  3. Hi shops now have legal obligation to ensure disabled access. They have to make 'reasonable' changes to their premises. So if it's a small shop and they can't afford to put a ramp in they could put a bell at the entrance with a sign for diabled people to get some help. If they have put a travelator in but it does't work then i'ts not up to the job so you can report it to the Disabilyt Rights Commision. Hi I've actually just had (am still having actually) similar problem . in line with the banking code I wrote to them and explained my situation and asked for extended overdraft or refund of some of the charges (1600 total in 2 months!!). Manager didn't reply so wrote again said he was in breach of banking code and then I got letter saying they would refund £808 ( don't know where the 8 comes in ) still waiting for it though sent letter back last Thurs. So if you write it might work you never know. ps. When i win against LTSB will get rest back off Nat West

  6. Hi and welcome. Well done for starting the process and good luck. I have got as far as filing my claim and it has been aknowledged so awaiting their defence.

They will file a defence and then you will be sent a copy from the court with an Allocation Questionaire(you will have to pay another£100 when you submit this) They will ask for another 28days to negogiate a settlement which is usually granted. Then you start to write to them and finally when you have been given a court date they will settle about a week before from what I can gather after reading other threads.
  8. Hi Franco You must take three copies with you to court 1 for court 1 that court send to solisitors and 1 for you. Once the claim is deemed served (probably Tues) the solicitors have 14 days to aknowledge the claim and then they have 28 days in total from the date served to file theirdefence. I filed my claim on 28th Sept deemed served on the 2nd Oct aknowledged on the 13th Oct and now they have until 30th Oct to file defence. Lloyds tend to do everything at the last moment tho!!!! I have just put a letter on my thread that I was thinking of asking to go with my request for judgement (if they dont aknowledge today. Please can you have a look and see what you think. thanks
  12. Hi all Well today is day 14 and as of yet Lloyds have not aknowledsed my claim. I will phone the court later to check but hopefully I will be filing for judgement tommorrw. I have decided that if I do I am going to ask for the letter below to go with the rquest. What do you think? ( my address) 17/10/06 Case no: ******** Dear Sir, Today I have requested a judgement by default against Lloyds TSB. As a member of www.consumeractiongroup.co.uk I have been empowered to take on the might of an international company to reclaim my bank charges. Through the website I have learnt from those who have gone before me how to do this. Also from reading other people’s accounts I am well aware of what may happen now. Lloyds play an exhaustive delaying game. They have never gone to court to actually defend one of these cases, always settling just before the court date. Perhaps you could suggest that one of the court staff could register with the above website’s forum and they would be able to read the many accounts of the banks actions, often underhand that are taken against people who make a complaint against them. Lloyds will no doubt on receipt of the judgement apply to have it set aside with the excuse that there has been a simple mistake and that they have a good defence with a strong possibility of succeeding. This is simply not the case as they have no intentions of setting foot in a court room. They will then request an extra 28 days to negotiate a settlement. Lloyds policy at the moment is to refuse to enter into dialogue until you have a court date set and then they will wait until about a week before and settle. I feel that this is an abuse of the court system and should not be allowed to continue. I am just a lone person and they are an international company with huge resources behind them and a specialist team of solicitors to act on their behalf. If they make a mistake then so be it, they should accept the judgement or file for an appeal. If they filed for appeal at least then they would have to go to court and a judge could finally force their hand into submitting evidence stating exactly how they calculate their charges and then finally a precedent could be set and then maybe the court system could be freed up from the many other similar cases that are brought. I have spent the last five years battling with the spiralling effect that these charges have and have come to the conclusion that you need to have a sum of money large enough to clear your arrears and to put your account a month in advance to finally set your finances straight. This money from Lloyds will do just that for me. I will be able to feel back in control and no longer fear the phone ringing or the postman coming. Most importantly though I will no longer have to keep telling my children that they cannot have the things that they need when they need them, such as new school clothes. Yours faithfully Midge
  13. Hi Freebird Thats exactly what i was thinking about. Explaining that they delay in all cases and that they don't use the month to negogiate and that perhaps they should asign one of their staff to join the forum so that they can see just what is going on on the other side of the fence. Well if they have not aknowledged I think that tomorrow night I will draft a letter and ask for it to be attached to the request for judgement. Will post it on here for comments and Lloyds to see of course hehe!
  14. Hi I too am with Snatch West and due to circustances beyohd my control my income dropped for three months and I got caught in the spiral of charges. It ended up with them taking over half my monthly income each month and then all the other charges from the other companies whose DD were refused. I wrote to my manager in line with the Banking code and explained my situation and asked for either an increase in my overdraft or a refund of the charges to help break the cycle. He didn't reply and so I wrote again and said he was in breach of the Banking Code and again explained everything and that I had written to my MP and would take it further if necessary. Well lo and behold on Thursday I got a letter offering to repay half of the charges to help me out and so I am just waiting for them to put it in my account (tho as they have taken more this month I don't think it will do much good). So in a way they have made an effort to help and as soon as I win my claim against Lloyds I will just follow the procedure on here and claim the rest back. If I was you I would just try to explain that it was an oversight and ask them nicely to refund the charges. As it is only 2 they should agree to this.

I agree with you if it wasn't for this site we wouldn't be getting our money back and really the donation comes out of the interest that you would'nt have had so it's no big deal. I fully intend to make a donation for each time I succeed and would be happy to do more to help if I could.

  19. Well I contacted HSBC again and they said that they would do a full investigation and then write to me. I had a reply today stating that they can not find any trace of this £250 payment made on 28th Aug and that I should contact Aqua Pay and ask them to put a trace on it. I had already done this and they had said that it was no longer their problem as they had made the payment, the money has gone out of their account and now it was down to the bank arghhhhhhhhhh So what do I do now! I'm still minus the £250 and nobody wants to take responsibility! Any ideas as I really don't know where to go now. Many thanks

  23. Hi I think this just means that you now have to contact the solicitors and ask them what their clients intentions are and when they intend to settle. It should all be done by the 17th Nov at the latest. Read some of the other threads to check. Hope that helps
  24. Hi ianfm I think if you read some of the other threads you will see that you can tell Lloyds that the account is in dispute and awaiting a court date and that they cannot continue to harass you or demand repayment until the dispute is resolved. Hope that helps
  25. Hi all well lloyds have til Monday to acknowledge and have not done so. I will ring the court on Monday pm to check but if there is still no acknowledgement does that mean that on Tuesday I can go to the court and request a judgement by default?
