In order to enforce the debt they must send you a true copy that conforms with the CCA in that the agreement must include certain prescribed terms. See here:

Creditors very often cannot do this, which means that, although the debt doesn't disappear. it makes the debt unenforceable

so there is a chance that my creditors may not be able to do this. i have debts with the following,

barclaycard

mbna

tesco

Natwest (credit card, loan and 2 overdrafts).

Capital one

 

Those silly borrow money for a month companies (who charge way too much interest if you do not pay on time)

 

freemans catalogue

littlewoods catalogue

HFC financial

 

does anyone know of any of these not being able to provide the CCA?

best way is when you make a payment take £1.00 off of it, sit on it a week max then send the CCA request, you need to do it at least 2 weeks before next payment due date. if they don't furnish you with the CCA by the next payment date you don't pay it.

 

simple :)

 

catalogs wont have CCA's but you still gotta do it. apart from the loans, the credit cards are likley to be application form NOT an agreement.
