  3. Halifax Card Services settled my claim just after the LBA deadline. Some people however have to prepare their court bundles before receiving settlement.

  5. Hi, and welcome. You only need to send a subject access request to get your charging history, if you do not know it. You have your statements, so you can get this information from them. Be advised you can claim back up to six years though, so if your statements are incomplete, it may be worth send it. The 8% interest is not applicably until you file your claim with the courts. Under Section 69 of the County Courts Act you can claim statutory 8% interest. This isn't an issue until you file your claim, so leave all reference out to it at the moment. You don't have to send your letters recorded (I didn't with any of mine), but for peace of mind and assurance they've received them, its advisable too. Have a good read through the FAQs and Step by Step Instructions for clarification. Good Luck

  9. You can claim back up to 6 years. If she has all her statements then start writing the prelimary letter. If she doesn't, send a SAR (subject access request) under the DPA (data protection act). Have a good read through the FAQs and Step by Step Instructions. It takes a while, but time well spent. When your ready to start your claim, start a thread in the Natwest forum. Good Luck
  10. Ok Presumably you filed the claim online? The "notice of transfer of proceedings" is issued when the defendant defends the claim. All claims filed on MCOL are dealt with at Northampton County Court. When the defence is entered the claim is then transferred to your local county court. You are both then sent an Allocation Questionnaire to complete within 14 days. This is all pretty standard stuff. Can you give more details in respect to the counter claim (ie. whats it for etc.). If you have been served the papers then you need to prepare a defence. Elaborate please?
  11. Hi Noddy. Some people say you can send the LBA off as soon as you receive a response from your prelimary letter. I personally think its best to stick to the time frame set out in the library and wait for the 14 days. JMHO

  14. Yep, just change the "returned cheque" lingo to "late payment" etc. Stat 8% interest is still applicable. Just make sure you ammend the POCs too when filing.

  16. I delayed submitting my N1 claim form for a week until LloydsTSB have took the £65 in charges they said they would. Its better to do it that way, then ammend your claim at a later date as it incurs a non-refundable £35 fee. Good Luck
  17. Well the interest isn't an issue until you start the claim through the courts. If you start the prelimary letter now, you can save alot of the waiting at a later date. You can add the later charges right up until you file your claim. Lots of claimants add the extra charges just before they submit their N1.
  18. Just do one claim Have they said when they hope to get you them by? If it were me, I'd send the prelimary letter now. You have around 28 days then to add the rest before starting the claim. You don't have to do an estimated claim, just add the rest on when you get them. There is nothing to stop you doing this, and it will save a lot of time.
  19. Hi Northampton County Court handle all claims filed online. Upon allocation it will be transferred to your local county court. LloydsTSB will enter a defence (around the deadline (28 days)). Nothing much to do unfortunately. Just a waiting game now. Familiarise yourself with the AQ (allocation questionnaire) as thats the next step.

  22. Ok guys. I haven't even looked at the CCA request thread yet as its bigger than the bible (well, not quite). I acknowledge I own the debt as I have paid it for the last 2/3 years. Are you trying to say if they can't supply the agreement I can get it written off?

  24. SETTLED Cheque received this morning for £700. AQ deadline is today too (isn't it ironic, don't ya think?)! Off to bank now to pay it in, then write to court withdrawing claim. This has actually made me quite sad, as I now have no other claims to persue. Since starting here September time, I have claimed back from LloydsTSB (twice), Halifax and Cahoot, totalling just over £2000. I'll still be about as I am helping my sister with her claims. Donation on its way shortly.
