They should have an idea what the DG's are doing

Taken from the OFT Debt collection Guidance final Guidance on unfair buisness practices (July 2003) updated (December 2006) 2.6 Examples of unfair practices are as follows: a. contacting debtors at unreasonable times and at unreasonable intervals b. pressurising debtors to sell property, to raise funds by further borrowing or to extend their borrowing c. using more than one debt collection business at the same time resulting in repetitive and/or frequent contact by different parties d. not ensuring that an adequate history of the debt is passed on as appropriate resulting in repetitive and/or frequent contact by different parties e. not informing the debtor when their case has been passed on to a different debt collector f. pressurising debtors to pay in full, in unreasonably large instalments, or to increase payments when they are unable to do so g. making threatening statements or gestures or taking actions which suggest harm to debtors h. ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment i. disclosing or threatening to disclose debt details to third parties unless legally entitled to do so j. acting in a way likely to be publicly embarrassing to the debtor either deliberately or through lack of care, for example, by not putting correspondence in a sealed envelope and putting it through a letterbox, thereby running the risk that it could be read by third parties. Better to have as much info as possible before deciding on such a big commitment.
  6. Have you spoken to an independant mortgage advisor? you could perhaps phone the one in the link. Be totaly honest with them tell them all your concerns and they should be able to advise you much better than me. But my gut instinct tells me that you won't have a problem as a mortgage is a different kind of borrowing than other types of credit. The biggest incentive to keep up repayments is the knowledge that you will lose your home if you don't and they know that. I will say this though it would be better if you could put some kind of deposit down because 100%+ mortgages are generally more expensive.

  9. I don't think you will have a problem. I read somthing the other day and someone's credit score was totally screwed but he managed to get a top shelf mortgage. I'll go and find his thread for you.

This is all they send you unless you get on to them with a none comliance complaint. you can start your claim with the information you have recieved. when you use the spredsheet just put "charges as notified" this will be ok, because thats all they put on your statements. you can if you want to work out all the charges by the amounts charged but it isn't nesassary. Carry on with your claim, stick to the deadlines, giggle at the bull***t letters they send. Good luck Chris
  17. Be carefull what form of ID proof you send, a scanner and 6 sample signatures could be usefull to them!!! don't use any signed ID to prove who you are.
  18. I've Just been reading through the new POC for Halifax. I am trying to fill out my N1 but the POC reads in the past-tence as if the account is no longer open. Is this right or do I need to change the wording to the present-tence to reflect the fact that the account is still open. Sorry to sound a bit dim, but I don't want to mess things up on a technicality.

  20. Sorry I forgot to mention Send Cabot a CCA request You can find a template for doing this in the templates library. I don't know how to link to it. you can't be liable for a card you've never owned, and to enforce the alleged debt they must have a signed copy of the original credit agreement. This obviously won't exist unless as I stated earlier you have had your identity stolen. then you can start getting to the bottom of things Best wishes Chris
  21. Have you checked your credit file? If you've never had a Barclay card why would they be chasing you. Could it be that you are a victim of identity theft! It may be worth checking.
  22. I've just finishid reading through your thread. Most of the advice so far is sound. However I've just had a lecture from one of my union lawyers regarding dispute resolution and his advice is to get yourself an employment lawyer, as it is a specialist subject and some tribunals have fallen down with the lawyer having insufitient knowledge. read dispute resolution on the ACAS website also look at other union (eg:Unite) websites some will have advice. Also try the DTI website you should find some info there as well
