  1. Thank you for that. In a good way... I am a horder when it comes to paperwork and have all bank statements and receipts, the council admit they had money from this bailliff but say there new system wont let them allocate the money therefore they are unsure what is owing...??? I have no paperwork proof from the council what is owing and from when. I requested a copy of the 2001 bill with the payments I had paid and they said the new system wont allow it and therefore have no paperwork??? in the meantime Jacobs are seeking to take my car.
  2. I have telephoned the council who said they applied 4/11/2002 for the liability and are sending me the paperwork. But the council have had my bank statements from 2001 showing all payments to a different bailiff
  3. Please can someone give me advice. In january I received a visit from the bailliffs for £190.93 (including costs) for council tax for 2001 I contacted the local council to inform them I felt I had already paid this. to cut a long story short after providing paperwork and many calls, I had another visit today with 7 days to pay, the council inform me they could not allocate all the monies I paid over the years and therefore need to deal with the bailliffs, (who wont listen and want the money) The council are now refusing to provide paperwork from previous payments to allocate against bills. I have done the necessary calls, letters etc... How do I stop these bailliffs till I can sort out and prove whether I have paid or not.???
  4. Hi I am in the middle of claiming my charges back from monument credit card. I have noween informed that they have sold this debt onto a legal company - Had letter today. I telephoned them to ask why they had taken over the bill even though I am in the process of a claim. They could not answer and are pursuing payment. Can monument do this?? Does this mean I cannot claim my charges back? Help please

  6. Hi, Been having a read of the above posts. I am in the process of claiming from monument. Not sure I am doing it right tho. My charges are as follows: £369.17 (Total spent on card) £606.96 (Paid on account by myself) Charges: £119.91 Payment Break Plan ??? (out of work, unable to claim on) £168.00 Late Payment Fee £420.00 Overlimit Fee £315.81 Merchandise Interest £1.65 Cash Interest. I know I can only claim for late payment fee and overlimit fee, and I have calculated these with interest to £638.66 I have sent the paperwork to Monument, they replied with : Bla Bla offer £204.00 and a new bill of £805.22 with Payment break plan on again. I am obviously wanting to refuse the £204.00 and preparing a letter, but does anyone know where I stand on this payment break plan, I have requested this to cover me being out of work and they inform me that that is not the case as I am in arrears. I have also requested that they stop charging this but was also told no. Why am I being charged this??? Any advice on this would be really helpfull Thanks
  7. Thanks for the advice. I sent the letter back in november, yes I left it a long time, been so busy looking for new job and family. As for PPI I was unsure what it was and I cant remember even agreeing to this. Isnt PPI a protection if I loose my job? If so then why an I not claim? :?
  8. Hi I am quite new to this claiming lark and Im unsure on a couple of things... Can you help please.. I have got my statements and sent my letter with amount plus interest to Capital One, but since this letter and some time I have had more charges.. Do I add this into my next letter or start another claim? And also do I need to put in a claim for the PPI ? Thanks:?
  9. Hi MilkTrayMan I live in cheshire. Not sure on rules here. As for Tribunal its employments rights unit part of citizen advice, I have only just had the case details so I think its going to be long long process. He was actually ok to work for as bosses go just a shame he ended up being an ars... I am not the first and I wont be the last one he has done it to.
  10. Joa Thanks for advise. I thought they had put the details down for housing but was not sure. I will be on the phone I think tomorrow too. As for the backdated benefit, I am appealing on this as it was in my ex husbands name, I have requested full details on the overpayment but as yet have not received any information. We shall see on this. Maybe I will win !!!! or maybe I will win the lottery!!! chances of either are very slim.....

Thanks Milk Tray Man Unfortunately my local job center no longer deals with claims, I was told I could only do this over the phone, the paperwork came back from them on 5th September (with all details of my housing details ie: No of rooms, who I rent off, occupants etc....) As for the council offices, thats a laugh round here, we have a One-Stop-Shop (basically its a room with 2 people in that you all cram in to to discuss your problem) unfortunately they are not able to look into claims and can only note down details. And no I had no savings really, I just struggled along (and still am doing) I have good friends and family. I have looked on the net and most websites state that when you claim job seekers or income support then no extra form needs to be completed for housing benefit, but I am still not sure if this is the true case for our local area or everywhere? I do have a case going with my ex boss and he has had the papers recently for the tribunal case, he only has till 13 Feb to respond, so I shall see on that, he owes me 3 1/2 months so would be nice to see it. (not holding my breath) would be a great 2008 if he paid up and I am currently trying to claim past charges with a credit card company, so that would really make me smile if I got that too.... My first job tomorrow is spending a day at my housing place to see if I can stop the reposession or at least put a hold on it while I sort things out. Have 2 interviews coming up so will be keeping my fingers crossed that I get back in to working life again.....
  12. Hi all Need advice please.. Long story but will keep it short.. Finished work 31 august 07 (grievence - none payment of wages) Telephoned job center for advice, was told to make claim for job seekers, went through forms over the phone and was told they would be with me shortly. (in the meantime I was told by a friend that I should have been claiming Income Support) Its a long time since I have claimed so I telephoned job center and they said no problem they would change this for me. They requested wage details (I stated that this was in a claim as my ex boss would not give me any payslips) Anyway got the pay slips and details by end September and sent them on to them. 1st question - have I been told correctly that when I claimed my job seekers or income support my houseing and council tax benefit was included with form? OK October still no payments from income support, telephoned each week, also telephoned council to say I could not prove wages or benefit as I had not had them through yet, November still complaining as I am a single mum and no benefit through... end November had income support through and backdated hooray, went down to local council with papers rather than send them. Dec - had letter stating they would only go from date I went with papers and not when I finished work. I send response and stated reasons for delay. Letter back saying they would not backdate it but they are taking £9.00 per week from my housing benefit for a overpayment they have found in there system for 1998/2000 2nd question - Can they do this? I now have a reposession on my rent to appear in court in February as my rent is now in arrears due to this. I have informed them that with the £9.00 per week deduction and my child tax credit has been reduced by £25 per week (for overpayment) I am unable to offer a decent amount to pay off the arrears. Basically I have had a really bad few months and they just keep throwing more at me...

Not feeling too bad thanks, just dreading christmas Sent both card companies letters re charges, got one back with offer of "well nothing really" the other is still phoning day and night, i have had 6 this morning, I told them I wont give my date of birth so they told me phone them, I did and they want my date of birth again I told them if they want to deal with this they must realise that I wont give my date of birth. hey they hung up them called me again on my mobile and house phone. really need to send a letter about the harrasment.. sitting here with my curtains shut, think shutting myself away will stop them butknow it wont. Think I need a kick up the backside to bring me out of this. Will get there Im sure. :-| x

I have all my statements and they are all documented in my computer I am not sure which charges I can claim for but I will be reading the relevent info 1st.   18. Hi, Someone has probably already wrote the same problem as me, but if I dont speak out I think I am going to loose it big time. I owe two credit card companies, or should I say I have paid over £400 in charges already and still owe another £300 on each. I am looking into taking this further but the state of mind I am in at the moment it not helping. I lost my job 3 months ago, and one credit card company in particular phones me over 6 times a day every day, I even get them at 7 in the morning and 8 at night. Its Sunday today and ive had 4, I keep telling them that I am unemployed and a single mum, they shout at me and tell me I HAVE to pay something, they even tell me to borrow of my family and friends. The other card company phones a few times a day too but because I refuse to give them my date of birth when they phone they are not geting anywhere. Can they keep doing this too me, I told them this morning that as it was Sunday and I had people at my house that I was not going to deal with it. They then phoned me again but on my mobile, I told them again the same thing and the man started to shout at me, I told him I had no money and could not pay, he told me that was not true and that I can afford some payment. Believe me I have NO money, I am even selling things to buy for my kids this year, the only luxury I have is my computer and the internet (sad YES) but at the rate im going this will be gone too. Can someone please advise me on what I should be saying to these credit card companies that are making my life hell. Thank you
  19. Hi all Need help please. Sent my first letter to RBS to claim my charges back. Had a letter back stating "we believe the charges are fair etc, however the bank is awaiting the OFT to finish with proceedings. Well basically they have sent me a 2 page letter that I havent got a clue what they are talking about. It does state that they will keep me informed. Are they just hoping I will forget or is this letter an explanation to say they will deal with my claim? Has anyone else had one. Really am thick at all this. Wouldnt be doing this but they charged me £35 for a missed direct debit of £10 but I had well over that in my account, they said sorry and that they would give me £50 back as an apology but my credit rating on my account is low again (took me 18 months keeping it clear to get my rating up) Any advice would be good.   20. Hi Thanks for the help. I dont have internet banking but I will cancel my direct debit, (this has been going on for over a year) they take £16 then charge me Over limit fee, Late payment fee, purchase interest and cash interest and card protection (total out £69 each month) Many sleepless nights. Unless I pay the whole amount I am unable to stop these charges. They phone me constantly too... I will also look at the SAR thing. Thanks again.
  21. Ok. I have sat here for over an hour looking for the answers. Having a brain dead moment I think. I have a capital one card and I missed my payment dates - got charged for late payment then over limit fee, this went on for months. I kept up the monthly payments but didnt reduce. I then paid off the over limit fee to get it under my limit. Stupid again.. I was late paying. Basically this has now escalated and I cannot clear it off. I have this problem with another card too and I am paying both but both still charge me each month. (they set up a direct debit but this is under the stated payment required) therefore I am charged still each month. I have asked if I can increase my monthly direct debit and I am told no. Can they do this? Should I just go for getting back all the fees they have charged me (in total this is about £1,500 for both cards. Sorry if this is on this forum already Single mum (and dont know a thing about what I should be doing.)
