    • Hi Dave. This morning I had another message from the owner, saying she's rung Booking.com again to ask them to sort the cancellation. And I just took a call from what looks like Booking.com's UK number. They offered us alternative accommodation but I had already found something on the Booking.com site two days ago. So we aren't homeless next weekend and Booking.com said we can invoice them after our stay finishes, so they can refund us the difference in cost between the original booking and the new one. Without your information on how property owners deal with Booking.com, I'm not sure the owner lady would have sorted this, so a big thank you from us. HB PS An email has just arrived from Booking.com. They confirm that the payment due won't be taken from my card - this was a concern obviously. I checked both my cards yesterday and I didn't make a payment from either of them when I booked. I couldn't remember when the problem happened because I made the booking a while back.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hya, I had a loan and a credit card with Egg and the debt was sold off to CapQuest some time back, who have added massive charges. Can I still send an S.A.R. to try and claim these charges back and if so, do I send it to Egg or CapQuest?

First NEVER talk to these "people" on the phone as they will try and get you to agree to anything.

 

Before you even think about making any sort of acknowledgement or payment to a DCA you MUST ensure that they have the LEGAL right to collect the debt.

This is achieved by requesting a copy of the Signed, Executed Credit Agreement via a Consumer Credit Act (CCA) request.

Is it important to start the letter:

I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY in Big Bold letters.

 

It is best to send this request via recorded/special delivery as there are some important deadlines to observe.

 

After 12 WORKING days the "debt" is in default and stays that way until the request is complied with.

If a FURTHER month passes then the DCA has committed a summary criminal offence and the matter should be referred to Trading Standards for action once the DCA continues to demand payment.

 

I hope this clarifies some things.

 

 

See what CQ have to say and then go from there.

Hya, I'm afraid it's too late for that, I've been paying them a nominal amount for quite a while and refuse to talk to them on the phone. They did have my number from Egg and harassed me until I sent them the harassment by phone letter from this forum, they stopped phoning me and agreed to remove my number, they have at least stuck to that.

 

Have I blown it then? It's something that I honestly didn't know I could do anything about until reading through this forum.

Its NEVER to late to CCA a DCA.

 

You MUST ensure that they can legally collect this debt.

 

As and when they comply with your request then get a SAR into Egg and go for the charges, hey there's nothing stopping you doing that at the same time as the CCA.

Another part of CCA is to confirm if CQ are entitled to add any sort of charges at all, normally a DCA isn't allowed to at all.

it never too late to send CCA so dont worry.

 

send cca to crapquest (they are bout 20 miles down the road from me) and send egg a S.A.R to check for charges.

 

i hadd credit card go to crapquest and was paying something silly on and off, they got snotty and threatend me, I then found the Consumer Action Group, I have never heard a word since :D

like us lot when you 1st start out, you get replys fro dca's that will send a shiver down your spine. the more you do it the easier it gets. my case now I cant wait to get home from work and rip open the post to see what just i get from a debt collector

I've had successes with bank charges thanks to this fantastic forum, it just didn't click that I could do something about the credit cards too :)

 

The thing is, these people don't expect you to fight back do they? They just expect you to lie down and accept it.

DITTO CB, i started bugging the OC's now and have the odd court order or 5 on the go, dca's know when they hit a brick wall, i now send letters to dca's just to annoy them whist i wait for a reply from any of them, for example no threat letters now for 4 weeks :( so i wrote 1 out 2nite to cabot given em 14 days to cough up a CCA or i'll take them to court :D (had a drink 2nite and got in the mood for a letter session (poor them))

 

soz it the only way to keep ones mind active and to supress the boredom of waiting for a threat letter

lol ananya, yes while it easy to get use to court orders and stuff, you wait till you are further down the line, it can get bit boring hence why the odd wake up letter gets sent to them, purley just to remind them that "HEY HERE I AM, DON'T FORGET ABOUT ME PLEASE, I MISS YOUR PATHETIC THREAT LETTERS" lmao

TRUST me when i say it more like confuses them when your chasing them for a debt that they "Claim" you owe them.

 

me personally like to string it along a little to drag it out (especially when I know there nowt they can do) yet again it starts gettin a little boring like 6 months or so later so you go in for the kill. to date when i go for the kill I either get no response and they vanish off face of earth OR get letter "We have decided to close your account and will not be in contact with you reguarding this account any further"

 

end result GAME OVER (for them that is) :D

Hi Curly Ben, Could I ask that you expand on this as CQ have added a large amount on a credit card debt they purchased from Egg, when I asked for a statement of account it was shown as interest. I have the CCA (from Egg) and it looks 'complete'.
