  1. I too have a situ whereby I have asked for an early settlement figure with WF. I took out a secured loan back in 2007, I asked for a SAR approx 3 years ago and there seemed to be the odd 10 pound charge for calls and other spurious late payment charges but limited PPI - well maybe actually there was approx 6 months of PPI. I took out a loan approx for 20k. I have been paying it for 10 years but lowered my monthly payments so that i was only oaying the interest. Anyhow, I have just called for a settlement figure and they are stating it is circa 4 to 5k. My loan was with Welcome and my charge on my house is still present. I am now being asked to sign a form stating that i will not pursue them for PPI if I clear this debt. Adice pls...thanks Andy
  2. It was a simply speed spot on the A1. Police pull. Very jovial, nothing to aggravate and the very nice police chap said don't worry, it wont go to court you can expect a fixed penalty in the post. No previous and well below the 101 auto court disqualification hearing. I was 91 mph. On the motorway. I have full ins and drivers licence. I sincerely think the post has just got lost as the letter refers to my lack of communication re the conditional offer of a fixed penalty hence the postal requisition and court date I'm very confident I've got this right...you see other post keeps coming for the other address up the road (new build housing estate) that also receives my post. My house in number 5 as is hers - I'm Road and she is Close and both have the same prefix. I get amazon gifts and all manner of other letters for her. I've knocked on her door to find out if she has a letter for me but keep missing her and in nay case this has now escalated so stopped chasing.
  3. Hi, i was speeding on the motorway and wish t plead guilty and pay the appropriate £100 fine and take the 3 points. I have been waiting for the [/b]conditional offer of a fixed penalty notice[/b] It never came on the post?! Then I receive a postal requisition to be heard in court. Can I not contact NYP and state that i did not receive the offer of a fixed penalty notice? surely this is unfair to go straight to court if I haven't received the offer to pay via the fixed penalty notice. Any tips or forms or letters i can send as my response guys would be most appreciated? i want to pay plead guilty and have done with this but haven't had the bloody chance. We also live at a new house and our address is proving really hard to locate for many org/co. Lots of mail goes to another house half a mile up the road! Genuine reason and I want to clear this up and pay.
  4. Yes indeed that's my thinking. i've hasd £10 charges, £1.50 charges, old ppi charges and a charge for it being xmas it seems! I'll take your very welcome advice on board. i see from the FSCS website that they were in default basck in 2011 and this could mean that they are unlikely to repay ppi - that said the financial ombudsman or courts would see that i've paid and offset the figure they owe me against the loan i still owe? Thanks again really appreciate advice. Wish they'd just fall of the earth and liquidate but my prayer mat doesnt seem to be working! I understabd i took out the loan but all the under hand charges etc etc i didnt sign up for
  5. Hi, I have a 15k loan secured against a property with Welcome. I've paid the loan since 2007 and am in a healthy state with them. That said I have just sent a SAR and PPI request as I believe there is an issue with my account in some shape or form. If i stop paying Welcome until this is reolved will they put a charge on my property and force the resale? Furthermore can I offer them a settlement figure to finish up amicably? They are registered on the deeds - I think - as a compnay that i do no recognise and are not welcome but an affiliated company seem to have applied to be registered with my mortgage company. Where do i stand can they force a resale if I dig my heels in and say no more m oney until my account is resolved? I smell a rat with my account as my balance also never reduces and there was defo ppi stuck to it - back in the day - but I cancelled it mid term. Pleasae help Thanks

  8. Hi,I have foolishly endured and suffered Welcome finance since 2005. I paid off my old Welc loan with a new one and this old one is classed as satisfied on my credit file and with welcome. My new loan if you can call it that started 2007 - mid year. During this period I have been told of various charges that have been applied, that I do not have ppi attached to my loan (although it could have been attached to my old loan with them i guess). In 2010, they made me an offer 'I couldnt refuse' they halved my interest to push me to pay more money into the account - which i agreed to do. so I increaed my payments of 426 to 636 pm and that was that. I made great strides into the account balance but then all of a sudden after only 4-6 months (lucky I checked) into it they reverted me back to my old interest rate and i was basck on circa 18% AGAIN. I called and complained and they apoligsed and agreed they had not written to me and asked me to sign anyting re switching back. Ever since I've been too busy setting up my own biz and raising 2 kids therefore I havent got round to looking into my account. Can I ask where do i start with welcome and where do i get copies of CCA letters, SAR letters etc? Can I also ask Welcome to lower my interest rate? this will help me pay it off quicker as I cannot afford the 18% they currently charge me. In principle I must have paid off the original loan of 22k by now. My calculation is as follows. .. Original loan in 2007 = 22k. Loan repayments since 2007 equate to 60 months at 426, this totals a payment to them of £25,560. Surely there is a law / agreement to be had to lower the APR as they have their money back by now and all the remaining 16k I still owe is pure interest? My house is secured against the loan and this is listed on my deeds with the registrar.Any advice will be greatly received as I've paid my way with these guys. As a family we've been tortured and this has happened in swarms and the attacks via telephone have been unashamedly brutal to say the least.I've now asked for all comm to be via post - so far so good.Thanks guys ps my account is healthy and I am not in arrears

I have genuinely never received any notification other than a formal charge certificate!My offence was the 9/11 and the charge notice with no right to appeal! was the 9/1/12 (I recived the letter yesterday the 10/1/2013). The annoying thing is that there was no markings, lines or signs on the road / near the road and I was not parked across the kerb. I would have though accepted the ruling due to highway code stips but would have loved the chance to pay the reduced fine...I just did not recieve it AND it was not attached to my car when I got back to it?! Furthermore I have had no chance of paying as I have not recieved a reminder letter?!This is very odd as I have just received the charge certificate with no formal appeal possible. I feel like I've been done by the highway man! What can I do? I've asked for proof via email directly to LCC of the PCN. Do they also have to provide parking pictures of my offence and can i request these? Is there also a process I can follow to state that I never received the PCN? Thanks guys RegardsHeadingley JR
  10. Well I haven't heard anything for 4 weeks so I guess I haven't got anywhere. They would not give me anyway of reporting my complaint and only gave me another name within the office - that's it! If you PM me I can always write an articulate email explaing events and how upsetting it was speaking to such a twit! Thanks and much much appreciated.   11. Thank you kindly Yes I agree they are. I have written without the recorded aspect previously to ask for a settlement figure and they have never responded. I've also been verbally abused down the phone by their deputy manager before. I'm in the process of complaining about him. some of things he said were incredible. He was basically taunting me and suggesting my house was worth nothing and that I can't be worth much if I have to go to welcome finance for a high apr loan. Quiet funny really as my house is worth a reasonable figure and is newly kitted out. Really bizarre chap, maybe he was on his high rolling drugs :-| I was astounded but I suppose if you want a poor job doing, you employ poor people and those that are willing to do it.   12. Thanks for this. I do have a good payment record and have been with them for 2.5 years. I have been late paying on 3 occasions but have always agreed a payback to cover any shortfall. I expect they will accept my reduced offer actually as they know I am a good earner and will secure a job shortly. However I just need an offer of help. I suppose I'm best writing to them and then giving them a call. Cheers
  13. Hi, I have a typical mortgage with the abbey and they provided me with the funds to buy my house. However I took out another loan to service house renovations via Welcome Finance and this was secured on my home. The problem I have is that I have recently been made redundant and need to take a break from paying their secured loan for a short period ideally or at the worst case for me to pay a reduced amount. The loan takes 400 ish per month of my earnings on 10 year plan I believe. What are the consequences and is there any formal process I can follow to make sure that they have to accept my offer. If they do not accepot my offer they may threaten with a valuation and sale of my home but how does that affect the Abbey who are the mortgage provider on my property. Apologies if this has been mentioned in other forums, I could not find my exact issue though when searching. What is the letter of the law and can welcome threaten to have my house sold even though they have not provided me with the funds to buy the house, I merely have a secured loan - my house as security.   14. philips Bailiffs & Magistrates Court - Distress Warrant Hi, I hope someone can help regarding a situation I have with Philips Bailiffs. In December i recieved a parking fine which I forgot all about ubtill we moved back to our property after having to live in a hotel for months. I made an arrangement with them to pay £30 a month for the fine which was then £170, I called 2 days late on the second payment being a new mum and all I just forgot, they wouldnt accept the payment as I was late and said I had to pay them in full, I advised them that being on maternity that was impossible and that could I just stick to the arrangment, they wouldnt let me. Anyway since July I keep recieving letters from them NOTICE OF ATTENDANCE TO SEIZE GOODS, I have called them every week to try and get them to sort an arrangment out again and they wont, I also keep missing the bailiff and keep getting more charges, they wont give me his number or let me know when he is coming round. I have also returned a payment form they sent with there letters and they rejected my offer of payment. Today I have recieved another letter not by hand by post and its heading is OUTSTANDING DISTRESS WARRANT and the bill is now £240 I am asked to attend an amnisty at Leeds Magistrates court on Wednesday. I have called and spoken to the court and they dont think that it is fare but there is nothing they can do, also I have called Philips and they refuse for me to sort out payment of any thing other than full payment. Is there anything I can do because I really feel I have hit a brick wall with this and its really getting me down, thankyou for any help offered. Kind Regards,

  16. Hi, I hope someone can help me with a situation I am having with Philips for a parking fine. I recieved a parking ticket about 5 months ago I completley forgot about it due to living in a hotel with my newborn son, our insurance company had made a bad job at a repair and we had to be moved out, 2 months previous as it wasnt safe for me as I was fully pregnant. When we moved back in I received a letter from Philips for £190 for the cost of the fine, I called them up and made an arrangment to pay £30 per month which I did, but on the second month I had forgotten to call till 3 days after the 1st, they then would not let me stick to the agreement and said I had to pay the full amount, I told them I couldnt due to being on maternity, they wouldnt budge and advised me to wait till the bailiff came round or simply just to pay up front. I then called every week asking when the bailiff would be coming round they wouldnt tell me they also wouldnt give me his number. I then sent of an arrangment to pay on a form that they send you and they wrote back that they rejected the offer, so I called again to make an arrangment and they wouldnt let me again and said I had to wait for the bailiff. Anyway I have come back to today and have a letter saying NOTICE OF ATTENDANCE TO SEIZE AN REMOVE GOODS for the sum of £240. I really do not know what to do I can not just sit and wait around for him not knowing which day or time he may call and I also dont want to pay all the charges, is there anything I can do??   18. Ok thanks, so once this is set aside I have no further contact with SLC as the judgement will be void.
  19. Just a thought but once this is set aside can i then make a CCA request directly to the SLC and also declare that this loan - being pre 98 - is STATUE BARRED.

By the way the judgement was not entered ages ago, I am certain of this as I got my mortgage back in 1999 and I had no CCJ's registered against my name and I currently have none as we stand from this company. This means it is a very recent judgement waiting to pop up on my credit report - I am in constant contact with Call Credit Experian and Equifax so I know exactly what has and curently is on my report.   22. I suppose my next port of call is the courts, this is definetly a fishing exercise due to the lack of information available to me. I have a name of a person who compiled the documents and a reference number/case number. Is it wise to call the courts first off? Also I do not have any paperwork for the loans - there were two taken out between 1995 term beginning and also 1996 - they were both definetly taken out before 1998. Also what does the total and my earnings have to do with anything? That will not make a difference to the CCA status surely??? Thanks for your help guys, If I could just have a bullet point step by step plan of action... for example Contact the courts Gather information Report back - via PM of course Construct legal documents etc
