      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I sent it away and it was signed for on the 7th March. I just phoned them up to check up on it and they say they have no record of it. It was sent special delivery and I still have the wee slip.

 

I'm on hold right now and have been for 15 minutes.

 

Obviously it looks like I'll be reporting them to the information commisioner as they only have 4 days left. :-x

 

How quickly do they produce the statements after being reported?

They can fight for the full 40 days, but most people get them at this point. The non compliance letter normally does the trick if not...

As long as you have proof it was received, then that is their own fault!

 

And the person on the phone should be able to order the statements.

I gave the woman on the phone the code to track the delivery on the royalmail website. It was a postal order I sent. I don't know if they cashed it.

 

She took all my details and said she was passing it on to the department that deal with the requests for statements.

 

I'm now waiting on a phonecall from them.

 

Not holding my breath.

 

I won't be phoning them again. I'll just wait until the 40 days are up and send them a nice letter.

first time here sent first letter of with ten pounds 28th feb kept being told still not found it they had two days left rang trinity road and hey they said it was there rang again 2 days later was told sorry cant find it but we send your list of charges out to you got them 2 days later total 12.370 for the last six years have sent second letter of recorded delivery waiting for there reply fingers crossed

Hi Tilly.

That's quite a tidy sum. Is that all charges?

Anyway, to work.......

 

Start by spending a few days reading the FAQs and the step by step guide in the library section. That will give you a good grounding in what is to come.

When you're happy with that, open your own battle-thread in the Halifax Forum and use it to post any questions and progress reports. If you can keep it up to date, it will make it easier to help you should you need it.

Read some of the longer threads in the Halifax forum to get some idea of the action.

hi can anyone tell me wot to expect now i have sent of my letter with my printout of charges also i had a phonecall from halifax as i was overdrawn asking me when i could clear it ,also im a bit worried because of the large amount the charges total to 12,370 whether they will drag there feet or make it difficult

posted 14 day letter registered post on friday just went on post office tracking site and its been delivered and signed for see how long it takes them to reply sent this one to trinity road and not buisiness risk centre made that mistake with first letter

if anyone sent there 40 day letter to buisiness risk centre and have been trying to ring them this number might come in handy 01422 3326398 you might get a recorded message but dont give up keep redialing you will get a human eventually

I took 14 days from the date of my letter and not working days either.

The only letter I have from Trinity Road gives this phone number 0870 850 1298 and the FAX:- 0113 235 7204. Open Mon - Fri 8.30am to 7.30pm and Sat 8.30am to 12.30pm.

Hi tilly. I'm not to sure of whether it will affect your claim or not. Try and get an agreement in writing before you start claiming and check the agreement over thoroughly. It may state in the agreement that they can request the money back at any time.

 

On a different note. Try and keep to one thread at a time. Just use the "Post Reply" button at the end of the page of your post. It will make it easier for people to see what is going on.
