I have an old account with capital One which I defaulted on several years ago and which was eventually passed on to Intrum Justitia.

 

They are the most aggressive debt collection firm I have ever dealt with.

 

After reading a thread on debt collectors I copied a letter I found on the site asking them if they had bought the debt or were acting as agents. The letter quoted the Consumer Credit Act and said that they were obliged to send me the information asked for. I also put in the letter that under the OFT rules of Harrassment they were only to contact me by letter.

 

Suprise suprise 3 weeks after sending them the letter I got a phone call from them at 0855 today. The person on the other end simply talked over me as I was trying to explain my letter. They said that their client was aware that I had recently remortgaged and wanted a substantial increase in the agreed monthly repayment.

 

Can credit companies do random financial checks on you even if you are not wanting to borrow money.

 

Capital One have 20 days left to comply with my DPA request. Intrum Justitia have not yet supplied me with the information requested under the CCA.

 

I believe the capital One account to be loaded with penalties and have said that I will not pay any more to them until I have received all the info.

Okay,

 

I believe Cap 1 still own the debt as I have had similar issues.

 

If the account is in dispute they cannot chase you until it it resolved.

 

I contacted the ERC department at Cap 1 (I had to kick up a right stink to get through, even then they refued and I had to hang up and call again....)

 

I spoke to Nicola there and she put my account on hold for 28 days and also asked for details of the abuse I had recieved from NCO (DCA)

 

I would ask Cap 1 to do the same for you, and hold the account of you will complain under the Telecommunications Act 1984.

 

Good Luck (and write to Cap 1 too as they have the say NOT the DCA even if they tell you different!)
