  1. Hmmm, the deposit should have been put in Tenancy Deposit Scheme....I don't know loads about that but the Shelter website is V good at explaining these things. V concerned that there are no dates or signatures, but check these 2 links, expecially the tenancy checker, and see if it gives your friend a better idea of where they stand then the good folks on here should be able to guide you: Shelter England - Tenancy deposits Shelter England - Private tenancies

  3. Found on the OFT website that the UTCCR do apply to tenancy agreements....they have also stated that they would object to terms exactly like this. Lets see if we can get a quick refund....there must be thousands have paid the same ridiculous charges and fees

  5. Hi all, hope you don't mind be jumping in but have the same issue with a friends card am reclaiming for...she claimed the full charges plus the contractual interest charged on them. They have offered the difference between the £12 & £20 only....is there a good template letter you know of to tell them to stick that, and that you want the full amount? Thanks

This is the initial letter Ive drawn up....comments more than welcome: Dear Sir/Madam, Administration Charge Refund I started tenancy of xxxxxx on xxxxxxxxxxxxx and was required to pay xxxxxxxxxx Agents an ‘administration charge’ of £95 as a condition of granting the tenancy. This was paid to yourselves when signing the tenancy agreement. After taking advice, I now request a full immediate refund of the sum of £95 on the basis that this fee was an unlawful premium in terms of section 82 of the Rent (Scotland) Act 1984 (‘the 1984 Act’). Section 82 provides that the charging of a premium is a statutory offence. Section 88 of the 1984 Act provides that a premium shall be recoverable by the person by whom it was paid, I am therefore entitled to a full refund in law. Please note - I will not discuss this matter verbally, please ensure all correspondence on this matter is in writing. Should I not receive a satisfactory response within 14 days of receipt of this letter I shall consider commencing court action
  7. Hi all Am helping a friend who was heavily pregnant & in private rent until her landlord decided to sell up. She managed to secure another rental with an Agency but she had to pay a £95 'admin' charge. She has since moved but when she left the Agency visited, agreed the condition of the property was fine and that was that....until she received a letter stating they were withholding hundreds of pounds from her deposit for 'cleaning' and 'late payment fees'. (the late payments were when she was in hospital and phoned each time to say the rent would be paid the week after when she was out...which they had no problem with at the time). Suddenly there are 3 or 4 late payment fees of £45 a whip! Their said its in the contract, nothing you can do (where have we heard that before ) I then find this, and am sending a letter based on this: Govan Law Centre: £2m fleeced from Scottish tenants in unlawful premiums each year But - As section 115 states s.115 - ‘premium’ includes any fine or other like sum and any pecuniary consideration in addition to rent. Would this include 'late payment fees' or could we try the UTCCR route (would they apply to a tenancy agreement?) Any input appreciated!
  8. Hi speccybeccy...I am interested in this right now also. There is an agency local to here that has been charging 'admin charge' of £95 for setting up the tenancy...and apparently another charge to renew later on. I have found this on the Govan Law website and am sending an initial letter with this info in it to see what happens. This is scotland though...not sure if there is anything equivalent in English LAw? Govan Law Centre: £2m fleeced from Scottish tenants in unlawful premiums each year (And this agency is well aware of the financial circumstances of these tenenats and how desperate they are to secure a house - one girl was heavily preganant and her prev landlord had decided to sell up)
  9. Hi sick of it all, I know the prospect of losing a chance of a job is worrying you sick...it would for me to! I worked for an Insolvency Practitioner a while ago and there were people who worked for the civil service, dwp etc in your position so I do not think it a problem once you work there. That is your private financial business, employers are not contacted to inform them specifically of this sort of thing. I cannot say how it would affect an application though. There are certain jobs you are not allowed to do while in any form of bankruptcy (director, local government etc), but not what you are looking at. Problem is, a lot of places credit check now - but at least warn you in advance they will do this. Just as Revvy said, you should speak to the citizens advice or a local welfare rights unit? They are wonderful and you will not be held to anything just by telling them your circumstances. They can recomend options and who to go to (most citizen advices have insolvency practitioners etc they know and refer folk to). The other thing is...have you looked into any of these debts? ie asked for agreements, see what legally enforceable, any charges you can reclaim to reduce the burden etc? Just talking about it then starting to reclaim charges etc makes a lot of us feel like we are taking control of them...taking them on! Loads of help on here for all that.   10. Hi abroadgirl I am so sorry I've not got back to you, I have so much on just now (court with 2 fights) I don't get on much lately. I will dig that e-mail address out for you tonight, use it to put a formal complaint into JD Williams/Reliable that they are passing the account on willy nilly after admiting no CCA and while in dispute etc... It is there standard threatogram, I'll bet it is even on a poorly printed bit of paper? lol, sooo professional. Will be making an effort to get back on CAG regularly now...so many folk helped me on here and I need to be doing my bit (and happy new year to you too )

  12. Hi guys, am finally back online permanently now, and I see I have some reading to do lol. Welcome been on the back burner as I have 2 court cases on the go right now so am up to my eyeballs but have talked over Welcome with the solicitor dealing with them for me and is willing to take it on, as the data protection breach needs arguing (beyond me!) etc.....but will use the winnings from one case to fund the Welcome one happily as this guy seems good. All in all, on the offensive. Hoping everyone doing ok but will read and catch up. Postggj - poor timing with the op, hope its an easy in and out job and all is well. CAG needs you! Andie - need to catch up with yours too.....dying to get back in the fight, best to all.

  17. Here are P + A REceivables.....note the complete LACK of info on the notice you were given. You should get a complaint into them and demand to know what they were instructed, why you cannot find them or Brendan Fisher on the Court Service regsiter. Address it to the director for that 'division', hes on the website.   20. Debt Managers lead me to the CAG by getting a CCJ on me by bullying me while I was pregnant and very vulnerable. Empowered is an understatement, this site has turned my life around, and I enjoy it! Thank you guys
