Go for it, what have you to lose? Sod it, you haven't got any money, they've made up this ridiculous story about you. You want to eat, play them at their own game. How do you know it isn't a case of racism? It could well be. Maybe they are not understanding your cultural differences and that has brought about their assumption. Good, he will now write to them and you go up in the priority order for them to deal with. They will take a bit of notice now. Probably will give him some cock and bull story though but it may shift things along a bit. Can't see it will do any harm and will let him know they are inept. Sal

I would accuse them of racism. They'll hopefully soon change their minds. They don't like that sort of accusation. This is absolutely ridiculous assuming you are gay whatever next. You need to get as much support as possible. Try your MP for starters and DEFINETLY appeal. Sal -
I don't understand you amianne the example you have written above is a technical prosecution. The person you knew had not received an overpayment at all so why was he prosecuted in the first place?

I have a feeling the other half is Police. Why would you provide evidence against the mother of your child unless you were some vindictive piece of work. As for the Police arresting people i don't need to be told anything about that. They arrest enough innocent people who have to end up suing them for not following PACE. If the other half gets arrested then if it was me i would get a solicitor to represent me and let them deal with it probably in a prepared statement. I am fed up with innocent people being accused of doing something they have not done when it is blatantly obvious to people that are not blinkered where they should be looking. In half of these so called fraud cases the claimant has only received what they should have and they are technical prosecutions. Ant to boot they cost the tax payer a lot more to prosecute. Stan Lee why would anyone agree to an interview under caution if they were not claiming benefits?

Oh god! I've appealed about my council tax and that was back in 2009/2010 and not had an acknowlegement either. I've had the court letters and the add on to pay court costs and all the bs that you have to pay even if you appeal. Their left arm doesn't know what their right arm is doing. Get your MP on board now sod the 14 days. Sal

Just to add they never received the court date until February 2011 and had to attend court 3 weeks later. How much is their figure on the overpayment? People seem to say that if it is under £2,000 you won't get prosecuted any way. Can't seem to understand why they are not also mentioning the housing benefit and council tax benefit? I reckon they are fishing and hope you admit something so they can go along those lines also. Don't admit to anything. It's not what they know or think they know it's what they can prove. I know someone that was interviewed in January 2010 and didn't have their first court appearance until March 2011 and their last in September, 2011 so i think you are being hopeful that you are out of time.

Seems to me they want to do an Interview Under Caution. My advice, go along and see what they put to you. Say you can't remember or don't know to their questions, don't admit you know anything. If they want to prosecute don't worry. Get yourself a solicitor dealing in "benefit fraud". Tell him/her you had an IUC without an appropriate adult present, as you are a VULNERABLE ADULT under PACE you should have had one. The taped IUC will them be inadmissable in court but you will know some of the evidence they have on you and what it is all about. Sod the papers, more than half of what they print is inaccurate. No one cares, lots of people are finding themselves in the same situation. All the best, Sal -

The answer is - how long is a piece of string? It could be up to 2 years or more. You need a solicitor specialising in "benefit fraud" and then a barrister. Best bet is to play ignorant. You certainly don't want to admit you know what you were doing was wrong. It's not what they know (or think they know) it's what they can prove. Why should you understand the benefits system? Hi, It wouldn't bother me either. I've had the Head's of various department's on my case, the Mayor's secretary, the lot. The best was the Mayor's secretary who couldn't understand what the others were playing at. They even had a copy of the title deeds to the property but they totally ignored that. I believe they make up the rules depending on who the person is. Jokers really. Sal

Don't get me started on the police! Another lot of bullies that miss the obvious and make up stories that are ill founded. Glad you mentioned the Ombudsman though. I must remember that because i have had over 3 years' of dealings with an inept Council regarding council tax that to this day has never been resolved!! Next time i get a Council Tax bill from them that is where i shall complain. All the best, Sal
