      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

DPA sent today for charges incurred during the short life of a CitiCards account 2003-4, I wish that I had kept my statements, I only kept the last one which said that I had a credit balance of 64p

Still no reply from CitiFinancial

 

Yes hey have their own form and will ask for 2 means of ID 1 for name other for address.

They will also try and say the timescale will run from them rec this.

You dont need to fill in their form if your original dpa request was clear in what you are asking for.

The guys name who deals with all the prelim stuff is called Richard Cooke he is a dpa officer for citi and based at their hq in Manchester.

His number is 0800 569 569 its a freefone number.

 

All my comms with them have been sent back to me via rec delivery and my statements were sent by special,meaning if you are not in you will have to go and collect from the P.O.

 

Hope this helps,but unfortunately they wont rush to get the stuff to you before their 40 days are almost at an end.

Well I've had statements back from Citbank and a covering letter. AND I'M FUMING!

 

It appears that the account was still active until I rang their call-centre to tell them to close it! This is despite me filling in the proforma on the back of each statement for three months up to June 2004 when I sent them a closure letter.

 

It seems that the statements continued to be sent to my old address- we moved in April 2004. Correspondance continued according to the DPA listing including issue of a new credit card, god knows where that went. To add injury to insult, even the reply to my DPA request was sent to my old address as well by special delivery. This is despite the covering letter using my present address!

 

What a ***ls up. Should I make a complaint about this? But who to.

 

On a brighter note the £125 of charges accrued by the account in less than 12 months has grown to just over £300 thanks to the extortionate 2.529% per month they charge.

Have you any proof that they were notified about this lot ?

If you have,and if you have copies of any letters you sent then you may have a good case.

As for the special delivery ......this HAS to be signed for and after the holding period would have gone back to the card issue centre.

At least you can move a step forward.

Had a very prompt reply today (letter dated 10th August 2006) from Matthew Jones at The Office of the Chief Executive no less!

 

He writes,

 

Dear Mike 220359,

 

Thank you for taking the time to write to me about £311.54 in charges applied to your Citi Card Account.

 

On Wednesday 5th April 2006 the OFT issued a statement regarding the default charges levied on customers by credit card issuers of contract..... (blah blah)

 

Although not a party.... (blah, blah)

 

In order to remain competative .....(blah, blah)

 

I understand that this was not the outcome you would have hoped for and if you would like an indepndant review of this, you may refer to the Finance and Leasing Association. You may also contact the ....(blah Blah blah)

Had the exact same situation as you, first got a letter from Matthew and then after the LBA from Brian Smith.

 

I have taken citicard to court now as they have refused a full refund (only give the difference between £12 and what they charged)

Further to post 13.

 

After the reading the letter attached to the cheque for £65 it seems that it mirrors that of others. Like most solicitors letters (in my experience) it is inflammatory and designed to intimidate or promote a comeback, I assume for which he will be able to charge 'his client' for a further letter.

 

That said he couldn't be bothered to sign it himself, must be workload, got his secretary ''pp'' it for him.

 

I'll write to him thanking him for the part payment and telling him to copulate off, then file the moneyclaim next week, when I get paid.

Hi I am having fun and games with Citi Financial. My account was sent to Cabot but I wrote to Citi asking for charges. received an amazing quick letter asking me to fill in their Data form. Do I need to fill this in? also sent by recorded delivery posted but not signed for!!. Cabot also sent me a letter requesting payment (£2090). Has anyone had experience with Cabot? and do I ignore them and continue to deal with Citi. confused, confused........

I had a similar thing with my DPA request, they didn't sign for it so I rang and comfirmed they had it, they will hold out till the last minute to send you the data.

 

Sorry have no Idea about the Cabot lot, but I'm sure someone else hase dealt with them, and can offer some advice.

:rolleyes: You do not have to send Citis Data Protection Act form.

However they are within their rights to ask for proof of name and address.

Send them copies of that.

Also be clear as to what you want ie copy statements/account transactional info from ....to.......

 

They are becoming an absolute pain.........in fact they are probably neck and neck with Abbey for the title of staller of the year award.

Had a rather terse letter from Citfinancial today rejecting the claim except for the £65 cheque that they sent me. To be fair it seems a standard letter not personally adressing any of the issues oh well of to court.
