Hi Alan, The wait will equal to 28 days + upto 5 days from when you submitted your MCOL actually if DG are true to form they will acknowledge quite quickly (you will see this within MCOL) then the 28 day clock starts counting (calendar days btw) They will then do one of a couple of things 1, Ignore you completely 2, Write with a possible offer 3, Submit a defence - usually on the 28th day But whatever happens you just have to put that kettle on and WAIT, do some painting, mow the lawn, go down the pub etc

Dear all, HSBC have at 3:55 today (which is my 28 day deadline following my MCOL) submitted their defence Grrrrr Am now comtemplating my next STRATEGIC move !!!! Shall I call DG tomorrow and tell then I fully intend to submit my Allocation Q and that I advise they give up now and save £100 or shall I keep silent for the next 7 or so days until my AQ submission deadline ??? The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. Umm, sorry, I thought you had issued your LBA, no don't issue the MCOL yet, there is a risk the court could argue you have not acted reasonibly, you need to issue your LBA this and give 14 days . . . Sorry, you have it seems lost a few days, but no matter you'll soon be back on track !!

Yep, put the kettle on and sit back for 28 calendar days One thought, it's not a bad idea to send a copy of your schedule of charges to the court (if you filed online) and once you know officially who the solicitors are acting on behalf of the bank, send a copy to them as well . . it may just speed things a little as it scuppers their delay by asking you for it at the last minute Best of luck
