Hi There, I've spent about an hour looking through this site after receiveing a link through my e-mail and i'm gobsmacked at the things i've read! I bank with Lloyds and have always had major problems with them! I've already printed out the draft letters and some of the FAQ's so i'm going to spend the day planning my attack!

P.S Does anyone know the correct address to send the first letter to Lloyds. There are a few different ones on the threads?

I'm quite prepared to take this all the way after visiting this site! OOH I've got butterflies already!!

Hi All, Haven't posted anything for a while. I have received a final letter from Lloyds this morning advising me that they will not refund my charges. It's full of the usual standard jargon and it's advising me to pursue my complaint through the FOS. I obviously want to take the next step, Do I just send them a letter to say i'll be claiming or just make a claim? I know I might sound as thick as two short planks but i'm a little confused as what to send to the courts etc... I don't even know if i've posted this thread correctly, Lloyds are slowly frying my brain cells!! Pleas help..... Donna x:-o :confused:

Donna how far down the claim stage are you ?

 

Have you sent them a prelim letter.......followed by lba ?

 

Have they had 28 days to settle ?

Hey Martin,

Yes I've sent both letters, the last one giving them 14 days. They replied within the 2 weeks with a standard letter, they also said this is the last i'd hear from them. Should I just go ahead and claim now? Also can I just enter my figures in the excel sheet and it works out the 8%? Thanks Donna :p

Yes as long as the 28 days has elapsed you can proceed with your claim. Best of Luck :D

 

As for the spreadsheet enter the dates and the charges and it does all the legwork for you, saves you getting a calender out and using your fingers and toes and an abacus :p.

The preliminary letter gives them 14 days, the LBA gives them a further 14 days, once the total 28 days have elapsed you can file your claim.

 

So it is 14 days from receipt of your LBA, which is deemed to be 2 days after posting via first class post.

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

No it's 28 days from the date you sent the 1st prelim letter, so 14-days for that, LBA sent - 14 days from that - then you can progress with your claim. It's just basically to show that you have given the bank reasonable time, which 28 days is.

The 28 days is not set in concrete,if you have had a reply to an lba and they are adamant they are not going to refund,then you can take this as their last response and go ahead.

If there has been no responses to any letters,then yes the 28 days is best allowed.

Same goes with the prelim.if they respond before the 14 days and dont agree to refund,that paves the way for the lba without waiting the 14.

 

The whole purpose of giving the 28 days is to give chance for dialogue.

 

If within this period it is made very clear that they do not agree and will not be refunding,then you have given that opportunity.

 

The banks are aware of this,and it goes some way in explaining their methods.....for example Barclays will respond to a prelim by stating they will look into your complaint and respond within 21 days.......clearly a stalling tactic.

Thanks that's made me feel alot less confused! I receive Child Tax Credit And Working Tax credit. Does anyone know if i put a claim through Moneyclaim online will I automatically be exempt or do I pay and claim it back? I've read a few other posts but I can't find any that says much about it? You cannot get exemption using online moneyclaim

However you will get it by doing this from your local court.

The paperwork is identical and the process is quite easy.

You could pick up a claims pack from your county court and fill it in at home.

 

The court staff are very helpful and there is help here too.

 

The difference is that you will not be able to monitor progress online and the timescales may differ depending how busy your court is.

 

Dont forget the fee for moneyclaim online is refundable in any case so you will get it back.

They will give you a complete claim pack

Easy to fill in as theres a step by step inst lleaflet.

 

Fillin the exclusion form and take it back with the completed app with proof of entitlement.

I've filled in my claim forms and worked out the 8% and got a total.

What about the normal interest? The one I included in the prelim stage when I approached them for a refund of charges? Do I work out a seperate sheet and include this with the claim? I'd be grateful of any help as i'm hoping to return the pack tomorrow! Many Thanks Donna

You'll need to attach a breakdown of how you arrived at the figure you are claiming. You can do this by using the advanced excel spreadsheet to calculate all of the interest for you. Then print out the result and attach it to your claim. The normal interst is the interest you were charged on penalties. You can claim 8% interest on both the charges/penalties and the interest on penalties. So your total should be made up of charges, overdraft interest and 8% interest.
