  1. Thanks citizen b The dj didn't seem interested albeit he didn't say no. To be honest he seemed to want me out. He had read all the notes and dismissed the case before I had opened my mouth. I think I will sleep on it. Thanks for that rebuttal statement - maybe to the successes forum:D
  2. Just make it clear you won't pay it. Hold out for original loan plus one month interest only. No agreement - no pay. Have you cancelled your card? You need to stop the roll over situation.
  3. I should have said that they chose to provide a witness statement rather than turn up in court.
  4. Thanks To be honest it depends on the witness statement relied on by the opposition. I basically listed a number of untruths and comments relating to their statement. For example they mentioned serving a default notice and I pointed out that it was invalid. The basic layout of the form was as per the post kindly provided by citizen B.
  5. Well that was quick walked in to the court chamber, DJ said good morning, invalid default notice and case thrown out. Less than five minutes. He basically said that my notice of rebuttal far outweighed anything that Tower had put forward. He aslo complimented me on my knowledge of default notice legislation. Thanks to all those that helped and that sticky about a ' tale of a dodgy default notice' Lets see if they want another go.
  6. This might be worth moving to the legal forum. The first time I have seen Cash Genie go the court route. As far as I am aware there is no obligation to mediate and this can't be held against you. I hope you have logged any threatening calls, letters etc. On the legal forum you may be able to get someone to look at the agreement to see if it is enforceable. You may also get some advice re a rebuttal statement if you want to disagree with any of the witness statement.

  8. Hi abbey Sorry to hear of your troubles. Technically it is fraud. Ring the cccs to arrange an appointment to discuss your finances. I am not sure the bank will seek a criminal outcome but will certainly perdue you fir their money back. Cccs or citizens advice would be a good starting point. Good luck.
  9. Hi Never heard of them. The SMS charge sounds very dodgy. Please tell your friend to avoid payday loans- only misery awaits and the potential for others to have control of your bank account. The money might turn up but I doubt it. Get their debit card changed- they have £3 but access to a lot more.
  10. Sounds like QQ are doing some sort of credit check. This must be a new tactic and perhaps they are checking all their previous customers. Perhaps more of us in the UK are not paying them;) It would be interesting to see if they have recorded anything on your credit file. You could e-mail them and ask them for an explanation.
  11. Hi jamie I suspect you will back tomorrow. CFO will give you nothing albeit I hope I am wrong. All the authorities take weeks if not months to act. Great eventually but won't help you in the short term. Another thing - CFO generally don't answer the phone.

  13. The simple truth is they wanted your card details. Why would they lend to you again when you didn't pay last time. Virtually no way of getting it back. I wish I could be more positive.

  16. Don't know much about this lot but they did get caught without a consumer credit licence last year and had to write loads of loans off. Personally I would just refuse to pay them and see if they fancy discussing data protection in court. A personal choice of course. Also worth complaining to oft and Fsa etc
  17. Be careful with him as his track record is appalling. The fact one month loan were desperate to let all and sundry know that he no longer worked for them as he was dragging their name through the mud tells it all.They are bad but not asbad as Tuvey. Then again maybe he is learning but it will be a turn up for the books if he has your best interest at heart. Never let him have access to your plastic:)
  18. You can't negotiate with QQ unless you can clear within 3/4 months. Best ignore them and wait for Gothia & Muckhall. Gothia will normally accept 50% of the outstanding balance as F & F. Gothia buy the debt and probably pay buttons for it hence they can make generous offers.
  19. They will be lovely to you if you can pay over 3/4 months. If not they will send loads of emails and ignore you. If they cause you any problems post again as they are easily dealt with.
  20. Jamie is right. There are ways of stopping them calling but it takes time and you will have had the calls. Never a bad idea to let them know you will answer your mobile or return their call when convenient. If you ignore them they will call your work. Looking at your user name suggests log book loan issues? - there is a forum on here just fir that if you need.
  21. Hi Jamie I agree with a lot of your comments. We differ on whether you should tell a pay day loan company in advance that you plan to default. Different opinions is what makes CAG great
  22. These companies have access to computers just like me and you. Some companies don't hide the fact and some like CFO have been thrown off several times. Basic rule of cag is that if you are from a company you clear it with the site team first. Not just pay day loans however, they have frequently posted in the dca forum.
  23. I don't think the debt is assigned to clarity they just collect on their behalf. If you refuse to pay clarity they pass back to ptp.
  24. True- but llife isn't always that simple though otherwise there would be no need for companies like Wonga.
  25. This seems to be the way forward with wonga. Maybe they are learning. Errol will soon get fed up with all the emails- hopefully a change of approach from them.
