  1. Hi Jason, DON'T be surprised to hear absolutely NOTHING from the bank. Start to calculate your charges plus 8% interest, and then you are prep'd to file your MCOL (money claim on line) its dead easy to do, you will have to pay a fee, this you add to your total claim. Then your in with the rest of a lot of us in here !! Good luck !! Steve

Hi Lynsey, I agree with Lateralus, I am in the same boat - sent prelim, LBA - not a squeak - file my MCOL and wow ther eIS life at HSBC afterall - they acknowledged and filed their intent to defend very quickly - I am convinced (hope) it's just stalling for time, they get 28 days to file their full defence, so as advised in here I'm sending a copy of teh schedule (as already sent to the court) directly to DG (recorded of course) to show them I'm not just playing and intend to 'go all the way' have yet to see what happens next !!   6. Hi David, I doubt they will shut your account, not for a single claim, afterall they are hoping they can fleece you again at some point in the furture far better to keep you than let you slide off to a 'competitor' rip off bank !! Steve.
  7. Just to recap on some earlier finding, days are counted as claendar days NOT working - that makes it shorter Don't give them any leeway - remember they haven't done so for you !! Steve

Hi Paul, As Lateralus has suggsted someone might paste acopy of their MCOL (Money Claim On Line) submission, here's mine, you don't have to copy, but you ARE limited to 1080 character, which includes spaces, commas etc and no more than 24 lines of text which can require a bit of trial and error to get it all to fit ! "The claimant has held account (xxxxx) since 1980. From Sep 00-Sep 06 HSBC has made 63 charges(avg of £25 if bal exceeds specified overdraft limit, recall S/O-O/D, when chq/debit payments was returned due to OD limit exceeded plus interest charged on them. These charges represent a penalty and do not accurately reflect the defendants admin costs. further they are contrary to Unfair(contract)Terms Act 1977 s.4, the Unfair Term in COnsumer Contracts Reg 1999 para.8 and sch 2 (1)(e) Further they are unreasonible within the supply of Goods and Services Act 1982 s.15. Claiment claims from the defendant a sum equivalent to the total amount unlawfully debited from the account of £xxxx.xx Also claimed is interest under sec 69 of the County Courts Act 1984 at 8% APR from date of ea charge to date of claim, total £xxxx.xx Total to inc interest and court costs £xxxx.xx also interest at the same rate to date of judgement or earlier payment at daily rate of xxp" This is a "word for word" copy of my MCOL entry, (minus the actual values)obviously you need to enter you own details for the account No and £ values Hope this helps Steve

Hey Babs, (have to watch that typing LOL) Got a papaer copy from the court today confirmimg that hSBC have acknowledged my claim, and guess what - the box saying the intend to fully defend is nciely ticked - eek Would it be prudent of me to pre-empt them writing and asking for a breakdown of costs to beat them to it and send one to their Edgbaston address ? Also it seems as the same person (Deborah D'Aubney) is dealing with - gosh she must be BUSY !! Maybe I could send her an xmas card as well LOL Steve x
  13. Hi ALL, received a letter from the court, basically a hard copy confirming thet HSBC had acknowledged my claim. (I knew that already from the MCOL site) I note there's a tick in the "I intend to defend all of this claim" box I guess that is perfectly normal ?? As I now 'officially' have D&G's address do I need to prempt them asking for a schedule of charges by sending one NOW (quoting the reference number ??? Steve

  16. Hi Paul, Don't feel special that you have heard nothing, it's the norm !! There is a template in the library to help with calculating interest payments ! As far as additioanl charges since you have started your claim, you can add these via the court by way of an addition but the court will charge £35, or you could wait for judgement and then start another claim (the bank 'may' close your account tho, so it's a good idea to open another with another bank (often called a parachute account) Good luck anyway !

  19. Hiya (again) Well depends on which way you count - I used me granpa's old abbacus and worked on counting the 17th as day ONE, so I actually make it the 14th as the 28th day after MCOL B4 my true love said - get the BARSTUARDS !! Steve x p.s. off home now !

  21. Abba, All I have so far is that the MCOL website has updated to say 'acknowledged' there are no details in there pointing toward D&G. Hopefully something in the post from the court soon then !

Hi Abba, I have already sent a 'schedule of charges' to the court, I did this as soon as the claim was issued As far as sending a copy to D&G, I certainley will, but 'officially' I don't know about D&G 'yet' as soon as I do, i.e. I get a letter from them I will send it !!! Hi Abba, Yes I suppose I have some comfort in that, I was so hoping they would 'overlook' my MCOL and then I'd sneakly win by defaut lol Thanks for the wishes, and I'll certainly keep the forum updated. I just know they will enter a defence, so am already pre-armed with my response - it's certainly a waiting 'game' and it's killing LOL Cheers, Steve.
