  1. At the start it said I did but the lady reimbursed this or was supposed to have as a good will but thats where it all started. It kept happening and last going off the man I spoke to said I wasnt put on the proper contract I was supposed to have been put on. So I dont know if my bundle for that time was actually getting the 2gb or a lower amount and thats why all the charges occurred etc
  2. I cant really remember but I do remember when taking out the package once my 24 month £30 contract had ended the man on the phone went through my usage for the 9 years I had been a customer and gave me a package that suited my needs. He said that I didnt need 600 minutes of calls or the amount of data I had on the £30 as I used nowhere near that amount and the £10 one would be more than sufficient. I think it was unlimited texts, 300 minutes and 2gb data but I cant say for certain as its been 4 years since I was actually a customer So do I just write an average email to him or could I use a template as a complaint?
  3. It started with internet charges on my account, when I first contacted them the lady I spoke to refunded the charges as a good will gesture. The next months bill didnt show the refund so I owed money plus my contract price and they were charging me for extra internet again. I would phone up and complain and the call operator would add credits to my account as well as taking smaller payments etc. Everytime I spoke to an operator I would ask them if my bill would be back to the original contract amount the following month and every single one of them told me it would, however the next month would come and id be in the same boat again, charges mounted up until I spoke to a gentleman who told me they had not put me on the right package originally so put me on the "correct package" that id signed up for, I had never used the amount of internet they were saying I used and id been a customer for over 10 years, at the time I was stuck at home all day every day and had broadband wifi there. Month later still hadnt happened, this had gone on for over a year and id had enough I asked for my puc code and left, I was only on a 30 day sim contract at this point id like to mention which was all of £10 per month but was receiving bills for £60/£70 a month until I left. Once I left they started chasing me for the money even though every call worker had assured me my balance would be zero and the only amount I would have to pay would be my original contract price, at most I would only have owed £10 which was the contract price. here I am years later still trying to fight a case that should never have even been an issue. Sent in an SAR and all they sent me were bills, the bills are no good to me as it was the phone operators that were apparently issuing these credits. Also to add Orange has taken this off my credit file even though they had issued a default, I am assuming they are going to have Lowells default me now instead which will start the 6 years all over again. There was only 1 year left of the original default before it would have been removed Didnt realise id pressed 1 year instead of 5 for default *fat fingers* lol
  4. Why does my balance show zero? I am getting so sick of fighting this now, I do not owe it but cannot seem to get anyone to listen or get the proof no matter what legal avenues I explore. What is my next step? Thanks
  5. This is a different thread so don't want it merged. This isn't to do with the first mentioned it's to do with they have transferred the debt. if not can u delete the original so I can post this as new
  6. I have received a letter this morning stating that EE have now transferred my old account to Lowells, however, firstly this account is still in dispute as I do not owe this money to them in the first place and secondly the amount they have stated in this letter of £258.54 is not the amount they have been chasing for all these years. I will state here this is an ongoing case that started over 3 years ago where I have non stop disputed I do not owe this money to them but regardless of my methods they refuse to cease. I have requested am SAR but received nothing but bills around 4 months after requesting and nothing else. The last on these bills was this: Thinking thankfully this is now all sorted I set about trying to remove the default from my account, this is the response I was given when I requested that: My question now is where do I go from here, I have a bill dated March 3rd 16 with a zero balance and an email from there stating the balance is owed on my credit file but have been written off. Where do I legally stand? Regards and thanks in advance for any help Sarah
  7. Thank you for your response. I'm not totally sure what to say is there a template I could tweak that anyone knows of. Thanks
  8. Isnt it now a closed account. I haven't been with them since 2014 and I didn't even owe the money. After my SAR I'm sure they realised their mistake and this is why it was adjusted, you don't just write off that sort of money that you've been chasing for this long surely. I've proved time and time again that I didn't owe it even sending them screenshots of their advisors text saying my balance was now zero so the account should never have been defaulted in the first place. I want the default removed or at least stopped at march
  9. Hi I have had an ongoing issue with Orange now EE for around 2 years. It all started with them charging for stuff that was included in my contract package, I'd ring them and they would wipe it off, however the following month it would appear again and the deficit got more and more so in the end I chose to leave. They have now been hounding me for £214 that I do not owe, I sent them the sar etc and received nothing of what I asked for but a bill showing that they had -214 off my bill so my balance on the account was now zero. Please see attached picture The default on my credit report states £222 which is wrong. I have messaged them and phoned them and they refuse to do anything about it. Can they stI'll default me on a zero balance? I sent a SAR off and received a shed load of bills nothing else, they told me no phone calls were recorded. Surely they cannot do this?, please someone help me Regards Sarah
  10. Hi, I have just checked my Barclays account, only 2 payments ever come out of this account but I am constantly in my £1000 overdraft. I had a letter today saying that I had gone over which came as a shock to me as the money that goes in should more than cover what gets taken out but I havent paid anything towards my overdraft in a long time. They have changed their fees apparently and now I am being charged £26+ a month for my overdraft, I never signed up to this, I had the additions added on back in lets just say 2005 and havent signed or agreed to anything since. Are they authorised to do this and am I able to claim this back under financial hardship does anyone know Thanks
  11. Its asking me to tick yes or no to the following statements: 1. I can confirm that I am willing to compromise on this matter. (Please do not use this service if you are not prepared to move from your current position) 2. I can confirm that there has been no police involvement in this matter at any time. 3. I can confirm that I have enough information about the claim, to allow me to enter into negotiations. Now I am thinking No to number 1, yes to number 2 and im not sure on number 3 because obviously I didnt enter into any agreement and therefore I only know the basics of the proof they have sent in for the claim which is the agreement between the company and my ex. Its then asking yes or no to do I agree to this case being referred to the small claims mediation service. then yes or no to do I agree that the small claims track is the appropriate track for this case... do I say no here because I am innocent?
  12. *Update* I have filled in a defence which they have recieved. Ive now recieved today a Small Claims Directions Questionnaire form which they would like me to fill in, in this its asking if I would like to settle out of court which im not quite sure about because obviously im innocent and do not want to settle nothing unless it entails me having to pay Zilch because I do not owe nothing. On this questionnaire, do I sign that I am willing to go to mediation but stick to my guns that I owe nothing or shall I put that I am not willing and want it settled in court. The solicitor I spoke to told me my case was pretty good and he would expect the judge to see I owe nothing Thanks
  13. His ex girlfriend actually paid 2 payments of £180 to them from her personal account so £360 in total and their claiming for £414.90. Basically they want £774 for printing a booklet. The company is Central House publishings, she ordered with them a 1/2 page advert to go in a local Pizza Hut discount menu booklet. I have just phoned pizza hut to confirm what she said and they are infact in a box in the branch, they are not being delivered to houses they are supposed to go out with the pizzas but this doesnt happen usually, this is the information they gave me. So she was right they did lie to her. Trading standards are not informed as of yet, would you suggest I get him to do this tomorrow?, she complained to the company, my friend havent had chance as today is the first hes heard of it
  14. Well yes by the looks on it although im not sure it would be 100% fraud as she didnt do it for personal gain or to cause loss, from what I can gather she was trying to help his business. However he has since spoken to her and she has stated that they didnt do their jobs correctly anyway. She was told 10,000 copies were going to be delivered around the area however there has been no deliveries, she contacted the company that the publishers were in contract with to deliver them and they are sat in a box in the store. She contacted other people who paid for the advertisement and they were given the same advice and are willing to give her a letter stating this. By the looks on this she was fighting this to begin with, their relationship then ended and she wiped her hands of it. Where does he stand in a court with this?, hes just said he doesnt want to phone the police as she has his son and he can see she was trying to help. He ended the relationship in a way that made her very bitter (im sure we all know the actual reason here without saying it )
  15. I am posting this on behalf of a friend so please bare with me when im answering as I have to double check before I post replys. A letter came through the post this morning from County court money claims centre giving claimants name and address and listing myself trading as my company name with my address as the defendant. I knew nothing at all about this. They are claiming £414.90 plus £50 court fees for services rendered by the claimant for advertising charges on menu booklets. The defendant has failed to make the payments due on their account. The particulars state 'The claimant contacted the defendant on a number of occasions regarding the balance however no payment was recieved'. This is where it gets a bit odd. They claim I am the defendant and that I signed the agreement , they have contacted me on numerous occasions requesting payment. However, on the agreement they have provided as proof it has my company name and my company email address (which I have only now got back because my ex changed all my passwords), my ex girlfriends address, my ex girlfriends name, her telephone number and her signature signing herself as company sec. She has never been company sec or had anything to do with my company may I add. I contacted her and she admitted taking it out and signing it, she had even paid the first two payments out of HER personal account and has offered her statements to show this, she said she was trying to be nice and get more business for me. I knew nothing of this and because we have split up she has stated she is not paying no more and refused to deal with them so this has now landed on my doorstep . Do I owe this money seeing as I know nothing of it?, I didnt sign anything, I paid nothing etc. I have sent in the acknowledgement of service stating I wish to defend this however the place where they have registered this claim is over 300 miles away from myself and I cannot travel up there so will need to do it all online. Thanks
  16. No sadly I havent been, I have no option of this on my phone. To be fair I didnt even think but will find a way of doing it from now on
  17. Hi, I have just come off the phone to vodafone on behalf of my partner, this was the 3rd time this week his phone has been suspended. Going back to the start, back in November he recieved a £500 + bill which I took hold of and spoke to a lovely gentleman in the team. Between us we came to the agreement of £100 a month to pay off the arrears. They took the £100 payment 31st December and everything was fine. Now comes January, the account has been passed to a collections agency and is now £700+ in arrears, how that figure comes about I cannot tell you but this is what they are saying. They have given us till March to pay the balance or his phone is suspended completely. I tried to point out we were paying the arrears just as was arranged, the plan was being stuck to our side its them that have not stuck to the arrangement, to which I was told it was only direct debited for 4 months, well if that was the case the £500+ in the beginning wouldnt even have been cleared so someone is lying here or has made a mistake somewhere. I just dont know how to fight this, for started the £500+ was extortionate but after paying £100 its gone up to £700+ rather then down. Any help or advice appreciated Thanks
  18. Hi sorry for my delay in answering too. I can only make a certain payment a month as im just not bringing in the money that I was but they refused this and want £200 a month which is just no where near possible for me to do. They have already threatened me with bancruptcy, I know they cannot do this as the amount isn't great enough but they are also threatening with baliffs now. Is there any sort of template letter to dispute amount requested I could use? Thanks
  19. No nothing I phoned and asked for copies and they sent out these: Pg 1 Pg 2 Pg 3 Pg 4 Pg 5 Pg 6 Pg 7 Then when I sent them a CCA request I received this: Pg 1 Pg 2 Pg 3 The cover note is exactly the same on both letters and states I owe £1239.93, there is nothing on there to suggest any interest has been added Regards Sarah
  20. Hiya, They sent me a breakdown sheet giving all the amounts but also photocopies of sheets signed by myself, on nothing does is state it is for yell apart from the photocopies show the yell logo on the top of the signed forms. On the cover letter it just says The cheque should be made payable to RSM Tenon Recovery, failure to comply bla bla bla instigate proceedings Sarah
  21. Hi and firstly thanks for looking, I am being chased by a company called RSM Tenon for an account I held with Yell. I sent them a CCA and they have responded with the information. Only problem is, they are chasing me for £1239.93 when I have worked out the amount I actually owe them is £1046.45. It also shows this amount I have worked out on the CCA, I know its not much of a difference but I feel it is rather rude to just add on money without explanation and would like to dispute this debt. Only problem is I don't know where to start in a letter and would be grateful of any help Regards Sarah
  22. She was with Gregory Pennington but I have changed her to CCCS now and that is in the process of going through, we have sent off the documents they wanted and done the incoming/outgoings over the phone. GP was taking £300 a month off her, CCCS has been arranged to take £220 off her which is an ease but not quite a comfortable ease if you know what I mean. she still only has around £50 a week to live on thats without her petrol to work and shopping etc taken off.
  23. Hi, My mum is under a debt management program and struggling to live on £30 a week, its a nightmare. I am now skint because I am bailing her out all the time. I paid off a Barclays account for her £1025 totalling back 2 months ago that she had failed to add in to the dmp, to be honest if she had added it she would have nothing to live on. This is killing her, she managed to beat cancer a few years back, as soon as all this stress started it came back she is now going through treatment again , she is on leave from work, I am doing all the finances and trying to hide everything so its not stressing her out. The £1025 I paid off was on a £250 overdraft the rest was charges, is there any chance on me trying to reclaim these under hardship? I am not up to date with the court rulings now. Also there are numerous charges added to her accounts that are now being dealt with through DMP is it worth me having a go with these also or will it rock the boat? Would appreciate some help, I am going through hell at the moment but just want to help, any advice or links to templates if that is a route I could take would be taken gratefully. Thank you
  24. *UPDATE* Boiler men just came out, I finally managed to convince them to cut the pipe after stating I will go to my MP and any newspaper that will listen to me regarding being left in freezing conditions with no offer of help for two consecutive nights. HA area manager for my area is putting in an official complaint on my behalf as he also tried the out of hours for me last night as did social services who could not get an answer either so it seems both the HA and Boiler contractors are going to be in quite a bit of trouble once this gets done. Main thing is the heating is back up and running even though the water now runs into a bowl that I will have to empty, I will gladly do that till summer if I have too to stop myself and my children having to go through this again!
