    • I am sorry I am not aware of this report from IAS assessors? The Court will consider my application at a online hearing in June. The Court instructed me to send Bank copies of my sons condition proving he could not have been the driver I have heard nothing further. My son is not aware of any proceedings I have not involved him to avoid causing him distress, he has been sectioned a fair few times and I need to avoid this happening.
    • I am very pleased that the Court has taken the decision to allow you to  represent your son and hope that he is happy enough with that to relieve the stress he will also be feeling. I do agree that Bank parking are so insensitive, greedy, horrible etc etc to continue proceedings considering  in what it is a very minor case of a wrong number plate . Even their  own  IAS Assessors, who are normally hopelessly biased in favour of their members, went out on a limb and said  " The Operator's evidence shows no payment for the Appellant's vehicle, or anything similar. It does show two payments for the same registration in quick succession. I would take a reasonable guess, based on the circumstances described, that the person paying has paid for the registration of the person they assisted again." That is damning evidence and you must take that report with you as well as including that in your Witness Statement which we will help you with. I would expect that Bank would discontinue the case at that point.  But I am sorry to say  that you should not count on it.  
    • Evening all,   I have deliberated over this offer for two weeks and I have decided to take their offer. I do understand that some may prefer us to go to court and receive a judgement but with our personal circumstances and my current military commitment that could become an issue. I am so grateful for all the help and support you have all offered me over the last few months.     • When I first responded to the PAPLOC, and received that 29 page junk back it was accompanied with a letter saying that they had already responded to my request back on Feb 18th 2023,(I never received it). I was just clearing out some paperwork today and found a letter from Lowell, dated Feb 17th 2023, explaining that they were still waiting for the documents from PayPal, and my account was on hold  until further notice.  Does this mean they were lying and can it be used against them if this goes any further? I have now filed my defence, and have had an acknowledgement from Overdales and the court. A little threatening from Overdales , explaining that part of my defence was invalid because they have now complied with the CCA, and they were still waiting for the Default notice from PayPal.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I havent heard anyone mention that since giving up theyve put on weight - am I the only one?

I dont smoke now but I cant stop thinking about food and cooking it! - yesterday made a chocolate cake covered in flake and buttons, and a sticky toffee pudding with toffee sauce and topped with double cream!,hungarian goulash and 3 more xmas cakes!! - I love food!!!! - I wasnt like this when I smoked though:( its like I have gained this tremendous appetite - but ive just bought paul mckennas ' I can make you thin' book - I'll let you know if it works............but he has a hell of a job on his hands:) :)

Weight is always an issue for me due to an under-active thyroid. I have to say though that cooking would not be on my list of things to do, although I really like good food. I craved something nice last night and went to the supermarket. I wandered round looking for something to take my fancy, but years of being broke means I can't bring myself to spend a fortune on big cream cakes etc, especially as half the time the reality isn't as good as the anticipation.

 

I bought a pineapple which is scrummy, and have still got a good half of it left. When I gave up smoking I did loads of knitting to keep my hands busy (hope that doesn't make me sound too ancient, lol), but the point I'm making is perhaps you could try something else creative to keep your mind and hands occupied. Really I guess I could also suggest exercise to distract you and keep your weight down, but that would make me a terrible hypocrite!

Perhaps we should start a thread in the BG on that Giz, although TBH I try not to let it worry me. When I can't find nice clothes to fit without paying a fortune I do get upset though. I often think people think I'm just trotting out an excuse for being fat if I mention it.

 

Mind you, you're a lot smaller than me, although I did manage to squeeze into the top you kindly lent me at the xmas do last year, lol.

:) Id find it hard to give up cooking - thats what I do best! I make wedding cakes and christmas cakes etc - I love baking. Funny enough when Im int he kitchen cooking - I rarely eat meals - I just pick now and then cos I'm busy - its when I am not doing anuything that I go looking for somethin gt o eat - so if I dont take the stuff into work that i v e cooked - I eat it!.

Ive tried weightwatchers - I think its expensive especially if you cant make it some nights and I only lost half an pound! - than started putting more on and this has never happened to me before - its only since I stopped smoking - I used to be able to eat what I liked and always stayed under 9 - 9.5 stone, so I tried swimmming and walking -but still put weight on. Now im trying the paul mckenna method which I have to say makes sense - its basically chew every mouthful of food about 20 times that way you feel fuller on less food and never let yourself go hungry - eat little and often when you are hungry. Thats the trouble - we wait until meal times by which time we are starving and its too much to expect anyone to then eat slowly so im doing it his way - the golden rule he says is - if youre hungry - eat:) and I have to say I like his style:) :)Ive known others go back to smoking because of the weight gain - its like your battling 2 things at the same time and its very hard - do you stop smoking and stay the same weight or give up and pile on the pounds ( or stones ).for some the weight thing is mnore important than stopping smoking, with me its not - Ive stuck it out 7 months so im not going back now but I only wish there was some pill or something you could take when you first stop to stopt he weight gain then more people would give up I think. Telling people to exercise is pointless if they dont like exercising , we all know we should exercise more but if you dont like it then its just no good is it ? Myself I prefert o try and eat healthy foods(well most of the time) - no greasy fry ups etc and I cant stand ready made foods from supermarkets I like to bake my meals at the weekends and then eat them through the week - that way I know what im eating - so lets see if all this works - ! i'll keep you informed.

Have a drink of water before you eat, or even when you feel hungry. Fills you up a bit first.

thats actually a good tip - I hate water but at work we have a water cooler and ive tried now and then having a drink when im hungry and it sometimes does surpress not only the desire for food but also for a cigarrette , also eating aniseed balls was recommended to a friend of mine when he stopped smoking.

I used to hate water, but I drink it all the time now, and it's great for all sort of things including headaches and clearing acne.

 

Also, if you still feel hungry after a meal, wait 20 minutes to digest the meal and you probably won't be hungry any more.

I gave up smoking the hardest way....it took a heart attack to stop me and that was in Nov 06 and havnt had a cig since BUT now I have gained weight and am now type two diabetic.....funny how I had to pay perscription charges for my heart tablets and yet now have an exemption card for all my tablets due to dibetese is classed as more of a life threat than the heart attack.....yes I know it seems bonkers. I still get the odd craving for a cig eventhough it's been so long since Nov 06 but then I smell the stale cig smell on peoples clothes as they walk by me when i'm out and it makes me gag.

GOOD LUCK to those of you who are fighting the this terrible habbit I am glad now I'm done with it forever

I to have gained weight and it has been three years since i have stopped smoking.

My dodgy knee has not helped either

 

but i would sooner put on weight than putting that crap they call smokes in my mouth again.

 

This image the media portray perfect people on tv,

as thin, gleaming white teeth and token ethnic minority needs to stop and people stop buying ino it

 

accept your self for what you are, inner beauty gives way to all that crap

 

only last month i saw a report on children as young as six with eating disorders for which they were not born with it

 

so if you are overweight, be happy, and lose it your own way and ignore stereotypes and dinosaurs

Hi postggj I gave up smoking 25 years ago went from 13s stone to 18 stone did not worry to much and gradually lost the weight again have been 14 stone for the last 10 years. Still have the SS nurse at the docs going on about me being obese, I dont care just enjoying my retirement now.
