pay them £150-00 in full and final settlement of a debt of £3401-45 if received within 10 days, letter posted 8/9/08, so i have until the 17th sep to pay up.

 

and they will update my credit file where appropiate.

 

does this sound right.

 

I have looked up letters to forum on activ and they appear to be a shadey bunch.

Hello and Welcome, DOZY.

 

Thats a new one on me, does sound dodgy, why would they write off over 3 grand :confused: unless they know they have no chance of recovering all the debt and are willing to chance their arm for £150.

 

Have you CCA'd them ? (What was the debt).

Dunno, but i only pay thames £2-00 per month on this debt, or rather my wife does ,as i have no income not even benifits , she pays from her pensions and pension credits, i just worked it out roughly that it would take 150 years to pay off this debt, maybe they have given up on me.

Dozy here again , no I have not had much time to send a cca letter asi only received the letter sat morning , it took four days to reach me , no doubt the first 3 in thames office

Ok now Guys , where do i go /what do i do , The letterheadings are excatly the same as previous letters from thames credit (aka Acktiv), phone numbers are all the same,as are addresses,agreement numbers are same ,ref numbers are same , My plan monday morning is to phone thames (activ) just asking about balance etc, not letting on about letter , to see if they bring it up, if they do would that seem ok to you on forum, Also how will i know that they will just take my £150-00 as part payment, tha way i look at it is this if thames brings up this letter when i phone , it would appear to be legit, also I feel that in that case the letter I have in my hand is a legaly enforced document. Please answer.

 

I currantly pay only £2-00 per month on this debt which by the look of things will run for 150 years!!.

Personally I would rip their hands off, however I would also demand that your credit file is updated as fully settled, and that you want a letter prior to payment that states

 

this is for FULL AND FINAL and that no other payment is required by either akticve kaptial or any subsiduaries abd that aktive kaptial will NOT SELL the remainder on.

 

then we can see how helpful they really are.

Hi forum

 

I phoned them this morning, its genuine deal , and because of delay in post arriving they have said I have till end of month to pay up.

 

now a question , I wonder if the credit crunch is going to effect other debt collectors, in this way , can i hope for more of the same.

Call me an old cynic but Thames offering to right off a debt for about 1/200th of its face value sounds too good to be true

A late post unfortunately. If you payed this I hope you sent it recorded. I would not put it past AK to claim it arrived after 10 days.

 

A monthly payment of £2 may be the reason for the offer, because it could cost them more to process.

 

AK we know you like to read these posts. Where is my offer? I will save you the effort. Like your last offer which I took up, I will pay the % of what is owed. Perhaps you will then grasp that any % of nothing owed is actually nothing.

I've had a similar letter, but not to the tune of £150 unfortunately. They are saying that "we may be prepared to significantly discount the outstanding balance in order to achieve an early settlement" etc.

 

I haven't replied yet. My account hasn't been with them long and I was going to send them a CCA request. What are people's opinions? Do you think that CCAing them will get their backs up and make them change their minds?

 

DOZY - not wishing to hijack your thread (I will start my own if necessary) but I'm sort of in the same boat and people are replying here.

Hi forum.

 

I rellie paid it off for me £`150-00, and received letter of conformation, stating its been settled, Now how do I check they have removed it from my credit file without spending bucks on it, will they mark it as satisfied or just remove it?.
