I am just moving the last of the stuff from the caff..........borrowed the mates transit.......its not the end tho......Col told me that he has had a few enquiries

Hi all,

 

Glad to see you are all keeping up the good fight.

 

I am at the stage where i have a court date of 30th November, my claim is for 1980.00 in cahrges and 100 + 120 court fees, Cobbetts made me an offer of 1100.00 on 6/10/2006 which i declined verbally over the phone, i have not heard anything since then.

My bank are continuing to apply charges to my accounts and this is now snowballing, i have today phoned the bank and requested that they refund the charges back to my account(the ones that i have incured since i started my claim and are not included in my original claim) less the 12 quid that has been deemed as a fair charge i.e:

38.00 charge, less 12.00 = requested 26.00 refund on each occasion, the woman i spoke to at the bank was very rude and refused to even look into it, this has now rattled my cage again and i am on the war path.

 

Q What is the best way to go about claiming these more recent charges back, i think i have seen somewhere on this site that you can add these charges to the original claim, or is it better to start the whole process again for these latest charges?

You cannot add them to the original claim since that would make both your claim partics and spreadsheet wrong from the original filed claim.

You could do this as an ammendment but it will cost you 65.00 which is not recoverable.you would also have to wait for the Judge to consider whether to allow it.

There are 2 other options then.

You can either ask Cobbetts to consider adding these to the final settlement which they would need instructions off the bank first.....or you can do another claim after this one is finished.

I understand that once an offer is made and turned down that Cobbetts have to wait for the bank to give their instructions before making further moves.

Its not as some think,an automatic decision to give the refund a couple of weeks after a refusal.There are other issues too some of which unfortunately I cannot fully explain on here for obvious reasons.

Hello All I Have Been Going Through All My Statements From 00-06 And Have Come Across The Usual Charges For Cheques And Dd`s But For Some Reason I Have Noticed Other Charges Which Are Referral Charges Ranging From £10-£90 Does Anyone Know Of These And Can I Claim Them Back,need Help Too Busy With Work Never Seem To Have The Time Thank You To All Who Can Help

Is this a standard or royalties Gold account ?

You can claim everything except the monthly subscription fee if it is a gold.

Are these charges showing at the end of the month ?

it is likely that the 90.00 is for 3x30.00 charges.

Referral charges are claimable.

Firstly its not my brief to suggest that and I really do not see the point but more importantly you will not need to do it.

There will be long periods beteen the stages of the claim whereby you will not need to do anything.

The waiting is probably 90%.

This does not lessen though the understanding of the process which has to be the full 100%.

Although this a self help site the teamwork here and the ability to get help from the members is something I have never seen anywhere else....and dont think I will.

Our nimbers are fast approachimg 100k and we have seen many people here from all walks of life go on to win back their money.

At the end of the day this is your money and better in your pocket than anyone elses !!

Even after so long........its great to read this thread again......anyone who has doubts and concerns.........who gets to a point where they feel like giving up..........where uncertainties can creep in........and when Cobbetts start to pile on the pressure.....reading Big Cols story is a breath of fresh air and gives a jolt and an incentive to push on.

A truy temarkable thread and one which inspired so many others.

So sad that it came to a conclusion......but yet good that Col was able to finally able to put his time to other uses.......Drove past the cafe last week and the shutters are still down........but the memories of all that was discussed and planned over the tea and bacon butties will live for a long time.:)

Actually since the days of BigCols claim,there has been some changes.....one of those is the Bank (both RBS and Natwest taking a greater role in looking at claims at an advanced stage...or even offering settlement very early )

Dont know whether this was a cost saving thing or a temporary offloading to clear a backlog.

Lyndsey will know the answer......but I cant see her telling...........

Hello all,

 

I have been very busy on behalf of the British Tax-payer and unable to keep up to date with CAG matters, glad people are still reading 'my story' though, all I can say is that whatever happens, keep cool and keep checking the latest on the CAG, ask if you don't understand and read as much as you can. It is so worth it in the end, just getting your money is great, but knowing that the Bank has listened to you (not just a number) is a great feeling.
