Not at all sure when i last made a payment certainly not in the years lowell have been reporting it , thats what i can't work out it was reported as in default in aug 2009 (not 5 years as stated earlier) but there is no reference to this debt before then but it states the account was opened in 2004
  2. could anyone help with this , i have lowell chasing a debt that they purchased from barclaycard some years ago , im fairly certain that this is SB , on my credit file there is no reference to barclaycard there is reference however to the debt by lowell who have been reporting it since 2008. The account was actually opened in 2004 but as there is nothing under barclaycard i believe it to be SB as lowell only started reporting it when they bought the account , have i made the correct assumption on this?
  3. thankyou for all the replies , i assume that you think the agreement is enforceable? The only other thing i would like to know is given that this will become SB in 4 months will reclaiming the charges reset the clock on this? , was just thinking its maybe better sitting it out to see if they take any further action , or would it be too late to reclaim should they start ccj proceedings on this?
  4. sorry didnt understand the charges bit? last payment on this account was nov 2007 so will this not be sb from nov this year? i can see the charges as they have sent a partial statement of account
  5. could anyone please advise on the enforceability of a response to a cca request received from jdwilliams https://www.dropbox.com/s/rfy5s9s2z5nsvc7/DSCF2342.JPG the name and address by the way has simply been written on the sheet and has not been signed , but they claim they do not have to provide a copy of an agreement bearing or some other proof of the customers actual signature. This become statute barred in 3 months and the balance of just under £400 has charges of over £200 can anyone advise how to proceed with this , still on cra file , account was opened on 5/2007 and last payment made on 11/2007
  6. our council now take into account child benefit as earnings , we have gone from paying around £70 a month last year to now paying in full this year at £117 a month
  7. hi all , had a tax credit check this morning that in itself isnt a problem but i feel that the questions are extremely intrusive , the have asked for my wifes employment details (fair enough) and my self employment receipts etc(fair enough) , but then they go on to ask about all my household expenses , loans hp , tv license etc which i fiond rather strange , they want all of this for a period of 3 months. Is this just standard as all seems rather strange> many thanks in advance
  8. thanks for the reply , wouldnt be able to claim JSA as my wife earns too much , its more the housing benefit bit im concerned with and what documents they would need as my self employed proof of earnings

Can anyone advise on this , my wife currently works 20 hours per week and i deal with the home responsibilities , as from april 2012 we as a couple have to work 24 hours as my wife cannot increase her hours we will loose £300 per month in working families tax credit , do i understand this correctly or will something else take its place? As i would have to find work around having the kids and my wifes work i am thinking of registering for self employment and working 4-8 hours a week , how would our housing benefit work with this would i have to send a declaration in monthly , or copies of receipts for money received? Would i be correct in saying the tax credits would take their figures off my yearly tax return for tax credit purposes .Sorry for so many questions but i am unsure of where else to be advised on this
  10. as i recall they only ever visited once so there was one charge ,the aoe were actually on my request at the time it was the best thing for us and the council instructed the bailiff to proceed , ill get on to them and ask them how to proceeed , just dont want a visit again thanks for the reply
  11. hi all could anyone help , i had 3 council tax liability orders running at once , the council set up an attachment for 1 of them , the bailiffs set up an attachment for another , and i had a payment plan with the council for the third. I completed the one on the payment plan , leaving me with 2 attachments , the amount owing on these has reduced from about £3000 to around £600 over the past few years at a rate of £25 per month split between them. The problem i have now is that i am changing employment and would prefer my new employer not to have to deal with this , is there anyway i can ask the council to accept a payment for the £25 a month on the payment plan instead of via an attachment , thus saving myself the embarresment with my new employer , many thanks

  13. could anyone please advise , i have an alleged debt owed to capquest , way back in feb 2008 i asked for a cca relating to the debt , a couple of months later they sent me an application form with none of the prescribed terms , i am well aware this is not a valid cca. In jan 2009 they sent me a S.Demand by post which at the time i didnt have set aside for various reasons. This morning i have received a letter asking me to contact them as i didnt reply to the stat demand 2 years ago , saying they are going to send a field agent to serve the demand personally , and i can avoid this by contacting them. Can anyone advise on how to respond (if at all) , bearing in mind i still havent recieved the cca i asked for 3 years ago , many thanks
  14. thanks for the replies , ill wait on them as the box was thrown away along with the receipt , i do have the connection leads etc which are unique to the camera , but they declined when i offered them .

I recently lost an item whilst travelling (value approx £250) that is covered on my home insurance.I contacted my insurer who took details of the claim and said they would require proof of purchase. Unfortunately i cannot provide a receipt.My policy states that they require receipts for any claim in excess of £500 , when i pointed this out to them they told me that "it doesnt state that we dont require receipts for an amount less than £500".We have now agreed that i can send a printout showing the debit card transaction when i bought this item.I have printed this and all it shows is an amount and date and doesnt state the retailer just that it was a debit card transaction.Is this likely to be sufficient as i feel that they are trying to be slippery. many thanks

  17. we have recently had a new heatwise electricity meter installed , our old meter had 4 readings i belived to be normal afternoon/evening (heatwise) boost overnight (heatwise) our new meter has 5 readings , does anyone know what the fifth reading is?
  18. just an update eon have now said they are prepared to write off £1300 of the bill , but i must pay £700 that was accrued between Apr 2005 and apr 2007.When i asked them to justify the amount ,they have simply sent me a statement of account from 2008 onwards and not anything from 2005-2007. They also said they have tried to update my meter on several occasions but cannot get access , i asked them to prove this and they did not respond , my meter has been read by eon on 5-6 occasions while this debt has built up , so how can they say they cant acces my meter , i have put in a formal complaint and i think this could end up being a long drawn out affair!
  19. thanks for the advice matt , id already thought of this thats why i'll insist on having it i writing , i'll still probabily fight the amount that they come back with because im now led to believe they can only back bill me 12 months , we'll see in time

Just a quick update for anyone else in this position.Eon have said this morning they will only try to recover any debt accrued from 2005-2007 - they are currently calculating this and sending it to me.They have also said that they accept that i will not let them update my meter until we have negotiated in writing the level of repayment , thanks for the help , i will update in due time
