  1. Hi Nymph ! I agree with Cooperman, they shoudn't close your account on just one claim, but may if you claim a refund on 2 or more accounts. I have started my proceedings against HSBC and my account is still up and firing on all pistons. Anyway good luck and keep this site posted on how you get on !!

    Hi Kirsty, Sorry I forgot to add a link to the templates:- http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ I think it's item 6 'interest calculation spreadsheets - I used one of the Excel ones, was fairly straightforward as they have formulae includede to do the sums bit !     Hi Kirsty, The £xxx refers to the amount of interest you have paid as a direct result of being 'hit' with charges. i.e. if you have a £500 OD limit and went over by say £10 you would most likely be have a penalty of £30 applied, Balance now £540 OD, you would then be charged interest on the original £500 PLUS more interest on the £40 over your limit (YES interest on the penalty as well !!! ) you have to trawl through your statements and add all this up (there is a spreadsheet in the templates section to help) This total interest amount is the £xxx figure Hope this helps -

Hi Tez, reading through all the numorus threads it seems pretty standard, stick with it and don't settle in part, accept any offer but let D&G know you intend to continue with the claim in full, so far I haven't seena single message that says it went to court . . . good luck keep the thread posted Steve_n

Hi Scott, It's all part of the delaying tactics - wait the 14 days from when they received your prelim, and send your LBA (letter b4 action) this time include your schedule of charges being reclaimed, remember NOT with 8% interest added (that's when it goes to court, IFget s that far) and then see what they do !!

The claimants accounts are governed by the defendants personal and / or business banking terms and conditions.As long as they are lawful ! 2. Pursuant to the defendants terms and conditions the defendant is entitled to make a charge for its services as set out in the defendants price list.Yes as long as it is deemed fair and reasonible given the actual cost(s) incurred by the defendant 3. It is denied that the fees charged for the services provided amount to a penalty or (if it alleged) a liquidated damages clause. It is denied the fees are an unfair contract term. The fees are an agreed price for a service provided by the claimant.Oh NO there not agreed, when did the claimant 'agree' these, also how can it be anything other than a 'penalty' as it is in excess of the actual costs incurred for administering the account. These are only my thoughts obviously, but based on all the blurb I have gleaned from in here I am confident that they are sound 'thoughts' Good luck, don't give up, don't be swayed or feel intimidated by the bank, there is stacks of info in here
  8. Hi Sarah, What was the basis of their defence ? I've just submitted my Prelim, LBA waiting to go for £3,200+ getting more paranoid by the day that I'll be the 'first one' who ends up on the front page of the Sun and a slot on Richard and Judy show !!!! Good luck, Steve x
  9. Hi, I have sent my prelim letter using the template, recored, received by 'them' on 16th Oct (early days yet I know) just reading up on the next stage - sending my LBA ! What are the implications of adding these para's per your template for an account opened in 1981 ?? "I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus interest plus a claim under ss.7 and 13 of the Data Protection Act 1998 plus my costs and without further notic" "Furthermore, I shall submit a Consumer Credit Act 1974 complaint to the OFT upon the basis that you have failed to comply with the OFT's direction of 5 April 2006 and are therefore not a 'fit and proper person' to hold a consumer credit licence under the 1974 Act. If you do not understand what this means then seek advice from your legal department" Any help or advice greatly appreciated ! p.s great site, can we tackle fuel, council tax, and BACS clearing bank consnext ?? LOL
  10. Yep, I have also had this - I agree with previous posting, it's an admission, and not a cop out of what has gone on in the past - let the courts decide Prelim for £3,211 received by HSBC HQ today - 14 day clock is tick tick ticking

    Dear all in this thread, Have posted my prelim today (recorded) claim for £3,211 plus interst of £164 (OD rate only not 8%) 14 day clock is now ticking tick tick, already have LBA typed on PC wainting to print etc. Have checked out MCOL looks quite straight forward, so Hong kong & Shark Bank Corporation - bring it on baby ! ! (have already fowarded link to this great site to a few mates)

    HI kirsty, I sent my SAR letter about 2 weeks ago, no £10 enclosed (didn't know about that at the time) and I received a 'nice' letter saying they could supply the info without sending my 6 years worth of statements (aww) guess what, I get no less than 43 envolopes worth (god knows what postie thought) after spending several hours sifting through I discover I have paid over £3,200 in charges plus interest, Prelim letter in post tomorrow asking for a refund - fully expect to get lots of fob off letters, but 'determined to win' Steve.

I'm new to all this, I have just written my prelim letter, posting (recorded) tomorrow for a claim amounting to £3,211.59 If it goes to court it will be £3,471) to come on HSBC lets play !! Am fully prepared to 'go all the way' am petrified I will be the 'test case' but at least I can then sell my 'story' to the News of the World etc, maybe even get my own slot on 'The Richard and Judy Show' LOL

Hi Bong, Thanks for the advice - I'm new to this, only found this site via a link from Best credit cards, cheap mortgages, personal loans, savings accounts, house & car insurance - The Motley Fool UK - been reading threads ever since (anyone got any advice on dealing with the possible divorce due to being on the PC too much LOL)
  15. Well, after reading thread after thread I have complied my letter, all ready to post next Monday (recorded of course) to start my attempt to reclsaim almost £3,300 in charges and interest. I started a week or so ago with arequest for information under the Data Protection Act, the the good old bank, well it's computer kindly churned out no less that 43 seperate letters of nice crisp duplicate statements (god knows what postie thought) and not a mention of any charges for that sackful. I few hours deciphering and I was gob smacked at just how much thay had gleaned from me !! I'm very nervous of the possible bully boy tactics I may unleash care of the HSBC 'henchmen' (closing my account etc after over 25 years), but what the hell, £3k is a lot of dosh to mish out on. I will certainly keep the forum posted on my progress. 03/10/06 request for all charges info under data protection act 13/10/06 43 envelopes of copy statements arrive FOC !! 16/10/06 prelim claim posted - recorded delivery 18/10/06 prelim confirmed delivered per trackback
