Ok. I have sat here for over an hour looking for the answers. Having a brain dead moment I think.

 

I have a capital one card and I missed my payment dates - got charged for late payment then over limit fee, this went on for months. I kept up the monthly payments but didnt reduce. I then paid off the over limit fee to get it under my limit. Stupid again.. I was late paying. Basically this has now escalated and I cannot clear it off. I have this problem with another card too and I am paying both but both still charge me each month. (they set up a direct debit but this is under the stated payment required) therefore I am charged still each month. I have asked if I can increase my monthly direct debit and I am told no. Can they do this? Should I just go for getting back all the fees they have charged me (in total this is about £1,500 for both cards.

 

Sorry if this is on this forum already

Hi Ivy, and welcome

First of all i would cancel the direct debit, if they wont take a higher payment then why should you pay it by d/d?

Do you have internet banking? if so set up a payment on this, you can choose how much you want to pay each month

Secondly do claim your charges back, send a DPA SAR (unless you have all your statements and know how much they have charged you) which you will find in the bank templates library and include a cheque for £10 ok?

Thanks for the help.

 

I dont have internet banking but I will cancel my direct debit, (this has been going on for over a year) they take £16 then charge me Over limit fee, Late payment fee, purchase interest and cash interest and card protection (total out £69 each month) Many sleepless nights.

 

Unless I pay the whole amount I am unable to stop these charges.

 

They phone me constantly too... :evil:

 

I will also look at the SAR thing.

You can also send a letter regarding the harassment look in library!

Dont ever draw cash with your card, the rate is extortionate

Cancel the card protection insurance, you dont need it as if like me you are up to the limit anyway so if it was stolen the thief wouldnt be able to use it! lol

Same trouble with me for Capital One, but mine was a few years back now. As people have said, use the Bank templates in the library, get a folder and document everything you send/recieve. Send everything recorded delivery, and finally, don't be afraid to take court action, they're counting on you to chicken out!

NatWest - WON! £3350 Paid back

Vodafone - Default removed

Citicards - Judgement awarded for £1898, default remains though...for now....

Capital One- WON! Settled out of Court £392 + Default Removal!
