i have 3 debts currently with Frederickson two of them i have CCA'd the third however is a joint debt with an ex partner for a business that ceased trading in 1999. i am unsure what the debt is originally for i think it was a business bank account with possibly a card attached to it but cant remember.

as its a bank account i dont think i can CCA them (or can i?)

anyway the letters have started arriving for pay up this debt will not go away.

its not that i mind paying it if i know what its for.

any advice for how to find out

i have asked HSBC for info in branch but they dont have any records of any debts

they are all from 1999/2000

any clue guys

Could you possibly adapt the 'proof of debt' letter

 

Dear Sir/Madam

 

Account no:

 

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

 

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

 

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

 

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

 

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

 

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

 

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

 

I/we look forward to your reply.

I think you could ask for some proof that the debt exists, please wait for experience member to help with wording, I'm no expert but caution is needed so you don't acknowledge the debt.

i have previously payed metropolitan (HSBC inhouse monkeys) is that acknowlegment or does it now stop because it moved on?

i have previously had letters for this and have told them to chase other party ahve i now acknowledged it?

Sounds as if they could be statute barred. Six years with no acknowledgement or payment made is all it takes. I think you should write as saintly has suggested.

Nat West Bus Acct £1750 reclaim - WON

 

LTSB Bus Acct £1650 charges w/o against o/s balance - WON

Hmmm - even though you are not a consumer if it is a business debt I think you can still demand proof of its existence. OK you are not covered by the CCA but if it was a partnership then you still have rights. After all, how are they going to sue you if there is no proof that the debt exists:confused:

thanks for replies guys will give it a couple of days dont want to seem too keen:D also their 30 days run out next week for other debts dont want to remind em too much that i am out there:) will keep checkin for any more advice
