    Hi Nickm, oh yes, don't for one min feel honoured that you haven't heard a squeak from the bank . . it varies greatly !! Some folk hear straight away, even recieving an offer or full payment, others (like me) are just about to hit the judgement button as they have ignored the MCOL apart from an initial acknowledgement. Persevere, and you will win, everyone seems to in the end, but I know the waiting is so frustrating !!! Steve

Hi all, Lovethedam is correct - send a copy of your swchedule of charges directly to DG (recored del obviously) also send two copies direct to the court if you filed using teh MCOL online system to be attached to your file The letter to DG needs to a simple:- I refer to the above claim against HSBC Bank plc. This is the court reference) "Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act" The letter to the court needs to be slightly different:- case ref xxxx name xxxx date submitted xxx "Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to a total amount of my claim, namely £ "your amount" I respectfully request that the enclosed schedule be attached to the particulars of my claim"
  3. Hi Em, "panic not . . . fair maiden" !! If your LBA 14 day deadline finishes next Monday the next setp is to issue your MCOL (claim through the court) this will incur a cost to you, it varies dependent on the value of your claim up to a max of £120. You add this sum to your total claim (so u get it back) you also need to calculate and add interest at the rate of 8% There is lots of help in teh FAQ and Library sections in here and there is a excel spreadsheet that will help with the calculations If you get stuck, come back and we'll see if we can help (someone will) Steve

  5. ok, once you submit, tere is a 5 calendar day delay to be 'deemed as served' by the court - the defendant then has 28 calander days to deal with

  22. Hi Jessica, Please read through the FAQ's but yes you do add the 8% interest at the MCOL stage. You claim for interest on each charge that was over your agreed OD limit or would have caused you to go over you limit, so basically if you deducted all the charges from your statements as they were applied my guess is that you would be still within your OD limit (well . . you could argue that) Have you used the spreadsheet in the library to calculate your charges total, if you do it will work out the interest for you. have a look at http://www.cag-files.co.uk/barracad/Spreadsheets/England/Complex-bank-charges-calc.xls

    Hi and welcome on board ! Not sure about a 'managed loan' I take it you mean one that is with acollection agency, or is it being managed internally by the bank ?
