      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Should i tell Paragon i have changed the date of interest in my letter and that i will expect interest added up until the date they pay me? Or is that too pushy?

Hi

 

I'd change the one in #48 as it reads that the only reason you are claiming is the fine they got.

 

I'd just say here's my papers (questionnaire and spreadsheet).

 

In addition I am aware of the fine etc etc.

Please find enclosed copies of questionnaires and interest calculations regarding a loan that we have had with your company in the past, with what we feel was miss sold Payment Protection Insurance. Please arrange for us to be reimbursed for our claims.

In addition I am aware of the fine your company was handed for the miss selling of PPI and I attach the report I have read

Ok both letters 1 more to Paragon and 1 to loans.co.uk were signed for this morning and POD has been printed and added to my file. Lets see what kind of response i get from Paragon this time. Also be interesting to see loans.co.uk response to my claim....:|

I have still not received any response from Black Horse - SAR sent 25/4/12. I know they still have 12 days to respond but i want to get my letter ready. As i do not have any account numbers how do i ask for the info again? This is my letter so far what needs adding?

Thanks ims, i have looked at it but it says to put your account number as the reference. I dont have any account numbers, thats my question

Just give them the same info as you gave in the original SAR.

 

Account numbers are not needed to trace peoples data...they will be able to do it from full name and address(es) a data subject was living at

I have today received a response from Paragon:

 

As advised in our letter dated 15 May 2012. Paragon was not responsible for selling a payment protection policy to you. The broker was responsible for the sale of the loan, the sale of insurance was not regulated by the FSA and i suggest that you contact your local Citizens Advice Bureau directly, if you have not already done so.

 

I trust that this clarifies our position in this matter.

Hi

 

I would run it by fos first to see if they will take it on. Some lenders tell you that you can't go to fos when in fact you can.

 

Indeed I remember one instance where Barclays said this in writing to a member and fos were surprised that they had said that.

 

If not then the FLA may be able to help or indeed court is another option but with court the civil burden of proof, i.e. the balance of probability will be on you.

Got a response from HFC this morning saying i will have my SAR information within 40 days dated 29/5/2012. I sent the letter on 10/5/2012 is the 40 days from my date or theres? I have a phone number provided by them, shall i call and suggest its from when they signed for my SAR letter?
