  1. thanks for the advice , not sure about the tokens , but obviously i dont want eon to change the meter and set the repayment as they see fit , until i have made some arangement.Looking on the consumer direct site it states In order for them to be able to collect this type of debt, they must be able to prove that they made reasonable attempts to update your token meter after every price rise. (eon have never attempted to adjust) In every instance your supplier should not attempt to backcharge for token meter debt older than 12 months (eon are trying to recover the debt in full) is there any milage in what consumer direct say?
  2. this is quite a long winded one so please bear with me: 6 years ago i had a pre payment electricity meter fitted by eon.After about 2 years it became apparent that the meter was building a debt up , upon calling eon they told me it was only because they had estimated bills and not to concern myself. About a year later again i contacted them again due to the debt rising - this time i was told that the meter could be wired wrong - i was using other peoples tokens or i had tampered with the meter .This was all before the problems with these meters was so publicised. Last year when i requested something done about this situation they informed me as you are a heatwise customer we do not currently have a key meter compatable with this system , but we will change you meter shortly. i recieved a letter this week asking me to phone them because they are withdrawing paper cards so they could let me know who will still stock them.When i phoned they said the letter is wrong and they now want to change the meter.There is a debt of £2000 that has bulit up due to eons failiure to calibrate the meter for six years. Being on benefits i simply cannot pay this back along with the huge increase in electricity price i'll have , i cannot change supplier due to having heatwise and nobody else being compatable. is there anything i can do about this? should i contact cab or bbc watchdog?
  3. yes this is correct , they will only look at you rent once a year.If there is a shortfall until it is looked again , you can ask for a discretionary housing payment to cover it , however this payment is totally at the benefit officers discretion and is not an automatic entitlement
  4. im pretty sure that if you are unemployed that they can only deduct an amount around £3.00 weekly direct from your benefit , i dont know how the fact they have been in your house would affect this rule though
  5. i have lots of dealings with these idiots , i have always a / refused them entry b/ made them a firm offer in writing (wether or not they accept you have proof you have attempted to make a payment) c/ told them to refer the account back to the council as you will simply not allow them to enter your property. on each occasion this stance has worked and after 2 visits b&s have returned the account back to the council and the council have then negotiated , good luck
  6. i wonder if anyone could help , i have several council tax accounts ,1 with bailifs , 2 with earnings attatchments and the current year.This current years payments despite struggling have always been paid , but every month i have recieved a warning letter saying i had not payed that months installment , every month i have had to phone them to tell them i had paid , every month they have appologised and said they took it off the wrong year.This morning i have recieved a summons for 1 unpaid installment , i have phoned the council and they said yes its our mistake dont worry about it. What i want to know is can i take this further , it has cost me a fortune in calls and added to my debt worries , i also see it continuing this coming year , many thanks

  8. im pretty much ok with replying to capquest , but do i need to have the sd set aside?if so how do i go about doing it?do i have to got to court as the court in the sd is not even local to me.
  9. In feb 2008 i sent a cca request to scotcall for an alleged debt of £1500 owed to halifax. They responded by saying the cca was not available at that time and would return to debt to Capquest. In june 2008 capquest again chased payment , when i again cca them they returned my £1 payment and said the account had been put on hold. In july 2008 they wrote saying they were not obliged to provide me with any documents as they had returned my payment of £1. This morning i have recieved a statutory demand for the sum , i have of course got all of the recorded delivery slips , returned cheques and letters from both scotcall and capquest , could someone advise me as what to do next, re -setting aside and responding to capquest thankyou

  11. i have just had a rent increase by £30 to £480 pcm for a 3 bedroom house.Ihave informed the housing benefit but they say they will not calculate my benefit using my new rent because the housing officer said that £450 a month was fair back in july.I have called the rent office and they say it is nothing to do with them because of the length of time i have lived at the property(7 years).Is there anything i can do as we live on benefits and will struggle to find the extra £30 a month , i know im not covered by the new lha rules but that allows for £550 a month for the property i live in so surely the council cant argue that my rent is excessive , the council are saying the rent officer will review our rent next july and we will have to find the shortfall in the meantime , or they have said apply for a discretionary housing allowance , how likely am i to get it?
  12. i have a littlewoods credit card that has been in default for 3 years , i am currently paying a token monthly payment and have been for some time , i have received a statement this morning from them (the first in maybe 2 years) and have realised they are taking £90 a month for ppi , surely they shouldnt still be doing this on an account that is no longer in use? I realise i should S.A.R them but cannot afford to do so at the moment can anyone offer any advise as the debt is just getting bigger thankyou
  13. i wonder if anyone could help , i have had a letter off howard cohen regarding a ccj i have with them , the court set the ccj to be paid at an amount of £1 per month , i have been paying this for 2 years now , they have written saying that they require me to increase my monthly payments or pay the debt of over £1000 in full . They have asked me to fill in an expenditure sheet with my employers details , and if i dont comply they will apply to the court for a formal ammendment of the judgement. i was under the impression that the amount set by the court bound both parties , is that so? how should i reply thankyou

Could find the correct section for this so i put it here! does anyone have any information on credit unions?I have been saving every week at my credit union for about 4 months , now the time has come for me to ask them for a small loan , on the application form it says that they may conduct a credit search to confirm my credit situation. When i started saving i was told that loans were issued solely on the ability to save and repay , im a bit worried that my credit history may affect my application , can anyone help?

  19. an update to this post capquest have written back a brief of what they replied, On march the 27th scotcall returned your account to us as they were not in possesion of a cca for this account , they also returned your payment of £1 as a goodwill gesture. Due to not recieving your £1 fee we are not legally bound to supply you with a copy of the agreement , however we have requested a copy of it from halifax.We are confused by the nature of your dispute please provide more information. Now do i sit back and wait? surely they cannot simply return your payment and then say they have no obligation to provide a CCA , thanks in advance

  21. Could someone help please, 18/2/08 i cca'd scotcall for a debt they were collecting on behalf of capquest for a debt they purchased off halifax! On 7/03/08 i recieved a reply off scotcall saying they were unable to find a cca so would return it to capquest immediately. On 24/6 capquest wrote to me giving me 7 days to pay in full or they will issue a statutory demand , how should i reply being as scotcall have already told me there is not credit agreement for this account and i am recieving calls daily from them.Thanks in advance
  22. i had a prepayment electricity meter fitted in 2004 because i had a debt i could not pay , the debt was collected over about 18 months and was cleared.I then over the next few months found a debt accruing on the account and was told by them not to worry it only due to the bills being an estimate and not read.By 2006 when the debt got to £500 i again contacted them and they told me it was due to the meter not being updated and that they were shortly changing the meters in my area.As at now the meter still has not been changed and they have never in four years made any arrangement or attempt to do so .The debt is now over £1000 and i still wait , i am worried about being able to pay this back as i live on benefit, i have not recieved a statement now by post or online since Nov 2007 , is there anyone who could take this up for me would energy watch be any use thankyou

  24. i am trying to get a safe bank account to prevent the risk of offsetting , i have applied for 1 with the natwest , i didnt realise that they were part of the rbos , and i have a debt to halifax also in the same group , would this account be safe being as they are the same group or does it have to be the same exact bank for them to offset debts , thanks
