  6. I wrote to them on 4th July last year advising that I had not received a reply to my DPA request. In the letter I advised them that I believed the account contained a large number of disproportionate penalties and requested that the account be placed on hold for 28 days after my receipt of statements etc. I received a reply asking me to confirm account details as they had no record. I replied on 31st July advising that the account number supplied was correct, but to date have had nothing further until the summons.
  7. Having joined the site last year and read the FAQ's I sent a DPA request to Capital One with payment. At the same time I sent a S.7 Consumer Credit request to their DCA (Intrum Justitia) asking for signed copy of the original credit agreement and sent the £1 postal order. I sent reminders to both parties but never received even an acknowledgement. Reading the advice of one of the moderators I left things in obeyance for another day. All letters were sent recorded delivery and the £10 cheque was cashed. I have today received a summons for the debt from solicitors acting for TBI Finan
  8. Had an offer from litigation department of YB offering all but £25 of my claim. I have run up a further £200 in charges since starting the claim, so I told them that if they were prepared to refund the addional charges then they had a deal. If they couldn't then I would start a second claim.
  9. Filed my claim with the court a couple of weeks ago. Received a letter a couple of days ago from the bank's litigation department, written in legaleeze but basically saying that the bank acted properly and in line with it's current schedule of charges. Hardly a defence. Does anyone know what to do next
  10. Received acknowledgement of service from court today. How can Black Horse defend not providing me with DPA request info. They were sent a reminder letter by recorded delivery before the deadline expired.
  11. Intrum Justitia are a DCA acting (I pressume) on behalf of Capital One trying to collect on a defaulted account from a few years ago. I read the thread about DCA's and sent Intrum the letter acting if they had bought the debt or if they were collecting it for Cap One. They have a few more days to reply but I am not holding my breath. The leeter stated that it was a criminal offence not to supply the requested info. Who do I contact and what action would I take against them for non compliance. I also sent a DPA request to Cap One but they have not yet replied

  13. RBS have filed an acknowledgement of service against my claim as they intend to defend it.
  14. I think we are in for a long wait - I sent mine on 9th June and have not heard anything yet. My account was passed on to Intrum Justitia who are the worst people I have ever dealt with. I am just about to report them to the OFT for continuing to phone me when I have instructed them to write. They talk to you like you are dirt and talk over you when you are trying to make a point. I am taking my claim form to court today against Black Horse Finance for failing to comply with my DPA request.
  15. I have an old account with capital One which I defaulted on several years ago and which was eventually passed on to Intrum Justitia. They are the most aggressive debt collection firm I have ever dealt with. After reading a thread on debt collectors I copied a letter I found on the site asking them if they had bought the debt or were acting as agents. The letter quoted the Consumer Credit Act and said that they were obliged to send me the information asked for. I also put in the letter that under the OFT rules of Harrassment they were only to contact me by letter. Suprise suprise
