      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I have just registered on here and have been trauling through the links trying to find what i need. I had about 4 or 5 loans with Blackhorse, HFC and Paragon over the past 8 - 10 years but do not have any account details. Can i still chase these with PPI as the Paragon one was for House Improvements and a substantial amount.

 

Any help would be appreciated.

Hi Grant and welcome to CAG

 

If it were me I'd send a Subject Access Request (SAR) to each lender. There is a template in the CAG library, the link to which is at the top left of every CAG page in green. Cos is £10 and they will have 40 days to comply.

 

Make sure you add a line that says that the SAR is to include copies of any and all agreements you ave had with them.

 

If you haven't got account numbers then make sure you give them your full name and the address(es) you were living at while the loan was active.

As long as you can provide all addresses from when you had the accounts

and some dates they should be able to trace the accounts in your name.

You could contact them with your details and request your information under the data protection act.

 

Im sorry I do not know the working on actually claiming back PPI, but I do know that they have to provide you with your info.

 

Someone cleverer than me will be along soon im sure :-)

Hi Again,

 

I have today received information back about 3 loans from Paragon Personal Finance dated between 2003 - 2005. All 3 loans i had taken out Joint PPI. In total the PPI for all 3 loans amounts to £12,800 that is without interest added. All 3 loans were paid off early, can anyone please advise me on my next steps to take.

 

HFC have also replied but require a copy of my driving license or passport and have returned the £10 cheque. Do i need to resubmit the SAR, cheque and a copy of ID now or just a copy of ID?

I will take a look at the calculations but to be honest i dont understand most of it.

 

Is there a set letter to send to Loan company now they have responded with account number and full breakdown of the accounts after the initial SAR?

 

Do i need to request the full amount of PPI plus calculations or do i hope they do it on my behalf. I am just worried i may get it wrong.

Go through it slowly and you may find it will click.

 

The idea of doing your own calculations is to satisfy yourself that any offer they make is correct and that when you send the spreadsheet to them it shows that you know what you're doing.

 

The idea is that you send a copy of the spreadsheet and a completed fos questionnaire to the lender with a brief letter requiring refund. The questionnaire is available from the fos website.

 

Have a bash at the figures and if you get stuck, I'll help you.

I have filled out the FOS questionnaire ready for all 3 Paraon Loans. I have done these seperately as 3 different accounts numbers. I will try and work out Interest. On the statements they have sent me the 3 PPi amounts are £5000, £4900 and £2000. All loans were paid of early so am i claiming all 3 full amounts plus interest? I hope thats correct..

ok these are the figs you gave for loan 1

 

Loan 1:

Loan Amount £20,000

Payment Protection £5,000

Monthly rate of Interest:0.674%

APR: 8.4%

Anticipated Monthly Payments: 180

Monthly Repayment: £240.19

9 payments made @ £240.19 then repaid

Interest: £16,733.57

Interest Rebate: £15,888.71

PPI Rebate: £816.72

Admin Fee: £150.00

Redemption Funds: £24,515.35

 

PPI is 20% of the total loan (5,000 / 25000 x 100). That means that 20% of each payment made was for ppi. Monthly payment is 240.19 so 20% of that is £48.04. No you don't put in the original £5,000.

 

You are claiming that £5,000 back by way of the instalments you paid and the final settlement figure.

 

Think of it this way, you did not actually part with the £5k at the start. The bank loaned you that £5k over a period of time and you repaid it by 9 instalments and then a final settlement. So you do still get it all back but the dates you actually parted with your money are important because it is those dates that are used as a base for calculating the 8% interest.

use this method by dx100uk BUT REMOVE PERSONAL INFORMATION FIRST)

 

scan the required letters/agreements/sheets

as a picture[jpg] file

don't forget you can use a mobile phone

or a digital camera too!!

or convert them to .PDF

ENSURE: remove all pers info inc barcodes etc using paint program

but leave all figures and dates.

 

goto one of the many free online pdf converter websites

it would be better to upload a multipage pdf

than many single ones

or if you have PDF as an installed printer drive use that

or use word and save as pdf

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB:you can set where it goes in the post by hitting insert inline.
