    • Hey people, I've been browsing this amazing forum for the past year and recieved a letter today which has made me require some help. Received a claim form from Cabot in the Civil National Business Centre in regards to an Aqua Credit Card taken out in 2018. I failed to make payments due to financial hardship and have not taken out any credit or uses any forms of credit since. Received a lot of letters from Cabot and their solicitors Mortimer Clarke which I've ignored    By an agreement between New Day Ltd RE Aqua& the Defendant on or around 26/03/2018 ('ths Agreement) New Day Ltd RE Aqua agreed to issue Defendant with a credit card. The Defendant failed to make the minimum payments due. The Agreement was terminated following the service of a default notice. The Agreement was assigned to the named Claimant. Cabot Credit Management Group Limited, acting as servicing agent of the named Claimant through its Appointed Representative (Cabot Financial (Europe) Limited), has arranged for these proceedings to be issued in the name of the Claimant. The named Claimant may be entitled to claim interest under the Agreement but does not seek such interest and instead claims interest under Section 69(1) of the County Courts Act 1984 at 8% p.a.from03/03/2023 until date of issue only, or alternatively such interest as the Court thinks fit THE NAMED CLAIMANT THEREFORE CLAIMS 1. 3800.82 2. INTEREST OF 379.84 3. Costs How would I go about this and what could happen? I don't remember much details about the card either.
    • cause like you said in post one, 99% of people think these are FINES (it now reads charge). and wet themselves and cough up. they are not, they are speculative invoices because the driver supposedly broke some imaginary contract by driving onto privately owned land which said owner may or may not have signed some 99% fake contract with a private parking co years ago, thats already expired or has not been renewed or annually paid to employ them dx  
    • My car DVLA details are 100% correct and up to date, guaranteed.  I lived at my address longer than I have owned the car and made sure the details were correct when we transferred ownership of the car, so it's not that.  It must be their second-hand eBay cameras.  I've emailed the CEO with evidence and laid it on.  I will keep this post updated with the outcome.  Thanks again FTMDave .  I appreciate the guidance. I hate these predatory parking cowboys.  How are they even legal?

    • upto you, if you have no assets like a home in the UK, there is absolutely nothing they can do even if they do get a judgement. i see you state last payment was 2021, so i will guess your notification to lloyds of a change of address was sent within the last 6yrs so they should have record of it on their system. why not give them a ring and ask what address they have for you? you could do AOS and defend the claim stating you are and have been resident in xyz since date, here is proof.  you could also send that to PRA demanding they discontinue the claim immediately. see what you can find out. you've till atleast the 19th (aos date) . dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all this is my first time on this forum.

 

Am having big problems at the moment with TSB over trying to pay my loan after changing to a different bank and they are refusing now to accept payment. Have a thread going for this in Lloyds forum.

 

Anyway have been so p***ed off with them and after reading a lot of postings on here I am starting to believe that I was mis-sold PPI. I took out a loan for £9,000 in about September 2004. I only wanted a £1,500 loan for a deposit on a car but the rep said that as i had a Lloyds credit card I would probably be overstretching myself with payments on this and the loan and it would be better to increase the loan to pay off the credit card. I agreed as i was only making the minimum payment on the credit cards and as the rep pointed out this would never pay off the card but the loan would be paid off in 4 years and debt free. When he started talking about PPI i told him ok as we were trying for a baby and i intended to take 12 months off but when he told me that it did not cover maternity leave I told him that there was no point i would be paying for something that i could not use. He told me however that on a loan of this amount I had to have the PPI. Stupidly I never questioned this and have continued to pay £300+ since. Having read many threads relating to Lloyds TSB this seems to be what a lot of people have been told. Anyway with all the problems I have had with them since my bank account was changed I have missed about 7 payments (because they refuse to take money from my new account and refuse to accept payment by internet banking or into my TSB account which is still open) but I was concerned when I was informed that the balance on the loan was still £5,500! As a result I have sent a S.A.R. and a CCA request. The C.C.A. request went into default early this week and i have heard nothing from them so waiting with bated breath to see if I get a response to my S.A.R.

 

Any comment no the above would be great as I am new with this PPI stuff and am not feeling very confident.

You are doing just fine, You have sent for your SAR and a copy of your credit agreement.

 

Nice to hear that they are already in default with the ca.:D

 

Do you have evidence that they will not accept your payments:???:

Yes i have evidence. When they didn't collect the first payment from my new bank account I got a letter from my new bank telling me that Lloyds TSB would not collect the payment. I tried phonong them but got indian call centre but got nowhere with them so I wrote to head office sending a copy of the letter I received from my new bank. They couldn't deny they had refused to collect the DD/SO they apologised and made a goodwill payment of £100 into my account for inconvienience caused to me. They also gave me a telephone number of the centre who could help me set up new payment facilities but again went round in circles them telling me payment can only come out of a select account by DD/SO so off my own back I then started transfering money to my old TSB account which was still open. I would transfer half the payment and as my CB and tax credits were still being paid into this account this covered the whole loan payment. I did this for about 4/5 months then in december i received a call from benefits who said that lloyds were now refusing to accept my benefits payments I also received a call from my new bank to say that the payment that i had sent to Lloyds for the other half of the payment had been rejected and returned to my account!!! so now no way at all of paying . Have written again when I sent my S.A.R. so who knows what response I will get. Not to bothered at moment as CCA request is in default so am just sitting tight until I hear/i month expires.
