  1. Hi Sharman That's a bummer! I'm just filling in my Allocation Questionairre for Taunton and was hoping that it was quiet there and there would't be any of these problems there. Still hopefully if you use Bankfodders letter you can have the stay lifted. I did get a letter included with my defence about using the mediation service but i'm turning this down as they have had 8 months already! Good luck

  3. Hi Gary Thanks for response. So on the mediation form should I put that They have refused so far and therfore I do not see this as a positive action to take plus I can't afford it?

Hi all Got their defence today.All usual stuff I think but not sure about no7 'The customer is notified of the charges in plain language at the conclusion of the contract, and on each monthly statement. The charges are terms which relate to the price payable by the customer for a service provided by the Bank, and persuant to Regulation 6 of the UTCCR 1999, are not subject to assessment of fairness.' Does this mean that the buggers are saying that they are exempt from disclosure? Also recieved AQ but my claim is over the 5k mark so its the 150 one. Also recieved letter about going to mediation and the form I have to return says that if I do not try it the judge may consider this unreasonable! but I can't afford to pay another £250 for this. All advice gratefully accepted as I now feel very nervous about this and don't know what to do.

  6. HI Phoned Smile they can't trace it either. Phoned AP they say they can't do anything until they get the money back THEN and only then will they pay me. Phoned Smile again and they asked for AP to fax a copy of their BACS trace so they can double check. Phoned AP and have asked them to do this. Had no reply so will have to wait to Mon to chase again. At this rate won't get the money til next Xmas! What a bloody saga
  7. Hi Get your money claim in and add all the charges up until day you enter the claim. WRITE to Abbey and inform them of your pending court case and that this puts the overdraft amount into dispute and that they should refrain from adding further charges until resolved. This shoulkd work but if not keep track of anymore charges that they add and either asked them to be refunded as well when you get to the settlement stage or just start a second claim for any new ones. Once they know you mean business by issueing court claim they should stop.
  8. HI You know what I've just realised it must have been my Smile account that the card was linked to..........doh! Did't have it for long so forgot about it so I've been chasing wrong bloody bank!!!!
  9. Thanks Bong will go in loft and have a look tomorrow. What I understood was that if HSBC had taken payment they would have money in a holding account and after 6 weeks send it back to whoever sent it in first place..... namely AP then they should pass it on to me as they should have done in first place. But obviously that would be too simple!!!!! Well I going to ring AP once again tomorrow but I have insited that they don't try to do refund on any card but pay straight into my bank account . Hopefully that easy enough to do!!!!!! WE shall see. Thanks for help tho
  10. So apparently they are asking co-op to trace the money and pay it back to them and then AP will transfer it to my bank account. Don't know if this is flannel tho
  11. HI well thats what I thought but I dont have the card anymore to check. The manager from AP has said that she has investigated on my behalf and found out that the co-op bank are the issueing bank of the card but I don't understand this so was trying to check. Credit cards have an issuing bank and if anything goes wrong you contact the issuers ... apparently not the bank so she says

  18. HI As you have started the process of reclaiming the charges you should write to Shabbey and say that the account is in dispute and therefore they should refrain from adding further charges until the dispute is resolved. Hope this helps
  19. Hi Well this saga is still going on. HSBC wrote and said they couldnt find money go back to AP. Did this got no joy and asked for business name and address to write and complain to. They refused. Rang again and said under Business Names Act they had to provide it so 20 mins later they did! Sent letter a week ago and no answer (no surprise checked companies house and that another story) Phoned AP again and said this time I would go to Trading Standards. Surprise Surprise the Manager now going all out to sort it! Can anyone tell me who are the issuing bank for HSBC debit cards?
  20. HI IF the full amount of your claim is £4200 and they have infact only paid total of £2381 you should send the template letter to accept as partial payment and state that you will continue with your claim to get the remainder. Check by reading some other threads.
  21. Hi CONGRATULATIONS and enjoy Yes if the claim is still with moneyclaim and not been transferred to your local court. I understand there is a section on moneyclaim site to do this.
  22. HI I have just read in another thread that as it contains the words 'without Prejudice ' that still means it can't be shown to the court so don't worry just carry on and send the template letter for refusal of an offer. Hope that helps Good luck

If you go to the template section of the site you will find a template letter to send. Just keep reading the FAQs and lots of threads and you will soon begin to understand the process.
