      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello there,

 

I've been thinking (oh no! I hear) anyway, what do you all think about this. St Albans Beer Fest 27th september. Google St Albans Beer fest and the scene is set. Dr Feelgood on at Alban Arena. The date gives good time to circulate as well.

 

Hope the Sun is making the CAGS Feelgood!

Hello!

 

I want to make 27th September the date for meet hooray!

 

I do hope we can get a few of us together even those who feel St Albans doesn't do it for them!! There's beer and music that's got to be good:D

 

B'ham sounds fab and I must check the site to see if there are transport suggestions i.e special deals by train or Nat Express. Please post on here with those details as well.

 

I'm in Court soon with Nat West and it will be the final hearing. It's been going on for 8 years! I wish I had found CAG earlier and I could have had a claim for charges won ages ago, and I wouldn't be still dealing with it. I don't Bank with them so it is a side issue.

I'll add the date to the thread and check my diary too. However with Brum and Nottingham on the horizon, and possibly a trip to Devon/Cornwall too I'll have to do my sums too.:(

I visited St Albans Arena and got info for 27th. It is £4 for the whole day which includes Dr. Feelgood. It is organised by CAMRA so wondered if there could be a CAG representation. Tickets can be bought on line in advance. Ask any questions and I will look into.

Quick update. Rang Alban Arena again today, will post phone num tomorrow. There are 150 tickets left for Dr Feelgood. After 4pm it is £4. for Dr Feelgood and entrance to beer Fest. Between 9am and 4pm it is £2 for the beer fest and then if you want to see group you pay £4 in addition to the £2. Do we have an idea of who may be able to attend can we start a list? I will post more details tomorrow. If you are a member of CAMRA- Campaign for real ales- it is free. Is castlebest there? There is of course the quiz if we can get a group, with prizes! I will check to see if any ticks are being held back to sell on the day.

Hi Guys,

 

The num to ring for any details of tickets is 01727 844488. If you want to speak to a real person just go through the options. The beer Fest is actually in the stage area itself so if you did purchase a £2 ticket you could well just stay there for the Group to play. This is only an assumption of mine so you could buy a £2 ticket and see what happens on the day. I am told the 150 tickets left for the pm session of £4 is the total amount to sell and there may or may not be any available on the day. The web site for accommodation is St Albans District Council - Tourism - Accommodation - Guide The tourist info office is 01727 864511. I will post any more useful info as found as I want to check out places to stay in a brochure I was given to see if any special deals or really good value for money hopefully as cheap as chips. I will contact Sillygirl on thread to see if she can make it and any ideas for travelling.

I do understand this meet would be very near recent meets just taken place but it will be great if you can make it. I am keeping an eye on any Christmas meets which I intend to attend. If there are more than one, I will probably opt for nearest. I thought I saw a London Meet can we link this thread to that and any other Christmas meets. It feels like it's been Christmas all year weather wise, without the pressies and good will!! Ah well the Banks are racking up the interest on bank charges not being refunded so they're alright.
