    • My mind is a blur so i cant recall exactly what the judge said at the end, but he mentioned that he would be making an order for Evri to make payment to me. I wasn't sure if the court order will also be provided to me, either by post or email - if anyone can shed some light please?
    • Agree with everyone here it's bang to rights. Looks like you just slightly jinked left in order to go right. Ultimately, your time saving attempt is going to cost you as I don't think you have any grounds to appeal. I'd just pay the charge and chalk it up to experience.
    • Thank you everyone!  thought to share some points from my experience in court today that may help others who are taking Evri to court: The judge sets out how the hearing will go and how each party should behave; while i was certainly feeling anxious/nervous ahead of the hearing (and I'm sure @jk2054 may have also observed this), the judge really does try to put any non-legal persons at ease; refrain from talking to the other party and instead speak to the judge if you have any questions/responses; the judge and the advocate spoke about tort of negligence - i wasn't sure how this applied to my case but the judge was questionning the advocate about this so i chose to stay out of this; the judge made reference to a historical case of Donaghue v Stevenson which established a duty of care; the judge observed that some of the points in Evri's witness statement by george wood needed cross examination but george was not present today for questionning; While i was claiming 8% interest, the judge pointed out that is the upper limit and that today, savings accounts give 4-5%. I therefore opted for 5% interest which was agreed to by the judge and the advocate; above all else, ensure you know your court bundle and have any notes to help you refer to specific sections - it helped me to structure my answers to the judge/defendant's queries, and point to specific evidence where i was asked to prove e.g., the value of the item. @honeybee13 - yes, will confirm when payment is received. I have emailed the Evri.claims email with my bank details and also provided them after the hearing to the advocate. @BankFodder message received and i am replying to it

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Got letter from FD today returning my cheque for £10 and telling me they will send the info by courier. Hope theyt dont close my account as they have excellent customer service- just have taken rather a lot from me in charges over the past few years- I know its £400 over the last two ( none for the last 10 months) but i had bigger financial problems before that

Im STILL: waiting for my statements. Am I being impatient or is everyone having to wait longer now. Originally I was reading about them arriving in a week but its over that since I received the letter saying that they wouldd be sent by courier

I'm exactly the same; it seems like forever I've been waiting for my statements. I received my letter saying they are on the way on 22/06/06 and still nothing!! :mad:

 

Its just making me more and more determined, so they’re not doing themselves any favours!!:D

Statements arrived today. Totalled up at £1468.50 in charges- most of them were where they sent me overdrawn with their charges and charged me again the following month :mad:

 

Goimng to do the peliminary letter now and send off today

I have received another sod off letter from FD in response to my LBA so looks like I will be filing a claim against them on Monday. How long does it usually take from filing to receiving an offer? Beginning to get a bit skint now.

 

Incidently they were going to charge me £30 at the beginning of this month for going 20 PENCE over my limit ( first time Ive been over it in 18 months) so I sent an electronic message asking them to refund it- AND THEY DID. When Ive asked before the answer has always be a big fat NO. Wonder why they suddenly changed their mind LOL

Well managed to withdraw that claim and have submitted a new oine- got to wait 10-14 days for my original money back unfortuantely

Good luck with it, you are one letter ahead of me, i am expecting to be told again to Go away again.then i will fill in the moneyclaim form on line i am claiming a total of £3143, sole account and £2500 joint account. So i have requested each as a seperate claim so it does not go over the £5000.

Is it just me or do you get the feeling it will all change with your claim, and even though all the other claims have been paid in full, your cliam will be the one who they take to court........

It seems FD are taking around 7 - 10 days to acknowledge the claim.

Egg Data Protection Act Statements arrived. On hold.

Amex to Remove Default - acknowledged didn't issue correct documents - default removed :) . £135 paid in full without Court

 

I'm on a roll now :rolleyes:

Well I sent back the letter rejecting the half offer on the 22nd- and am still waiting for the next offer. I notice that someone whose claim was acknowledged the same day as mine as already got their money.

Haeda letter from DG solicitors telling me that they were waiting for a response to the letter they sent on the 21st ( my half offer) so I have redone the refusal letter and faxed to thenm as well as posting another copy.

 

Waste of a week that was!!!!!!!!!!
