Hi Pondfish My local County Court is Bedford. LloydsTSB filed their defence on the first claim, and they settled just after the District Judge (Mrs Wilding) ordered an allocation hearing (sometimes they do this to obtain more information before they allocate the case to a track). On the second time round, LloydsTSB settled after my LBA, so didn't need to start a claim. The draft directions weren't available when I claimed, but I'd reccommend anyone to use that strategy. You have nothing to lose if the D.J. ignores them. Where abouts are you?

Hey Kolo I sent a SAR for my second claim (first one was only for 4 years I got off their website). Forgot all about it, till out of the blue I received my statements (outside the 40 day deadline). It appears on the second claim they cough up straight away. They know your serious this time!

Hi Joe They usually return the SAR cheque, so thats a bonus. As long as your subject access request was made under the data protection and you included the fee (which obviously you did) its all OK. They often write back telling you of a random date they'll reply by. Stick to the step-by-steps and you can't go wrong. Good Luck

Hi Trigger Yeah, just proceed straight with the LBA after the initial 14 days are up from the prelimary letter. Classic delaying tactics. Don't know why they bother with them now. Everyone ignores them.

Hiya Am unsure of this. When the Halifax settled my claim, they credited it onto my credit card account. Maybe the Abbey only pay this way?

I agree. Although I think it will be the end of free banking (LloydsTSB charge me £7 a month anyway)!

Thanks kfdh1962 We have a hold over them now. I reckon within 3 months it will be about £12 per breach. Still expensive, but at least people won't see a large percentage of their wages go at the beginning of each month.

they always try that one. the £12 charge still isn't a genuine pre-estimate so it's still unlawful. Send a rejection of settlement letter (link from post above) and continue with your claim.

I agree with Ian. Just make sure that you send them an updated schedule of charges. As long as the courts receive the correct documents and amounts, thats the most important thing. When you do the interest spreadsheet for your claim, double check its correct as changing amounts at court stage costs a £35 fee. -
You can also download a N1 form from HMCS website in PDF format. You can fill it in, then print and give to your local County Court. You can do this with the Allocation Questionnaire too. Helps if you have big handwriting

Hi guys One thing to always remember... If you have ever complained and had the charges refunded you must leave them out (as you say). And also, if you accept a part payment, and continue the claim, deduct the monies from the latest charges. That way you get more in way of interest. Hope I've made sense.

Hi Marky Went about it abit wrong to be honest. I received a 50% offer from them which I declined. I said I will continue the claim until all funds are returned. Then Killmeedyman (I think) PM'd me saying he wrote to them and they accepted his offer. So I thought I'd give it a go. I faxed the early settlement figure through on the 5th, and received their reply today. I know its £35 short of the target, but I'm happy with that, especially not having to proceed with the court bundles etc. My AQ has been submitted just incase they don't cough up. Don't want to fall foul of the district judge. I also sent them a copy of the AQ just to prove I was continuing with the claim.

My friend is claiming from a LloydsTSB business account and received 65 A4 envelopes (count them, 65) each containing a months worth of statements.
