  2. hi babycatcher, The simple answer is, if the vol red scheme is not more attractive than the compulsory red scheme, what incentive would an employee have to opt for the vol scheme? Thus normally a vol red scheme is more generous, but there is nothing in law to say it must be. In reality, if you don't feel the vol scheme is generous enough, then do not volunteer for it; it is after all, voluntary! Che NB and do not forget if you have for example, mortgage protection insurance etc, then such policies often do not pay out if you have volunteered.

  3. I agree with your suggested tactic of attempting to settle early in the proceedings. It would be in their interest to settle early sometimes.

  4. What lilly white has posted is how to approach setting aside a previous judgment; bearing in mind that normally the timescale for a set aside application allowed is 28 days.

  6. Ahaaa, So you were an early starter, reclaiming back in 2006. No you don't need to be specific, but you can mention that you require sight of your credit agreement for the a/c (if they send this, it'll be a first!). The SAR will show if there have been any charges added to the a/c since you last reclaimed.

  7. Hi jamdodger , welcome to the forum Right, then - what you need to be aiming for, if there is a considerable amout of these charges - is to get a claim up and running - and eventually to the 'stayed in court' stage ....... However , first things first , you asked for guidance on procedure : Links for new starters http://www.consumeractiongroup.co.uk/forum/faqs-please-read-these/ Templates library http://www.consumeractiongroup.co.uk/forum/bank-templates-library/ I think this should help get you started..... , first off, get your SAR sent off (recorded delivery ) as soon as you can , that'll give you up to 40

  8. Hi, Right, you need to send one to each Credit Card or Loan Account. Don't give them your signature (they can get creative!) just send a PO, not cheque, for £1 with each and print your name on the letter . Send recorded delivery and keep all the receipts as proof. This is where you'll need to get really organised and write down on each receipt which account it relates to. Start a folder with sections for each account and start keeping all correspondence (only deal with them in writing from now on). Once the 12 +2 days has passed you can choose to withhold payment legally if you wish. (That's your choice) until they do. Send the req

  11. Wow, the lengths that people will go to avoid paying money they owe! Reading your post, I can't see any evidence at all to amount to fraud by false representation, it's not exactly something which people get arrested for all the time. However, saying that, I only have your story, which I am not doubting for one minute! I am assuming that you were arrested on suspicion of committing fraud by false representation, and therefore taken to the police station, interviewed and bailed pending further enquiries. Therefore, on attending your bail hearing, you were told that you were being released with no charges. You cannot sue the la

  13. well you need to find out 'what' is giving you a poor score. only you can ans this. you could quite easily go down the route of paying them off on the agreement they remove the late payment markers. they wil play ball. but i would be VERY sure this is the reason your score is poor. my gut reaction is that is not the reason. dx
