  1. Hi Mr Mac As you have new charges to add it would be advisable to send another LBA with an updated spreadsheet to the bank in question giving them 14 days and then go to MCOL. You will find the correct address to use on your court claim in the contacts sticky in the corresponding forum of your bank. Good luck

  3. Here's copy of the letter Dear Sir/Madam, Thank you for providing me with a copy of your completed N149 Allocation Questionnaire, which I received on **/**/**. Referring to the Allocation Questionnaire, I must admit to being somewhat surprised by your response to Section A (Settlement). You have ticked ‘yes’, thereby requesting a one month postponement in proceedings in order that a settlement may be reached by way of negotiation. Please note that throughout the process of this claim, neither yourselves nor your client have ever given any indication whatsoever that you wish to settle this matter without the need for litigation. In fact, all my previous attempts at dialogue with your client have been met with outright refusals to negotiate this matter, and on **/**/** I received a letter from Lloyds TSB’s service recovery centre which explicitly stated that the bank had issued its final response and therefore would not enter into any further correspondence. It is for this reason that I felt I had no alternative but to seek redress by way of Court action. Having said the above, I do believe that litigation should always be a last resort and would of course be happy to settle this matter without the need for a hearing. Please be advised though, that I am completely confidant in the strength of my claim and believe that your clients charges could indeed be proved to be unlawful penalty’s which you are trying to cloak as contractual service charges. For this reason, I will only settle for the full amount of the claim, namely £***. In light of your indication of your intention to negotiate settlement, I will await your communication informing me of how you wish to proceed. I trust this will come before **/**/**, as this is final day of the month you requested to reach a settlement in your allocation questionnaire. A copy of this letter will also be sent to the court.   4. Hi I got my settlement offer the day after the AQ deadline if that helps. I did send a template letter by Gary H back to SCM with my copy of my AQ and I think this helps. Good luck

  7. Hi all Well I've got my second letter back from Mr Udder the milkman. Says can't offer any more please accept £132 as our final offer. So now I need to get my court claim ready. So far I've only sent spreadsheet with list of char.ges on. So can I now do one claiming compound interest and if so How do I work it out ? Numbers is not my thing. Also have more charges this month to be added. Thanks in advance for help
  8. HI all Well back from hospital feeling like i've been kicked by loads of angry horses. No sign of my cheque yet. Phoned SCM yesterday to check they got my signed agreement and they have and said it takes 5-7 days for cheque to come through. If not here by Tues will phone again as that will be 1 week since they got my agreement.
  9. Hi Dave I recieved a settlement offer the day after the AQ deadline. Today the court sent a court date of 27th Feb but I dont need it as I accepted their offer.

    Hi all I wrote to Smile reminding them of their complaints procedure last week and told them they had less than a week to reply to my origional complaint. Letter from them this morning containing a cheque for £495. This is £60 short of what I asked for but I'm too poorly to argue anymore so it'll do for me along with my full settlement offered by LTSB it's been a good couple of days (despite the gallstones!) Thanks for all the support and help donation will be made when cheque has been cleared
  18. Hi I've just put a message on your thread. Yes I had all the conditions and they also said they would be crediting my account, But as I dont have one with them I have just signed the form and asked for a cheque and stated that I will not inform the court of the settlement until the cheque has cleared.

  22. HI Keep at it . My AQ was due by 13th but I put mine in on 3rd and SCM did theirs on 9th and I had a full settlement offer from them on 14th. So hopefully your on the home straight now. Good luck
