Hi I am in the middle of claiming my charges back from monument credit card.

 

I have noween informed that they have sold this debt onto a legal company - Had letter today.

 

I telephoned them to ask why they had taken over the bill even though I am in the process of a claim.

 

They could not answer and are pursuing payment.

 

Can monument do this?? Does this mean I cannot claim my charges back?

Yes, they can do it as the account is not (yet) formally in dispute. You can still reclaim the charges - keep on claiming them from Monument.

 

Also, write to the debt collection agency and tell them the account is in dispute because Monument have the amount wrong (because of the charges) Head the letter "ACCOUNT IN DISPUTE" in big letters. Copy that letter to Monument.

 

It is probably worthwhile sending letters to both asking for "a copy of the executed agreement under s78(1) of the Consumer Credit Act 1974". Send a £1 postal order to cover the statutory fee and remind them that the statutory period for them to reply is 12 days.
