  1. Just a quick question. I just won the first part of my claim http://www.consumeractiongroup.co.uk/forum/royal-bank-scotland-bank/25068-highland_lad-bos-another-winner.html and I am going to tell the court that they have settled. Do I need to fill in Form 11 or do I just write a letter explaining they have settled out of court ?
  2. I have had no charges on my account for a good year now, these charges are all from 2-4 years ago. I broke the charges down because I am in scotland and wanted to go the small claims route. Do you think I should just go ahead with the other part of my claim ?
  3. I Won!!! Got a letter this morning saying its not in there interest to pursue the claim so they are paying £735 for the bank chanrges, £260 for the interest and £39 court fee's to my bank in the next 7 working days. Total £1,034 donation will soon be on its way. I am going to send the bank a letter saying that this claim was part of a bigger claim and I will be pursing the rest. They have 7 days to pay the rest of the money in full else I will be submitting another court claim. Is that the best way to do it?
  4. Got a letter from the court today, Return Day is 27/10/06 and the Hearing Date is 03/11/06.
  5. Andy999, I have the exact problem as you! Been happening since April. I also had the telephone services with them which was cancelled when I got a ADSL MAC Code but I still get billed for it. I used to phone them all the time and they said it will be sorted and send my a payment of £14, it never got sorted. I dont even bother phoning them any longer because its just a total joke. I sent 2 Registered letters to them, they replied to the first one saying they are really sorry for the bother and have cancelled the account and all services and also sending £14 to me, they never! Still get letters and no refund. So sent another letter giving them 14 days to sort it out but they never. I have contacted OTELO who have now taken on my case, hopefully I will hear from them soon because I am still getting letters from talktalk! Maybe you should also contact otelo? www.otelo.org.uk

  7. Hi, Thanks for the input, I have checked over the forms tonight and I am pretty sure I have got everything right, I was just panicing Claim for £735 + £260 interst + £39 court fee's will be submitted tomorrow!
  8. Hi, Thanks for that. What I am going to do is just break it down into claims of £750, I have calculated the 8% interest and going to fill out the court papers today and hand them in on monday. Would someone be willing to look over the papers etc before I submit them to the court. I am really worried that I am going to make a mess of it!
  9. Heard nothing back from my LBA so I am going to go down to the local court on Monday and make a clam. However I think I have made a wee mistake. The first charge I am claiming for starts on 29/01/01. Because I am in scotland I can only claim for 5 years, what date should I use as starting 5 years from, the day I sent for the data protection act? Any advice would be great 29/01/2001

  11. Yeah the 14 days are up on the 31st of this month so I will wait til then to send the LBA even tho I know I wont hear anything else from them!

  13. Hi, Came across this site about a month ago and decided to find out how much the bank took from me in charges. When I was a student about 2 years ago I got a lot of charges to my current account, I was thinking about £200-£300 in total. I was totally gob smacked when I got my statements in and the total charges before interest was £2,386!!! Sent of my prelim letter on 17/08/06 so hopefully I will hear something shortly! Timeline --------- Data Protection Act sent - 25/07/06 Data Protection Act Money Cashed - 02/08/06 Data Protection Act Acknowledgement Letter - 09/08/06 Statements from 04/04 to 08/06 received - 14/08/06 Statements from 08/00 to 03/04 received - 16/08/06 Prelim Letter sent for £2,386 - 17/08/06
