  1. Morning Merlin I take it this is Hire Purchase (car?). The option fee is that rip off last payment to take ownership...crap but true. The termination info on the agreement are your rights for terminating the agreement at various stages...you can Voluntarily Terminate (VT) the agreement if you have paid a certain amount, which is to hand the keys back and walk away from the car and the loan. (good if it turns out to be a heap!) The cancellation info just relates to when you first signed. However!... The acceptance fee and option fee...they should show them as added onto the total finance charge. As in...they calculate the interest on the £8900 to be £3637.92 then add the fees on top (as if no interest is calculated on them) to show the total charge you are paying for taking out credit £3932.96. But, we have all found that in our statements the balance is - the amount you borrowed + the fees THEN they start calculating the interest....which as far as we can tell is againt the CCA 1974. 2 things - did you actually pay the £195 acceptance fee with the first instalment, as in your first ever payment was much larger than all the rest? (does it show this on your statement) And can you scan and post up your agreement - minus any personal details - so we can see? Sorry Timdrew, didn't mean to confuse you there....I was about to reply to you when I heard my son creeping about upstairs (little horror lol) so just subscribed to your thread quickly so as not to lose you and went to chase him back to bed Vodafone have put me through similar. The contract was due to end and phoned and e-mailed and cancelled, just waiting on a final bill. FINAL bill never came, just more monthly bills mounting up. Kept phoning and writing and was told each time...oops sorry, I can assure you it is now canx and all sorted. Then got a letter from a debt collector - sent them packing! - still fighting with vodafone now. I've heard of quite a few.... Was the debt collector a company called dlc by any chance?

Is all this rigmarol trying to get a hold of a specific signature? hmmmm If it must be a specific mandate (ridiculous, the DPA states no prescribed form any authorisation must be in) then it would be a standard bank one...so why didn't they get you to do this when in the branch half a dozen times? You are right..stalling tactics. They shouldn't have cashed the cheque if they couldn't process the SAR yet. Goo dluck
  4. love it. Speaking of Cohens...I have a complaint regarding them and Lewis. Sent an e-mail to Cohens and got a response in the post from Lewis (apparently). I then received e-mail responses from a person at Cohens, answering an e-mail I sent Lewis....then got an e-mail reply from Lewis answering different questions from the SAME person! When I tried to complain they tried to just close the a/c and make me go away. What is going on over there?!
  5. Hi all, can someone please have a quick read of this thread and see if they can help this cagger. Welcome being nasty and they need some help fast. Loan with welcome was secured and the house was repossessed a few years ago. heard nothing since until cagger finds a ccj been obtained from Welcome for the (apparently) remaining unsecured amount of the loan.   12. seriously though, once its done (and miller time is over lol) we need to spred the word. Tell everyone what their new situation is, how tofind out how they've been scammed and what to do about it. I talked a long while ago on this thread about a couple I dealt with who were ripped off like you wouldn't believe...I have always vowed to get word to them that they can be free of them. They were good people and what was done to them was very wrong. There should be CAG leaflets or something we can hand out.....I am forever writing the website on scraps of paper etc!

  17. Hi all Have been sent a Capital One DN that just say the arrears must reach my account within 28 days of the date of the letter. No date is specified, the only date anywhere on the letter is the date they posted it...but as they said 28 days (obviously giving 14 days to pay), is that now valid? (the arrears listed may actually be wrong lol, still checking! Any clever bods opinions would be grand! Thanks

  21. Exactly. and the question then is...as its not a flat fee per introduction but a % of the loan amount....how do you know the broker got you the best deal and you did not end up with a larger laon so they could make more commission?
  22. So they tried to take court action against this cagger for payment of 'internal' a/c's that ae used for book-keeping only (). If that had not been defended by some normal person that hadn't a clue what to do about it and just let it take its course (as many of us have done) ...then they would have got judgement for that sum of money. Which in turn can realistically happen to any rbs a/c holder...that is scary scary stuff

  24. Found your thread Had a quick rad through and JDW are playing same games with me. I challenged them on the harrassment and they just keep dodging the questions....I am gonna HOUND them till they answer so will let you know how I get on, it may help you. I am doing it all e-mail with them....want the address I've been using? Easier quicker and cheaper I found. As for Buchanan Clark & Wells, as soon as they get a sniff you want a CCA they will run away
