      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Would just like to add my CONGRATULATIONS as well. Its great to know that our perseverance is working and i have some good news myself

 

I got sent a cheque this morning from American Express Credit Cards for £55.95

in response to my LBA, However I was claiming £75.95. Basically they have refunded the difference between what they had charged me in charges and what they say OFT say is acceptable (£12). A lot of credit card companies seem to be offering this.

 

I'm not sure what to do. Should i accept the cheque, or should i accept the cheque and write back and say i still want the difference of £20, or should i send the cheque back and tell them i want the full amount and am willing to go to court for it ?

 

What do you think ?

sup to you, depends how desparate you are for the £20 and how far you think AE will make you go? That's not a bad result for such a lesser amount, but is the extra hassle worth it for £20? You may wish to ask this question on your own thread so that you get specific answers!

I personally think i would be happy with the cheque for £55.95. My next step would be to go through small claims court and thats going to cost me more than £20, so maybe i'm better to take what i'm lucky enough to be sent on this occassion. If i was claiming for a lot more than maybe that would be different.

No news from me .....still waiting....it's all gone quiet on the cobblers front. This really seems to be dragging on and on.

RBOS: Fob off letter recieved 28th June.

LBA for £2,690 & LBA for £3,240 sent 1st July. Replt to LBA'S recieved 14/7/06......fob off again!!! watch this space

Well they are gonna have to start defending sooner or later........they cant hold all the claims up........anytime soon now they either got some mega defending to do .or start paying up.

Been watching these RBOS threads for a while whilst preparing myself for our "big fight". Started a thread sent my prelim and prepared for a lonnnnnnng battle. Was offered a partial refund which I rejected and off went my LBA for just under £5k. Was due to start moneyclaim today, had interest all worked out when I got an offer on Sat. FULL SETTLEMENT!!! Can't believe it. Maybe RBOS have finally realised that cobblers is just a waste of their cash lol. Or perhaps tommy was having a good day?

They say the settlement will be in my account within 5 days so all excited here. Will be able to sort out our finances and have a relaxed christmas with the kids. Really chuffed for all you guys that have won so far. Will keep watching everyone who is still waiting and I wish you all luck.

Go Col must be you next surely?

I posted here a while ago, but thought I really should catch up and see what is happening with everyones claims.

RBS currently have 5 days left to reply to after accepting my claim and yes Cobbetts are 'dealing' on behalf of RBS. I am waiting with baited breath. I am fully expecting them to defend on the grounds that they do not know who I am due to a typo on my claim through mcol (can you believe I mistyped my own name??) Still I have completed all relevant forms to rectify this and sent them off accordingly.

 

Will be interesting to see what happens next and how much clser I am to getting back my two whole terms worth of student loans that they 'borrowed' from me in the guise of 'fair and transparent charges'. The entire affair would be funny if it wasn`t so utterly rediculous.

 

So I wait patiently with baited breath for the next step in my claim, though after the good will offer of 500 odd quid aganst 3000 in charges I have the distinct impression I will have a long journey ahead of me yet.

 

Still we fight the good fight and take pride in setting the way for the next generation, or maybe this generation.

Had a cheque sent to me from Amex for 55.95 (i'm claiming 79.95). Have declined their offer and am sending cheque back. Do you think this letter is ok (have used most of the template) ?

Thank you for your letter dated 26th September 2006.

I respectfully decline your settlement offer of 55.95 and request, once again, that you return to me all charges imposed on this account, totalling £79.95.

The cheque you sent me is enclosed with this letter.

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

My letter before action sent previously indicates that you have until 9th October 2006 to respond before Court action commences. However, as my gesture of goodwill, I am willing to extend this date until Thursday 12th October. You are hereby reminded that there will be no extension to this timescale.

I trust this clarifies my position.

Never got as far as dealing with cobblers here. Just RBOS themselves perhaps they were feeling generous lol. Hope they hurry up and give you guys your settlements soon. Still waiting on the payment tho, will it turn up lol.

Okey dokey,

 

I started this thread on 19 June, nearly 16 weeks ago! My Court date is 6 November, and all is quiet on the Western Front. The claim is now £3246.70, plus £300.04 interest plus Costs (£250 ish), now £3796.74!! I can't even work out what that grows by each day!! If this is a standard month (which it more than likely is!) I can expect another £118 in charges before the end of this week (account charges + referral charges). I can't wait for this to be settled, oh how I will laugh!!

Thanks Alibobsy, got that letter off today and will be doing all the paperwork to take Barclaycard to court tonight. Also Marbles had until yesterday to reply to my LBA and so far nothing, so will be doing that court one too. Will be very busy tonight me thinks lol.

I am including copies of the charges i am claiming (got from templates) can i put on this sheet a claim for recorded delivery which was 3.00 and the 39.00 its going to cost me to file in court.
