I don't consider myself to be in a financial position despite savings accounts, as the savings are for a purpose and i didn't think that it was reasonable for me to go into my savings to foot the bill for a hire car, with no idea what the cost would be/when i would be reimbursed. Principia are still having issues claiming back the hire car charges from the defendants insurers and i am at the stage where i need to provide bank statem...

So are you saying we should just tell the solicitor all this now or should we submit our financial statements? I am worried sick over this. Since the accident we have had countless calls from people saying we could get compensation for my son etc. We have asked countless times for the calls to stop. He was not injured, merely shook up and so we do not believe in compensation for something not necessary. We are honest people just trying to get through this mess....

Frankly companies like Auxillis (and Accident Exchange/Easidrive/Kindertons etc etc) operate underhand tactics like this all the time, but as frustrating as it is, from the other side of the fence you can only realistically challenge what you can prove to be untrue - which isn't often a whole lot (credit hire litigation is something I do a lot day to day). From your point of view, don't worry - your solicitors know what they're doing (they do this a lot) and as Ganymede said - a settlement before trial is the most likely outcome....

Your agreement with Auxillis will mention somewhere regarding your obligation to assist them in any litigation to recover the hire charges. To do this they instruct a law firm, in this case Principia, to deal with that side of things. How much did the hire charges total (i.e. was it over £10k)? And do you know if the other side's insurers have formally admitted liability for the incident? Without seeing the T&Cs it's hard to say what your obligations under that contract are. Sytner then uses Auxillis and everything was taken care properly but after 1/2 months I've received the contact from Principia Law where they will act for me to recover the HIRE CAR loses. I'm concerned about the terms and conditions where it's mentioned the costs (success costs + police report etc) that I've to pay that I was not aware! I was not aware of the need for an external company and hidden fees, can someone explain a bit more how this works ? Thanks in advance...
  6. ...a long call as lines were busy and then loads of questions to answer plus then being transferred to auxillis for hire car and repair questions. From the online account portal you click the claim button and it then shows contact number to ring to make a claim and the number shown is 08445611417. No mention that its a premium rate numberb except at bottom of page if you scroll down quite a bit which I didn't as just needed a number to ring to sort messed up car. Why a company like this is charging high call rates is beyond me, especially on a customer service claim line....
  7. ...ar and model ect.. It varies from £750 to £899 from what iv seen. The hire car company are Auxillis and have to claim hire charges directly from Aviva. That's who the 3rd party are insured with. I just feel like I am the one who has to do all the phoning around and as if I'm the one who is going to be at a loss for something I didn't do. I wasn't even in my car when it happened. I'm not sleeping, im stressed and I'm going to be inconvenienced. Iv got 3 children so its vital I have transport....
