Chances are my bro has had a letter from all of the main DCA's that get such positive coverage on here (sarcasm). I have complained to the FOS about the fact that Natwest continue to farm out the debt to dca after dca whilst knowing full well that the amount is in dispute subject to acourt case which is stayed pending the outcome of the OFT test case.

 

I think the FOS will see this as unreasonable BUT the trouble is the timescales. Some harassment letters have greatly reduced the frequency of telephone calls.

 

The trouble is the time factor. Sure I could write letters to each 'new' DCA but why should I? (Not to mention the expense). I did consider popping into the local branch with my bro. I understand in general you can't do an awful lot in a Natwest branch but I wanted to do it mainly for my own amusement. To cause a scene in a dignified manner. Not screaming and shouting but simply to ask why they seem unable to perform simple tasks adequately.

 

I have no doubt that I'll probably be told the manager isn't available but I quite fancy watching the persons expression when I explain the situation (with his permission of course). I'll make sure I say the unlawful charges bit slowly and clearly.

 

Is anyone willing to bet that the best they can offer is to phone a department for him?

 

Any suggestions welcome.

 

I understand that the bank is passing the credit file to organisations but my point is they have not right to. NOBODY has the right to pursue the debt because it is in dispute. It is NOT the duty of the consumer to point out the errors of DCA's. However it does become futile when there is a new one every week.

I'm just waiting for all the info I need to send the biggest complaint to the FOS you've ever seen :grin:

If that doesn't go in my favour then I'm all fired up to drag them into court because of the disgusting way they've handled everything.

Your brothers not alone there's a few of us out there who have been messed about in exactly the same way.

A friend of mine is stuck too in a stayed court case with them which I feel is utterly unfair because they still keep applying charges even though she's stuck in the system.

I think when the test case is over all the banks should be forced to repay all the charges they have sneakily applied whilst you've been sat in a stayed situation ( there's wishful thinking for you ):)

Natwest : Witholding my statements & adding defaults etc , S.A.R sent Jan/08

Natwest for my partner : £2,101.00 won! Feb/07

Studio Cards : Refund for admin charges £108 Won! Dec/07

Complaint made to FOS for P.P.I Jan/08

Nationwide: S.A.R - (Subject Access Request) sent for statements Nov/07 ( waiting to see what happens in the OFT test case )

Littlewoods : defaulted on CCA request Feb/07

DCA's that crawled out from the woodwork and have crawled back : 28 so far!!

He's NOT getting anymore charges or interest so in that sense the stay is a good thing (assuming we get the outcome we want) but what really irks me is these idiots chasing 'debts' which they are not allowed to enforce. Why should I write to them? Why should he have to put up with them ringing him?

 

I think I'll make a scene just for laughs :)

I'll be seeing my MP as the situation is simply absurd. In the meanwhile another complaint to the FOS will at least highlight the issue.
