  1. Jenny, The timings are:- Prelim - wait 14 days assuming thats what you said in it ! LBA - again 14 days. Submit MCOL (assuming you don't get any response) The defendant (the bank) has 14 days to acknowledge, and then 14 days to defend or satisfy, if they don't bother to even acknowledge, they get a straight 28 days from served date (usually 5 days after submission) All dates are calendar days, not working !!     You certainly need to expect it will 'go all the way' but there is no need to worry, there are literally 100's of posts in here to guide you, so you are far from going it alone !!

Sorry ATTA-GIRL (in defence me lud, how was I too know THAT) LOL Your daugheter does not need to tell the court anything until she has settled (either full or part amount) She does need to write back to the bank staing the following:- Dear bank etc etc Thank you for your offer to which I am pleased to accept, however this falls short of my claim by (amount £) and I am continuing with my claim through the courts for the full amount. You should be aware that failure to settle for the full amaount continues to incur additional costs and daily interest charges. I look forward to your immediate response and settlement in full for the amaount of (toatal of claim £) Yours etc etc Also if there is a clause in the letter which says the offer etc is cobnditional to a confidentality statement - she should cross this out, no comments, just delete it !!!   4. The interest is added up to the date of the submission. The claim No and your name is fine So . . just a very brief letter to the court - "please find enc my schedule of charges in support of my claim ref ??, I respectfully request that you attach this document to my claim file" Then a similar one to DG (once you 'officially' know it's them) just leave out the 'respectfully part' Steve.

  6. In addition to the 8% - you will also claim a daily interest rate based on the value of your claim, so the longer it takes, the more you get Almost better than working for a living !!

  8. I think DG are so bogged down at the moment they are at the brink of admin collapse, I bet they have drafted in temp staff, probably polish or romanians to help with the back log of claims !! ((NOT saying that there are lots of very capable polish and romanians out there - before I get complaints from them all))

Hi Katie, You need to remember the address you put in MCOL for the 'defendant' will be the address at which the court documents are 'served' and must include a valid post code, try looking on the mastercard staement, especially the small print on the back, there should be a 'head office' address or similar !! You wouldn't need to use 'mastercard' in the MCOL as this is simply a type name, the bank is the operator and will be liable for any legal dealings (I think)

    Hi, Firstly, yes it is quite normal for the banks to completely ignore all correspondence, although in fairness they seem ok at sending out copy statements etc !! As far as attaching a spreadsheet online - you can't !! you need to post/fax one when you receive the confirmation that your MCOL has been raised with the court, they will send you a copy through the post with all the info in it. Send a hard copy of your spreadsheet (the one with 8% interest added) to both the court and DG, recorded delivery of course !! Fitting the words in is trail and error it CAN be done, you just have to keep editing and changing until you get it to work - it's a little tedious, but it IS possible. Good luck !!
  11. Hi 666, DON'T forget any correspondence to the court or DG must be recorded (signed for) that way you have proof of receipt (but you knew that already didn't you ! ) As my trail suggests DG have until 14th to respond to my MCOL (28 day dead line) and the clock is ticking

    Once you submit your MCOL, and have paid your fee, you will after a couple of days receive a copy of the claim in the post, and also when (if) the bank acknowledge receipt you will see this update in teh MCOL web site, they (the bank) then has 28 calendar days to submit a defence (assuming they said they are intending to do so) Then it's a waiting game One thing you can then do to while away the time is to send a copy schedule of charges to the bank's solicitors DG in the case of HSBC, their address will be on the claim acknowledement form. Mark the date in your diary and wait my dear fellow - wait !!!

Hi Ian, Just one quick point, it would be best to treat your claims seperately, not add them together (in case you were thinking that way) Looks like your on the right road, read as much in here as you can, and ask anything your unsure of, and your soon be advising others that are then following your trail. Remember to carefully log everything you write and do, and keep your thread updated as a diary and so that others can follow and help as req'd
  20. Hi, The reason they "bury their heads in the sand" is really simple !! They gleam about £3 BILLION a year from charges and interest on charges from the UK, would you dig a very large hole and shove your CEO's head in it as well LOL

    Alan VS HSBC

    If you have got that far I 'hope' you have read teh FAQ's and alos as much from others postings in here, you will be fine, 100's have got as far as you and have sucessfully got their money back. I hope you also used the template letters from in the library section to compile your MCOL and calculate your interest etc. Any help ? just shout !!
  23. Hi Sharkie, Ideally you need to try and remember the month/year the actualy date is not important. You could ask the bank, I'm sure they would tell you (of course you might omit to tell them why you want to know) LOL Steve

Hi Babs, Nope - I have assaulted postie this morning, I think he is getting REALLY hacked off with me now, even said he'd check back at the sort office to make sure my nice 'fat' letter from 'DEBS' at DG hasn't fallen out of his sack or been posted to Santa by mistake. Sigh - more ruddy xmas cards - bah HUMBUG
