  1. Hi, I live in Edinburgh and sued through Edinburgh Sheriff Court. I'm with the BOS. They settled but waited until the day before my court return date. Just to get my goat up! Starting another claim shortly. Best wishes, hope it all goes well.

  3. Hi Setrice, Not sure about Q1. Q2 just go back the 5 years. Bank will not be let off! Q3 claim for the full 750. interest and your court fee are extra. I'll get back to you on the wording issue.
  4. Hi tedshez, Just put the total of charges, don't add the interest untill you file your claim with the court. Good luck, I've just had £720 refunded from the BOS. They seem to have forgotten my court fee's, will phone them pronto!

My Small Claim of £720 & 8% & £39 court fees is due in Edinburgh Sheriff court on the 10th of October, but I know I will hear from BOS before this. You can claim £750 small claims or £1,500.00 Summary claim, read more of the BOS threads on the site and you will get abetter idea of what the score is. All the best Scott.

  12. I got my first "f " off letter about 1 week after posting. I waited about 2 weeks after my 2nd letter (LBA) again I was told to " f " off and they did not want to talk to me again. I popped down to Edinburgh Sheriff court and filed my claim, case will come to court 10:10:06. Bet you anything they will want to speak to me before then! I'm claiming £720 + 8% interest + £39 costs. I'll keep you updated.

  14. Mitchell, Not sure about them closing your account, I have not heard of that happening much. Some people say you should open another account, in case. I didn't bother. I think it's only when you are filling the claim at your local Sheriff Court you should not put anybodys name, because it's not the person you are claiming against but the company they work for. When I started my correspondence with my bank I always wrote to the person that's in charge of my account, my Business Banking Manager, big name for a total useless Piers Morgan. Hope this help's.

  20. Hi, My names Scott, I've had a Business account with the Bank of Scotland for about 28 years. Over the last 6 years I've been hammered with ex/od charges and returned d/d charges to the tune of 6,700. pounds. I recently sent letter asking for these charges to be refunded. Got standard fob of letter offering 325 pounds in full and final settelment, I accepted this but not as full and final settelment. Informed them I would be looking to claim back full amount due. They responded by offering the same amount again but leaving it open so I could reconsider. They ended their letter by saying "having considered all the circumstances of the case, it seems we have reached the position where no further explanations will serve any useful purpose". I just want to know how to proceed, I know the limit in small claims courts in Scotland is 750 pounds and I can only claim for the last 5 years. Can I claim 5 separate years charges back all for 750 pounds, giving me a total of 3,750 pounds. Your help would be appreciated, I live in Edinburgh, my account is a Business Account held in Edinburgh and I wrote to the head office at The Mound, also in Edinburgh. Thanks, Scott.

  23. Hi all, I am trying to claim back over 6 grand from the Bank of Scotland in Edinburgh. They have offered me 325 pounds and have said that " Having considered all the circumstances of the case, it seems we have reached the position where no further explanations will serve any useful purpose". I am a self employed Painter and Decorator and have had many sleepless nights over these bank charges, last year alone I was charged 1,870.00 pounds. I have a business account and just wondered what to do next, I know I can only go back 5 years but I beleive the small claims courts in Scotland only let you make a claim for 750 pounds. Can I make 5 seperate claims for this amount? Any help would be great. Thanks, Scott.
  24. I am a self employed Painter and Decorator, have been with the Bank of Scotland for about 28 years. The last 10 have been an absolute nightmare. I have struggled to stay in business due to ever rising bank charges. I have been charged about 1000 pounds per year for ex/od charges and returned D/D charges. I have had countless arguments with my banking manager regarding giving me a larger overdraft, if I had an overdraft of 500 pounds I would never incur eny ex/od charges or returned D/D charges.The Bank seem to think that an overdraft of 250 pounds is fine for a business with a turnover of about 36,000 pounds.(I have 1 employee). I recently asked the Bank to refund 6,700 pounds which they had taken since May 2000. They wrote back asking me to accept 325 pounds in full and final settlement. They have given me 8 weeks to accept. They also informed me that the Unfair Terms and Consumer Contracts Regulations and the OFT decision do not apply to business accounts. Can anyone advise me on what to do next. Many thanks, Scott.
