Total claim (claim + 8%) x 0.00022 = daily interest So I did same as you One thing, just been advised that you need to post a copy of the schedule of cjharges to the court (Northampton in my case) quoting your claim reference, so they have a copy (only applies if you submitted your claim using MCOL) Steve !

  4. Ok, thanks, will do that now, take it no need for a letter, just a one liner staing claim ref and saying 'please find attached schedule of charges as unable to submit within the online system' of someting similar ??
  5. Hi Bapsp2000, It's Steve, umm, just a quickie - whats all this about sending a 'copy' of the schedule of charges to the bank and to the court ??? I sent one with my prelim and LBA to the bank, but couldn;t send one to the court cos the MCOL system wouldn't allow it !! So do I now need to urgently send one direct to the court (Northampton same as your guys) and I asume quoting my case number, or do I wait for the bank to acknowledge and hopefully contact from D&G ???? Arrghhh - HELP !!!! ( I just know it will be ME that ends up at the 'Old Bailey' and on the Trevor McDonald show . . . (Richard & Judy are fully booked now LOL ) Steve x

I have sent prelim and LBA and didn't hear a dicky bird (track & post confirmed receipt) Have just filed my MCOL - gulped at the £120 - but I'm also very stubbon My 14 days to acknowledge starts on next Tues (privately hoping they don't bother to acknowledge that either) Then I WIN by default !!!!
  7. Hi Lynsey, I know there's at least one post in here where the claim is for over £19,000 !!!!! I'm unsure how it may affect your claim, so can I suggest you track down 'Bong' he seems very knowledgable !!

Hi, I'll go along with that one, I have submitted my prelim, LBA and just last week filed my MCOL and have heard absolutely diddly squat (and I'm doing the usual check of my letter box every single day and feeling very aprehensive - so you are certainly NOT alone. It wasn't easy to convince my OH that I had to spend £120 when we are seriously skint and so close to xmas But in for a penny - give me my pounds BACK Steve

Hi Lateralus, Great that's the shorter of the two options then ( iknow, patience, patience) But I'm wearing the door mat out with all the letter box checking LOL Haveing read 100's of posts in here now, it seems that the bank may submit a defence, although not 100%, are there any threads that sugest what to do next if they go down that route. I'm just trying to stay one step ahead. I'm no legal buff, and just feeling the usual paranioa ?
  10. Hi David, Great, glad to see your gonna go for it ! I have filed my Prelim, LBA and just done my MCOL, the nervous part is that I have heard diddly squat, zip, zilch from the bank all making me think:- I have I used the correct address (8 Canada Square) Did they get the letters (track & Trace says they did) Will they pay up, or will I be 'the one they defend' (they havent yet, so why pick on me) My MCOL has cost £120 (£3,600 claim) and I can ill afford to spalsh out £120, BUT . . I HAVE to believe in the sheer number of folk in here that have sucess stories, so can only assume that they are so overwhelmed by the number of claims that they can't reply to all. I am now quietly hoping the actually don't even bother to acknowledge the court claim -I then win by default, but I guess they will submit a defence on the 23rd hour !! I HATE big organisations ripping off the little guys - power to the people !! And this is a BRIALLIANT site - tons and tons of advice, great people too Anyway - good luck !!!!!! Steve
  11. Hi, I have submitted my MCOL claim - gulp :o as far as I understand the bank now has 14 days to acknowledge (hope they don't ) If they do, they get another 14 days to pay up of defend ?? Are they working or calendar days ???? Thanks, what a BRILLIANT site this is !!!!

Hi, I have been trawling this site aprehensively looking for the same answer-yep I just filed my MCOL (£120 worse off) and had to swallow HARD and wndered if little ole ME would be the test case and end up getting sued by HSBC for £1,000's etc etc . . . BUT I haven't found ONE single entry that even suggests that ANYONE has lost. I think it was Bong who pointed out that would ANY bank risk a test case in law that might just go AGAINST them and cause a change in UK banking law which will prohibit thenm from fleecing its account holders for millions (oops £ billions) in charges etc etc So . . . . armed with that info I confidently thumped the SUBMIT button in MCOL It's WAR now and I have NO intention of backing down now
  13. I agree, not many banks offer 'interest free overdrafts' and remember you end up paying interest on the charges as well !!!

Hi HSBC Detroyed my life (phew) A quick not eon interest - you would need to submit interest calculated using the spreadsheet in teh templates section in here for ANY charges that caused your overdraft limit (assuning you have one) to exceed - for example (based on an agreed OD limit of 500 balance -490 charge applied 30 = balance of -520 so your now 20 over your agreed limit, and you will be charged interest on this WHOLE amount of 520 (yep, they get interest on the OD and interest on the 20 of THEIR charge as well - great isn't it (for the bank anyway) hope this helps - Steve

Hi 'Ladies' Just posted my MCOL for a cool £3,600 done the Prelim and LBA - NOT a squeak from HSBC, I treid camping out under the letterbox just in case - going ever so slightly MAD now I'm seriously cakking !! So it's 14 days for 'them' to acknowledge - I'm quietly hoping they are so snowed under they overlook and I WIN by default, but knowing MY luck (I'm the guy who will win the millions and the goldfish eats my ticket kinda guy LOL) Well - here goes-£120 quid worse off, fingers, toes, legs and $£^& crossed !!! WAHEY - I just multiplied my friends list by at least 10 fold - (I know-need to get out more ) THANK YOU guys (and gals) for ALL the support and encouragement - I'm quite honestly overwhelmed - I have done it, got my claim No now and my very own 'slot' at "Northampton County Court" and I'm now £120 worse off - BUT hopefully will be a WHOPPING £3,600 better off just in time for crimbo - watch this space Love's you ALL Steve x

Hi all, I'm in the same boat as all you guys, my LBA deadline is tomorrow, so I'll wait (in I guess false hope for the letter from the bank) until Thursday, then it's MCOL time (yep I'm nervous I'll be THE ONE) that gets front page of the Sun (and other repitable papers) saying "banks win against mugs" or similar LOL but having come this far I 'aint giving up NOW !! Hi Guys, I too have a question related to above, and any help would be appreciated My total claim is for £3,051.50 + interest of £160.09 (NOT calculated using 8% and this is my LBA figure) When I submit my MCOL I take it I use the 3,051.50 sum but also add in the calculated 8% interest on that sum for the 6 year period as given in the template spreadsheet ? (approx £424.96) this would give me a total claim of £3,476.46 ? Do I then claim the daily interest rate on this total amount or just the LBA claim amount ex the interest ? i.e. 3,051.50 x 0.00022 = 67ppd or 3,476.46 x 0.00022 = 76ppd Sorry if I'm being thick Steve 8)

  24. Update on my claim Have posted my LBA - HSBC received this last Thurs (2/11) and have heard absolutely nothing so far Is this normal ?
