  1. Hi guys Any advice on how I can get rid of a CCJ issued by PRAC Financial? My credit report states that the default on my loan with Payday UK (whose debt Prac has acquired) is Satisfied as of Jan 2017. Another credit report says its closed. Unfortunately these clowns still want their pound of flesh. Ive received two letters. One from Northampton County Court about the CCJ and one from BW Legal saying I pay the amount of £1,029. I dont want to pay another £255 to set aside. I dont want to pay anything to remedy? What should I do? Maybe write to the court?
  2. A Builder I paid to do work, did only 70% of the work and more or less abandoned the job for a much bigger project. I had to engage somebody else to finish it. I wrote and threatened legal action, he laughed in my face. I sued in the County Court for £6,500 and won by default because he did not even bother to send in a defence, instead he sent me a check for £1000 two days before the deadline for his reply to the case, asking me to withdraw the case that he will endeavour to pay the balance because he is strapped for cash right now. He then applied for the judgment to be set aside with an N244 application, He lost his N244 application, it was dismissed. He has now appealed that court judgment. In his application he also asked for the court to stay execution of the £6500 judgment I won, pending permission to appeal and subsequent appeal. His reason is that he does not have money and will suffer hardship. I received his notice of appeal by email. (which is ok by me, I have not been served by the court, though or any date given for the case to be heard on this appeal) When I saw he applied for stay of execution of judgment, I drafted a witness statement opposing the stay of execution, I listed his assets, which includes, 2 rental homes, an investment farm, he rents out to a tenant farmer. A small part-ownership of a taxi business (I knew about the assets because he is boastful and boasted about his wealth) I searched land registry and the houses and farm are all his. I sent off the witness statement opposing his application for a stay, by e-filing to the court. Now, the court has written me, asking me to file a respondent notice (N162). (I am a litigant in person) He has a firm of solicitors representing him. I agree with the decision of the judge. I am not appealing the judgment I won. I just sent in the witness statement to show he is lying about his assets and should not get the judgment stayed pending permission to appeal or subsequent appeal. I have tried to fill out the form, but I'm stomped because I don't know if its because of the witness statement I sent in or if its how I am to present my side in the appeal. His lawyers did not file any skeleton argument with their N161, their reason was that they were awaiting further instructions from client. Its over 3weeks now, I still have not seen any other paper work from them. Sorry for the long first post. My question is - Why do I need to file an N162(respondent Notice), I agree with the decision of the judge, I am not appealing the decision in any way. I just want to oppose his application for stay of execution pending permission to appeal or appeal itself.
  3. Can you help me with a ppi claim I have tried to claim. I had a credit card with citibank that was taken out back in around 2000. I had ppi on there which was costing me around £30-£40 per month. I had a CMC who said they could put a claim in for me, this was over 2 yrs ago. After all this time and numerous calls they have now closed the case for the following reasons. Citibank transferred my account to a bank called Opus. This was done without me knowing until I had a statement off them where I called them and found out that my account had been transferred to them for reasons I still don't know. I owed nothing on the card and Opus refused to send me a card as they were not issuing anymore. I can only see my account being transferred because I did't use the card for about 9 months as didn't want to and like I said I owed nothing on it. When the claim was put in and after many months, citi said the account was now with opus and had nothing to with them now, Opus said the account was with citi so the claim is against them. This went backhand forth and nobody would take responsibility over who the claim was against, even though I paid all ppi to citi. CMC sent the claim to the ombudsman and after about another year they replied saying there is nothing they can do and the case is closed with them. Is there anything I can do as I paid all this ppi and cannot get anywhere with it at all. In all the time I had the card I was self employed to and found out lately that even though I was paying ppi I was not covered as I wasn't employed The ombudsman was told this also. Can I get anywhere with this now or is it done and dusted. Please help. Many thanks
  4. Hello guys. So, back in January I was doing some work in Swindon and needed to park my bus. After driving around for half an hour and finding no street parking within walking distance of the job and residents only parking, I decided to park in the local authority car park across the road. The bus didn't fit in one bay, which according to the board contravened the terms of the car park, but I didn't have a great deal of choice and the car park was practically empty, so I bought a ticket and would take a gamble on getting a PCN. After finishing the job and going back to the bus, I did indeed have a ticket, which I had half expected anyway. It gave me 14 days to pay at a reduced rate of £25 and £50 after that point, and within 28 days. If I appealed within the 14 days it would stay at £25 if it was not successful. Using their online system I put an appeal in within the 14 days, as I felt a little hard done by, as there didn't seem to be any provision for vehicles larger than a car. The online system stated I would get a response within ten days. I carried on with life and forgot about it, until... A week ago, a letter from Swindon arrived stating I now owed them £50. It made no reference to my appeal and is the first thing I've heard from them since I entered it online. I gave them a ring to find out what was going on, to be told that they had indeed received my appeal and replied to me on March 8th by email rejecting it. Now, I absolutely have not received any email, or other correspondence from them apart from the letter I received a week ago. I advised the lady of this only to be told that basically it was tough and there was no way to go back to the £25 rate and I would need to stump up £50 now! This seems wholly unfair. Their attitude is 'well we sent the email', so there. Do I have any ground for recourse on this? Fair enough, I've lost the appeal and will now pay, but to lose the right to pay the reduced rate as I've not received their email seems unduly harsh! Many thanks in advance!
  5. I think i am posting this in the correct place, if not please accept my apologies. I have 4 items 2 of which are paid for in December this year and two were new taken out in march this year. Unfortunately i lost my job two weeks ago and have been harassed ever since, phone calls sometimes 10 times a day, now i am ignoring my phone. my wife had the misfortune of taking a call on the house phone from them and received bully boy tactics such as ultimatums of paying by 5 30 or we will get your stuff, my sofa is one of the new items and believe me if i could get rid and get a second hand cheap alternative i would but its not that easy as i have no money and have 4 children who cant just sit on the floor waiting for a sofa to sit on. I will be getting my first JSA payment this weekend do i give them the lot to get them off my back or a percentage of what i receive? Any help or advice would be appreciated. Thank you.

Hi all, About 3 1/2 years ago my partner left me and my baby twins as I was alone and not working the only help I could get was from vanquis, I applied for benefits but they took months to all kick in and we had to eat in the meantime. various things happened, washing machine died a death, needed new fridge, had to move house due to mould problems so the credit card was used. One of my children has a chronic life-limiting disease and I get carers allowance. The problem is, the interest started piling up on the account, and my repayments weren't denting the total balance. I panicked and activated the repayment protection thing which has frozen the account and stopped the interest being charged. The problem I'm having now is that I can only do this for two year, and I'm coming to the end of the two years and will still have £2,500 approximately, to pay them back. I've been combing the internet for what to do but the only advice I can find is about debt management or ivas and the like. I don't have any other debt, just this. I don't know what to do, obviously I want to pay the money, I don't expect to get out of the debt. i used the money I should pay it back, I'm just worried that my payments will never clear the interest and it will get more and more out of hand. Please help!!
