  8. Looks fine - personally I wouldn't bother with teh "withdraw the conditions part" just cross them out and counter sign, they can't ever use them in any way against you if you do that. My guess is it's a 'standard' template they print and send out and they may actually not be able to 'delete' that paragraph - it may just make things easier in the long run.

  13. I think it's the third rock past the moon at the moment babe !! I thought although they get 5 days from your submission for 'deemed to be served' if they actually acknowledge which they did in my case that would then be 'day 1' ?? (oh I don't know, I'm tired and really need a big hug) I have sent 2 e-cards to you so far - no wind up, hmm that's odd xx

Just another thought - I wish the bank had thought I might 'give in' - NOT that I would though, I say this because:- I haven't had one single response or reply to anything to date, I have sent my prelim, LBA and submitted my MCOL all recorded etc, and know by track and trace that all have been received, the MCOL was acknowledged the very next day, my 28 day deadline is at 4pm this Wed and I still havent heard diddly squat Let justice begin - sweetness comes to those who are patient - but THIS has driven me mental My point is that there is absolutely NO pattern, logic or even common good mannners from banks or their so called solicitors in my opinion Steve !!

  16. Hey yeah, Jim it IS judgement week - somehow I feel VERY nervous this week, how on earth will DG process all our claims, hey, whoever gets any post first gets the first round in . . . . . Clare did you get your e-card ? Babs, ironing I'm fine with, not sure about floor washing - isn't that what a dog is for anyway it would make my carpet all soggy LOL I take it from above that the deadline is 4pm on judgement day, do you count the day the acknowledged as 'day 1' or is it the next full day ?? Cos mine will either be this wed, or thurs, and I'll be hovering over that little MCOL button, but will prbably be shaking so much I'll miss completely Anyway ladies (and Jim) it's back to work I owe . . I owe (all together now . . . It's off to work I owe, I owe, with a mortgage, and overdraft, debit card or two . . it's off (ok, I'm going, bye 4 now gang)

You need to accept their offer withinthe time limit, but point out that you are still continuing with your claim for the full amount - if you wish to 'slightly' amend this, that should be ok, but you will need to bear this in mind if it goes all the way to court (which it won't) Have a trawl around as many threads as you can there is bound to a be copy of suitable treid and tested wording for a response to them. remember as they have already made an offer it is highly UNLIKELY to go to court, it would be a brave bank that stands in court trying to defend having already 'admitted guilt' by offering to settle Banks seem to follow no logic whatsoever !!!!

Hi Sacha, Once you submit your MCOL it will be prudent to send a paper copy direct to the court (probably Northampton) with a brief covering letter along these lines:- Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to a total amount of my claim, namely £ (your claim amount) I respectfully request that the enclosed schedule be attached to the particulars of my claim. Once you receive the copy of your claim from the court, you wll 'officially' know that probably it's being handled by DG solicitors (HSBC's 'in house' legal team, you should then also send a paper copy of the same schedule direct to them, this time you can simply say "please find enc schedule" remember to include the court reference (case No) and send both recorded delivery so you have proof. Sorry for the bold text, it won't switch off !! Steve.

  21. Hi, I think your worrying too much - firstly, they have in not so many words admitted liability by making an offer, so thet is good. You could accept their claim that you have made an error and do one of two things- Accept their current offer, saying you intend to claim for the full amount, but will amaned the claim with the court (this I 'think' will cost you £35) and continue as before, or you could say to the bank that you are prepared to deduct £30 + interest from your claim and now will accept the revised amount of £2595.98 so on this babsis £1500 is NOT acceptable In a nut shell why should you accept over £1000 less for a simple mistake (assuming they are actually correct) we are all human afterall !! I'm sure others will post and advise but that's the stand I think I would take ! Steve

  23. Hi, Lateralus is quite right you can access your credit data online, Experian and Equifax both have web sites and as far as I'm aware make asmall charge (£10) for supplying a full history Mine made scary reading LOL Steve.
  24. Hi Michelle, Likewise, welcome to CAG, there is literally 1000's of posts in here that will help you through the process of getting back what is 'your' money from the bank . . . As Bong said it can seem daunting at first, and even scary, but . . as your experience and confidence grows your soon be helping those yet to start on this . . Don't be worried about asking what might seem trivial or even silly questions, we all did (and still do sometimes LOL) Also by keeping all your posts in one 'thread' you will have a nice 'diary' of your own claim as it proceeds, and others can advise and also learn from your questions and the answers as they go Anyway, best of luck, Steve.
