  1. Hi Skyblue - First time the post 'lost' their AQ. Knowing them I think they will reply to the court but may be late. If you get a strike out like I did they may just reissue the claim. They shouldnt be allowed but DJ allowed it in my case. Fortunately for me the DJ threw it out in court (Tower didn't attend but sent written witness statement). I can't believe your default notice will be legitimate. If so I hope the court have asked for a copy.
  2. Hi Sky Glad to see you still fighting this lot. They are persistant so I imagine they will be back to the court in their own time. With my first claim they blamed postal issues. Did their default notice check out with you. They got mine wrong and they are probably done by the same person! I am still waiting to see if they fancy a third go!
  3. Barker and Lowe are just another desk at Wonga. I always think a CCA is a pound well spent. Will put them on the back foor and make them realise you are serious. As for the default they probably can (not sure if they will). I have not seen their agreement tested for enforeability but there are other Caggers who are much better on this subject than me.

  6. I suspect you will have to go with plan B and hope they won't put on your creditfile. No guarantees but as yet they generally don't. Personally I would rather have the 'black mark' than continually pay the interest on these loans. It really is a personal choice

  9. Your only hope is the bank. As jamie says they are reluctant to intervene. I would explain to them that an associated company of cash genie obtained your details frauduently. Make a lot of noise. Nine times out if ten they won't help but you never know. Make sure you lose card again- just in case. You may have to put this down to experience as cash genie are vile.
  10. The main problem with the I/E form Is that the company could decide what you can afford to pay. Of course if you have multiple debts your available income could change so you need to keep some back. Pde express for example will onlybe interested in maximizing their repayments. They don't need this info and have no right to it.
  11. there is always a chance you can end up in court but if you do you need to do your research and stick to the courts timescales. Above all you need to attend or be at their mercy. So far it would appear debit card loans, tower capital and now cash genie will try the court route. This is the first time I have seen one of these companies win.
  12. Sorry to hear that tweeny. Typical pay day loan response if they have your card details. Report card stolen as pde may decide you owe them some more. I hate to say it but you may have to put it down to experience. Pde don't give a damn about you and will certainly not give you the cash back. Sorry I can't be more positive.
  13. They are just trying to frighten you in to paying. Personally I would send them a cca request and see if they are entitled to collect. As jamie says you are a long way off an aoe.
  14. I think we can agree to disagree jamie. If you read the debt forums you will see that many folk can only afford to make token payments. I have never been unemployed but I can't imagine getting by on what they get. Finally if toothie says that's all they can afford then I for one can't possibly disagree.
  15. Toofie A £1 pm payment is reasonable If it is all you can afford. If it takes you years to pay so what. Despite what wonga might say this is not a priority debt. Stand your ground. Personally I wouldn't even let them have the quid without reaching agreement with them first and have it in writing.

  19. They will have to reach agreement with you or they don't get paid. I think CRS maybe credit resolution services (no personal experience). Its a worry if PTP are passing to others rather than good old Clarity. However if only 6 days late may still be with PTP. PTP may be the original creditor but impossible to deal with.   21. Hit the read triangle bottom left and ask the site team to do it. The company that are doing this to you are powerless when they can't raid your account. They will have to negotiate.
  22. Hi lisa Don't sell or borrow to feed these parasites. You can pm jamie or myself if needbe but please tell us who is being difficult. They can nearly always be stopped. If you can't tell us then then it is difficult but as a rule of thumb protect your income and refuse to pay them until you have a satisfactory agreement.
  23. Barker and lowe do pass on. I have seen them pass on to 1st credit amongst others. Not such a bad thing to be honest. I suspect that the more it is passed on the easier it will be to negotiate on your terms.
  24. Hi lisa You have been too nice so far and they are treating you like an idiot. Jamie is right that all companies act differently. Even on the unlikely event they recognize you there is not much they can do. Don't divulge exact figures etc. Time to stand up for yourself - good luck
