  2. For the sake of two days, go with the 22nd just to be fair.
  3. They'll just ignore it. However, it does prove to them that you are unsure of what your doing. Not having a go, but have a good look through the FAQs and Step by Step guide. I know theres alot to rummage through, but it will save costly mistakes later. If your unsure of something, just ask.
  4. You can only claim the statutory 8% interest, once you file the claim at the County Court (or MCOL). Therefore we leave it out until this point. However, you can claim contracual interest from the start. So if the banks start settling before a claim is filed, the only way you will get interest is by claiming the contractural rate, not the statutory 8% under the County Courts Act. Which rate are you claiming?

  7. Up to you personally. Its thought the OFT will soon tell banks to lower the charges anyway. But it depends on your circumastances. If your always being no charged (no offence) then maybe you should seek for the amount with no conditions. On the other hand if you accepted, it will save a big headache (court etc). The other thing to bear in mind is that by settling now, you cannot claim the satutory 8% interest.

See how they reply. If you haven't signed anything stating you have accepted the payment as "full and final settlement" I can't see you having a problem.

  12. I agree with mumofthree, also point out that you won't inform the courts until you have received cleared funds.

  14. if they haven't submiited a defence, you'll have a job getting it struck out. if you filed on MCOL you can hit the judgement button. expect a copy of the defence and an offer soon.
