    • Hi All I know this a long shot but ha anyone got any advice please? Nearly three years ago (maybe more) my ex took a contract out for a new phone for my birthday that I ended up paying the bills on (lovely present huh) I have always paid the bill for this. The phone number that I have had for most of my adult life was passed over to this contract and I am old now haha We are now divorced and have not been in contact  - he is abusive and I have nothing to do with him. I cannot enter into any dialogue with him whatsoever. I have continued with my phone contract and number etc but am stuck - I have no access to my bills even though they come out of my account - as the contract is in his name I cannot get a pac code to move therefore I will lose my number if I cancel- sky just quote data protection at me which I get but this is soooo frustrating!!!! I know that the sensible thing would have been to just l cancel the dd lose the number get another contract elsewhere and get over myself and move on but I am just asking out there as a final desperate attempt - can anything whatsoever be done??? Thank you in advance :)
    • What's your intent, or interest? I can't see that you have any cause of action regarding bills issued by one third party to another third party. Is the idea to use this as a lever "I'll denounce you to HMRC unless you do blah blah .." That might in fact have no teeth anyway, HMRC will aware of the company's turnover via their other tax affairs.  As a matter of fact a company buying VAT rated supplies and selling to VAT registered customers is actually worse off if not VAT registered themselves. Has your court case reached it's conclusion yet?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Got my papers back from the courts yesterday and i assume Halifax received theres also.

 

Do i hear again from the courts regarding a date for the hearing? or do i wait for Halifax reply to the courts? or do i wait another 14 days for a reply of some sort?

 

had a good browse through various threads but cant see which one of these options is correct. i dont want to sit here waiting for a reply from halifax/courts if i shouldnt be.

 

I assume i wait for second contact from the courts but just to confirm please, thanks.

p.s. Got a freebie off Tesco express saturday night. was out for my Bday heading up north for a night out. put £12 petrol in and bought a cpl of sandwiches on offer at 40p each and some crisp. total was £13.54, so gave the cashier 2 x £10 notes. Cashier gave me a £10 and a £5 and some change with the receipt. so i got out of the shop as quick as i could and left their property. On inspecting the receipt the cashier had rang in a £10 and a £20 note giving me £16.46 change.

oh how i laughed up the motorway. Cheered me right up. :)

Charity Group £200 compo for lost passport.

HM revenue & Customs; demand for WTC overpayment £632.12. Disputed, their error. Did not have to repay.

They have 14 days to reply from date "deemed served" on letter from court, check with court then to see if they have acknowledged service. if they have they have a further 14 days from date deemed served to file defence. If they have not acknowledged you can file for judgement. Use bottom half of letter from court.

yea the papers are stamped from the 13/8 so the deadline for hearing from them should be the 27th. im away on the 27th til the 31st so will have to preceed when i return.

If the Notice of Issue stated the 13/8 then they have till the 10th Sep to reply. This is the full 28 days.

 

That is they have 14 days to Acknowledge --27/8

(They usually do)

 

Then from 27/8 another 14 days---10/9 to file Defence

 

If you dont hear anything after this date then you can File for Judgement by Default.

 

Try to get this in as soon as you can , dont give the banks anymore time than is neseccery.

Hi all

 

Having returned from my family holiday, on my doorstep were 2 letters.

 

1 from Optima legal services & 1 from the courts confirming the Halifax defence.

 

Having a read in the forum the Optima is the standard letter, nothing more, nothing less.

 

ok, that said and done im awaiting the courts for a date of hearing, correct?

 

in the mean time, since i submitted my claim in the courts i now realise it was important to point out that i was on benefits at the time. Only finding out after ive submitted my claim, how do i go about submitting this 'further information' ?

 

i still havnt got round to getting a letter from social security but will do this coming week if they agree to do it for me.

 

im now going to have a good read of the past week or 2 threads as ive been away.

Hi Foo, hope you enjoyed hols. have you rang court to see if they have filed defence there, if they have not you can immeadiatly file for judgment. They do make mistakes sometimes, so it prob worth a phone call. If case is stayed by bank or court you can use fact that charges are from benefits to have stay set aside. I am not sure how you submit "further Info" but I am sure some one here will advise on that, you can also ask court when you phone them. I would hazzard a guess that you have to use N244 application form, but this is only my opinion, which is prob wrong.

I think if Im not mistaken that you can amend your POC by paying a further £35 but Im not too sure but could be worth you ringin the Court to find out as Im sure it will be worth it in the end.
